Special Use Request: Staff Report I. As pertains to Title 17 of the JMC, the Land Use Ordinance a. The property in question is currently zoned Residential 1 as detailed in 17.14.010 of the JMC. b. The proposed use, a family childcare home with five or fewer children, requires a Special Use Permit in the R-1 zone from the Planning and Zoning Commission as detailed in 17.14.010 of the JMC. II. As pertains to the City of Jerome’s Comprehensive Land Use Plan a. This request complies with the Comprehensive Plan as relates to Chapter 6, Our Quality of Life, Goals: Foster a supportive, healthy, and resilient community of residents, rooted in Jerome’s rich history, that collaborates to welcome visitors and newcomers, and offers opportunities for everyone to live, work, and play. III. 17.60.030: GENERAL STANDARDS FOR SPECIAL USES: The commission shall review the particular facts and circumstances of each proposed special use in terms of the following standards and shall find adequate evidence showing that such use at the proposed location: A. Will, in fact, constitute a special use as established in section 17.60.060 of this chapter for the zoning district involved; • Staff Analysis: The Planning and Zoning Code allows family childcare with an approved special use permit in the R-1 zone. B. Will be harmonious with and in accordance with the general objectives or with any specific objective of the comprehensive plan and/or this title; • Staff Analysis: The request appears to be harmonious with the objectives of the Comprehensive Plan and Title 17 of the Jerome Municipal Code. C. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water and sewer and schools; or that the persons or agencies responsible for the establishment of the proposed use shall be able to provide adequately any such services; • Staff Analysis: No additional services will be needed to serve this use. F. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; • Staff Analysis: In-home childcare does not create excessive additional requirements at public cost. G. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; • Staff Analysis: The hours for the childcare will be 7:00 am to 6:00 pm Monday through Friday. The families can pull into the driveway or there is on-street parking. The hours of the childcare and the availability of parking will not be detrimental to any person or property. H. Will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public thoroughfares; • Staff Analysis: This use will not impact or change vehicular approaches. I. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. • Staff Analysis: It does not appear that the proposed use of this parcel will result in the destruction, loss or damage of a natural, scenic, or historic feature of major importance. IV. 17.60.050: SUPPLEMENTARY CONDITIONS AND SAFEGUARDS: In granting any special use, the council may prescribe appropriate conditions, bonds and safeguards in conformity with this title. Violations of such conditions, bonds or safeguards, when made a part of the terms under which the special use is granted, shall be deemed a violation of this title.
