City of Jerome, Idaho FIRE DEPARTMENT OPEN BURNING PERMIT REGULATIONS Please follow these directions very carefully, should you have any open burning questions have them answered prior to conducting your open burning. By answering your questions prior to your open burning you may prevent a needless fire department response and the related costs to you the tax payer. 1. Burning Permits A. Burning permits are required for all open burning in the City of Jerome (Ordinance 912) 2. Minimum requirements to conduct open burning A. A valid burn permit B. Burning shall not be conducted within 50 feet of any structure or other combustible. Clearances may be reduced to 25 feet when the burning pile size is 3 feet or less in diameter and 2 feet or less in height. C. Any conditions that could cause the spread of fire shall be eliminated prior to ignition D. A competent person of mature age shall constantly attend the open burning until the fire is extinguished E. A fire extinguisher, garden hose or other on‐site fire extinguishing equipment F. No burning shall take place when weather conditions could create a nuisance to anyone or the property of anyone in the vicinity such as, an air inversion condition G. No burning shall be conducted prior to sunrise and must not continue after sunset H. No burning is allowed in any street, alley, highway, or between any street and curb 3. Examples of illegal burning A. No valid burn permit B. Burning before/after established burning hours. C. Not complying with the minimum requirements as stated in the ordinance D. Burning on a NO BURN DAY E. Burning commercial or industrial wastes F. Burning of materials which emit dense smoke, noxious odors or create a public nuisance such as but not limited to garbage, paper, boxes, furniture, bedding, plastics, wire insulation, waste, petroleum products, rubber products, noncombustible trash including metals, tin cans, glass, animal remains and animal or vegetable waste resulting from the handling, preparation, cooking, or service of food is prohibited G. Burning in the Central Business District without approval of the fire department 4. Open burning in violation of the ordinance will be extinguished and may result in a misdemeanor citation 5. Any burning permit may be revoked by the fire department or police officer at any time for any violation of these rules or Ordinance 912 6. You are responsible for your burn A. Open burning authorization by these rules does not exempt or excuse any person from liability' or consequences, damages or injuries resulting from open burning, nor does it exempt any person from complying with applicable laws, ordinances, or regulations of other governmental agencies having jurisdiction 7. Prior to conducting any open burn, ensure that burning is permitted in the Twin Falls area A. Check the Idaho Department of Environmental Quality (DEQ) web site at http://airquality.deq.idaho.gov/ which is typically updated daily at 11:00 AM B. Follow all State of Idaho rules for open burning found in IDAPA 58.01.01 ‐ RULES FOR THE CONTROL OF AIR POLLUTION IN IDAHO C. Monitor the fire – you must be on site while the fire is burning and have the permit in your possession 9. No burning when winds exceed 10 miles per hour or when fire danger is VERY HIGH or EXTREME 10. Burning of fields greater than 1 acre may require an on‐site inspection by the fire department 11. Recreational fires do not require an open burning permit. However, all safe burning practices and rules must be followed. A. Recreational fires include camp fires, barbecue grills, barbecue pits, and outdoor fireplaces with a total fuel area of 3 feet or less in diameter and 2 feet or less in height for pleasure, ceremonial, cooking, warmth, or similar purposes
