Municipal Court Judge Daniel Bauer swore in the new Planning Commissioners. 1. ROLL CALL. Commissioner Meagher was absent. 2. APPROVAL OF MINUTES FOR SEPTEMBER 9, 2009, AND APPROVAL OF MINUTES FOR THE SUBCOMMITEE MEETING OF MAY 27, 2009. The minutes for the May 27th Subcomittee were withdrawn. A motion to approve the minutes of September 9, 2009 FAILED by a vote of 2-0-5 Burleson, Jones, Penaluna, and Smith abstained, Meagher absent. The minutes would be continued to the next meeting. 3. APPROVAL OF AGENDA. There were NO changes to the agenda. 4. PUBLIC INPUT. NO action was taken on this item. 5. PUBLIC HEARINGS. 5.1. Discussion and possible action for recommendation to City Council on ZMA 10-06, a Zoning Map Amendment to change the zoning from C-1 (Limited Commercial) to C-2 (General Commercial) for a 0.92-acre parcel located at 305 HWY 95A (APN: 20-057-08). This item was APPROVED by a vote of 6-0-1. 5.2. Discussion and possible action on VAR 10-07, a Variance for Lyon County School District to increase the permitted height for outdoor lighting fixtures within 100 feet of a residential zoning district from 15 feet to 27.5 feet in height. The subject site is located north of Farm District Road between Jasmine and Rainbow Lanes, (APN(s) 22-411-07 & 22-411-08). ---PAGE BREAK--- 10/14/2009 FPC SUMMARY Page 2 of 2 A motion to DENY VAR10-07, based on the discussion in the Staff report and the inability to meet the required findings for a variance was APPROVED by a vote of 6-0-1 Meagher absent. 5.3. Discussion and possible action for recommendation to City Council on TA 10-10, a Text Amendment to amend Chapter 31 Subdivision Maps and Chapter 36 Planned Developments of the City Development Code, specifically Section 31.050 Conditions and Phasing of Maps and Section 31.070 Duration, Extension and Amendment of Tentative Subdivision Map, and Section 36.120 Schedule, to increase the time for filing final maps; and other matters properly relating thereto. This item was APPROVED by a vote of 6-0-1 Meagher absent. 6. CHAIR AND COMMISSION ITEMS Commissioners welcomed the new members and thanked Commissioner Peterson for the time he spent on the Planning Commission. 7. DIRECTOR’S ITEMS. Community Development Director Fred Turnier presented Commissioner Jim Peterson with the Civic Leader award recognizing the five years he served on the Planning Commission. 7.1. Report on previous Planning Commission items 7.2. Upcoming joint City Council and Planning Commission Meeting 7.3. Master Plan and Development Code Update NO action was taken on this item. Director Turnier relayed there would be a joint meeting with the City Council on October 28th at 4:00pm. Commissioner Smith relayed the next Planning Commission meeting would be held on Tuesday, November 10th due to the observance of Veteran’s Day. 8. COMMISSIONER SUGGESTIONS FOR FUTURE AGENDA ITEMS.
