McLean County CJCC Executive Committee March 21, 2012 Present: Chief Judge Elizabeth Robb, Judge Robert Freitag, Sheriff Mike Emery, Ronald Dozier, Kim Campbell, Alyssa Curran, Greg Allen and William Scanlon ISU Stevenson Center: Dr. Frank Beck and Dr. Ed Wells ISU Stevenson Center Data Report (February) Dr. Ed Wells reviewed his analysis of the number of court appearances by charge class (CM - Class M felony). There was considerable discussion regarding the discrepancies regarding the length of time to process both the misdemeanor and traffic charges (this is a sub-group of all CM and TR filings where the defendant was booked into the jail). Following the discussion, Dr. Wells will re-examine the cases and conduct a sampling of the data. Case processing times by race show no differences among the races, but still indicate that African- Americans spend more time in custody than other racial groups. This cannot be found to be significant because neither the amount of the bond, nor the criminal history is used to provide correlation with this data. Dr. Beck provided information regarding the length of stay. He compared the number of different persons, length of stay by charge class and average number of beds used. The length of stay is consistent across time or rising in most instances. He also had compared violent with non-violent cases for length of stay (note: non-violent includes all drug offenses where a weapon or violence is not included). Non-violent offenses make up a vast majority of the jail population and average bed days used by both categories is up over 2009- 2010. The total bed days used by non-violent offenses for January and February of this year are up over 2011. There was discussion regarding the non-violent data. It may be beneficial to separate drug offenses from non-violent offenses, so that will be done for the next Executive Committee meeting. Pre-Trial Services Data Analysis Alyssa Curran presented her work on the review of the Pre-Trial Services Program: o There is an 85% success rate (completion of the program) o The most common failure events are a technical violation and a new arrest o Approximately 78% of the population in the program is Male o There is little change from the arrest charge to the filed charge within the program; and where there is a change, that is not a significant factor in completion of the program o The amount of bond set is not a statistically significant factor in the ability to complete the program o There is no significant difference between males and females in completion rates for the program; additionally, no significant difference in race of defendant on completion rates ---PAGE BREAK--- There were a few questions regarding some of the tables. She will make this presentation to the CJCC on April 5. Jail Mental Health Information William Scanlon reviewed the information provided by the McLean County Jail on defendants with mental illness or mental health issues: o In 2010, the number of persons with MH issues was 850 of 3887 inmates (21.87%) o In 2010, average length of stay between finding of Unfit to Stand Trial (UST) and transfer to DHS was 51.5 days o In 2011, the number of persons with MH issues was 856 of 3796 inmates (22.55%) o In 2011, average length of stay between finding of Unfit to Stand Trial (UST) and transfer to DHS was 57.3 days Mr. Scanlon was asked to forward this information to the Administrative Office of Illinois Courts for their review. Case Disposition Standards Judge Freitag was unable to meet with the Criminal Division on this issue, but will do so shortly.
