AS PROPOSED FOR FIRST AND SECOND READING RESOLUTION AMENDING ULDC § 5.02.02(B) REGARDING RV’S AND TRAVEL TRAILERS Currently, the Gordon County Unified Land Development Code (ULDC) restricts Recreational Vehicles (RV’s) and Travel Trailers as follows: “RV's and travel trailers may be allowed for occupancy in a campground or travel trailer park as permitted in this ULDC.” See, ULDC § 5.02.02(B). ULDC§ 1.10.00 defines a travel trailer/recreational vehicle as: “a vehicular-type portable structure, whether self-propelled or pulled by a power unit, designed as a temporary dwelling for travel, recreation, and vacation uses, which is identified on the unit by the manufacturer as a "camper" or "travel trailer" or "recreational vehicle.". Gordon County Government has received numerous requests for an amendment to the ULDC allowing the occupancy of RV’s and travel trailers under the limited circumstances existing when an owner of a tract of land is actively constructing a personal single family residence. The Board of Commissioners referred the issues raised by these requests to the Planning Commission for a recommendation. After careful consideration, the Planning Commission has unanimously suggested possible revisions to ULDC § 5.02.02(B) as reflected on page 2 of its minutes from the November 13, 2023 meeting and a copy of page 2 of the minutes are attached hereto as Exhibit 1. Now therefore, it is hereby resolved, after a first and second reading, ULDC § 5.02.02(B) shall be amended as follows: B. Accessory dwellings shall not include tents, boats, manufactured storage buildings and mobile structures including RV's and travel trailers, with the exception that RV's and travel trailers may be only allowed for occupancy in a campground or travel trailer park as permitted in this ULDC or by a ---PAGE BREAK--- family during the construction of their private single family residence on a tract of land that they personally own subject to all of the following requirements; 1. This exception for personal use during construction of a personal residence on land owned by the occupant shall only be permissible on land zoned or 2. The occupant must first obtain a valid building permit for the personal single family residence to be constructed; 3. The occupant must obtain a separate permit on an application in a form determined by the County Building Inspector for temporary personal occupancy by the family for whom the residence is being built during construction. The permit fee is $150.00. 4. The applicant shall provide proof a contract with a septic clean out service for the duration of the permit or a septic connection approved by the Department of Health, and compliance with all other applicable provisions of the ULDC; 5. Electrical Power service shall not be allowed until a temporary power pole has been approved by the Building Inspector; 6. The placement of the RV/Travel Trailer permitted under this section shall be in accord with the requirements ULDC §5.02.00 et seq.; 7. The RV permit will be revoked if no work has been done within 3 months after issuance; 8. The RV permit will only be valid for one year from the date it is issued; and, 9. Violation of this Ordinance shall be punishable by a fine of $100 for each day of violation. So resolved this day of December, 2023.
