July 2022 Home Based Vendor Packaging and Labeling All packaged food sold by a *Home-Based Vendor (HBV) shall have a label. The label must provide the following: • The name and address of the producer of the food product. • The common or usual name of the food product. • The ingredients of the food product, in descending order by predominance by weight. • The net weight or volume of the food product by standard measure or numerical count. • The date on which the food product was processed. HBV foods that are unpackaged at the point of sale are considered “labeled” when there is easily readable signage accompanying the food product. HBVs must also post the label information of each product on their online marketing platform. All foods both packaged or unpackaged by an HBV, must have the following statement in at least 10-point type: “This product is home produced and processed and the production area has not been inspected by the State Department of Health. NOT FOR RESALE.” (This statement was prepared in 10-point type to demonstrate in the field, the size of the required font.) If HBV foods are to be shipped, products must be protected by tamper resistant packaging to allow end consumers to visually determine if the products were tampered with. Health claims should be avoided on packaging. Claims such as “heart healthy,” “light or low fat,” or “sugar free” must be substantiated by the nutritional facts on the label. It is acceptable, however, to claim added or left out ingredients, such as including “no sugar added” on the label. *Home-Based Vendor (HBV) means an individual who complies with IC 16-42-5.3.
