SUMMARY OF ACTION FCC Meeting: WEDNESDAY, July 20, 2011 5:00 p.m. OPEN MEETING – PLEDGE OF ALLEGIANCE 1. ROLL CALL. Present: Councilwoman Malloy, Councilman Parsons, Councilman Edgington, Councilman Chaffin, Councilman Eilrich. Councilman Parsons was on the phone. 2. APPROVAL OF THE AGENDA. Interim City Manager Fred Turnier asked to pull item #6.E.2 from the agenda. Councilman Chaffin noted that he would abstain on item #6.C. since he is the principle on that specific item. Fernley resident Janice Prichard requested to discuss agenda item #6.E at the end of the agenda. Councilman Eilrich requested to pull item #6.B. and discuss it at the end of the agenda since he had corrections to the minutes. Motion: to approve agenda and hear items 6.B. and 6.E. at the end of the agenda, Action: Approve, Moved by Councilwoman Malloy, Seconded by Councilman Parsons. Vote: Motion passed (summary: Yes = 4, No = 0, Abstain = Yes: Councilman Edgington, Councilman Eilrich, Councilman Parsons, Councilwoman Malloy. Abstain: Councilman Chaffin. 3. PROCLAMATIONS BY THE MAYOR. Mayor Goodman awarded Certificate of Recognition to 4th of July Committee. Mayor Goodman awarded Certificates of Appreciation to Arts and Culture Commission members and Convention and Tourism Authority Board members for their service and outstanding accomplishments. 4. RECOGNITION OF EMPLOYEES. Streets Public Works Worker Kyle Reitnauer was recognized as an Employee of the Month. 5. PUBLIC INPUT. Public comment is limited up to five minutes per person. Items not agendized for this meeting cannot be acted upon other than to place them on future agendas. D. APPROVAL OF REQUEST BY THE FERNLEY CHAMBER OF COMMERCE FOR WAIVER OF LIQUOR LICENSE FEES FOR THE SENIOR PRO RODEO TO BE HELD AT THE OUT OF TOWN PARK SEPTEMBER 16TH , 17TH & 18TH. E. DISCUSSION AND POSSIBLE APPROVAL OF TWO AGREEMENTS WITH NV ENERGY FOR PART OF THE NEVADA PACIFIC PARKWAY EXTENSION. 1) ADJUSTMENT OF UTILITY FACILITIES AGREEMENT 2) ALLOWANCE FOR FUNDS USED DURING CONSTRUCTION (AFUDC) SIDE AGREEMENT (END OF CONSENT AGENDA} Motion: to approve consent agenda minutes items #6.B and 6.E., Action: Approve, Moved by Councilman Edgington, Seconded by Councilwoman Malloy. Vote: Motion passed (summary: Yes = 4, No = 0, Abstain = Yes: Councilman Edgington, Councilman Eilrich, Councilman Parsons, Councilwoman Malloy. Abstain: Councilman Chaffin. Item 6.B. Motion: to approve minutes with one modification made by Councilman Eilrich. Action: Approve, Moved by Councilman Chaffin, Seconded by Councilman Edgington. Vote: Motion passed (summary: Yes = 5, No = 0, Abstain = Yes: Councilman Edgington, Councilman Eilrich, Councilman Parsons, Councilwoman Malloy, Councilman Chaffin. Item 6.E. Motion: to approve the Agreements with NV Energy for adjustment of utilities as part of the Nevada Pacific Parkway Extension Project, Action: Approve, Moved by Councilman Edgington, Seconded by Councilman Chaffin. Vote: Motion carried by unanimous roll call vote (summary: Yes = Yes: Councilman Chaffin, Councilman Edgington, Councilman Eilrich, Councilman Parsons, Councilwoman Malloy. 7. DISCUSSION AND POSSIBLE ACTION TO APPROVE TENTATIVE AGREEMENT BETWEEN THE CITY OF FERNLEY AND LOCAL 1245 OF INTERNATIONAL ---PAGE BREAK--- 07/20/2011 FCC Page 3 of 5 BROTHERHOOD OF ELECTRICAL WORKERS, AFL-CIO FOR JULY 1, 2011- JUNE 30, 2012. Motion: to approve the Tentative Agreement between the City of Fernley and IBEW Local 1245 for a Collective Bargaining Agreement with a term of July 1, 2011 to June 30, 2012, Action: Approve, Moved by Councilwoman Malloy, Seconded by Councilman Edgington. Vote: Motion passed (summary: Yes = 3, No = 2, Abstain = Yes: Councilman Edgington, Councilwoman Malloy, Mayor Goodman No: Councilman Chaffin, Councilman Eilrich, Phone connection with Councilman Parsons failed at 5:50pm. There was a tie vote and Mayor Goodman voted “Yes.” 8. DISCUSSION AND POSSIBLE APPROVAL OF: A. RESOLUTION #2011-008 MODIFYING RESOLUTION #10-007 AND #10-008, AMENDING THE RULES AND PROCEDURES AND GRANT GUIDELINES FOR THE CITY OF FERNLEY CONVENTION AND TOURISM AUTHORITY BOARD AND REMOVING COUNCIL APPROVAL OF FORMS FOR CONVENTION AND TOURISM AUTHORITY BOARD. B. RESOLUTION #2011-009 MODIFYING RESOLUTION #10-019, MODIFYING BY- LAWS FOR THE CITY OF FERNLEY CONVENTION AND TOURISM AUTHORITY BOARD. Motion: to adopt Resolution #2011-008 modifying Resolution #10-007 and #10-008, amending the Rule and Procedures, Grant Guidelines for the City of Fernley Convention and Tourism Authority Board and removing the City Council approval of forms for Convention and Tourism Authority Board. Vote: Motion carried by unanimous roll call vote (summary: Yes = Yes: Councilman Chaffin, Councilman Edgington, Councilman Eilrich, Councilman Parsons, Councilwoman Malloy. Motion: to approve Resolution #2011-009 modifying Resolution #10-019, modifying By – Laws for the City of Fernley Convention and Tourism Authority Board. Vote: Motion carried by unanimous roll call vote (summary: Yes = Yes: Councilman Chaffin, Councilman Edgington, Councilman Eilrich, Councilman Parsons, Councilwoman Malloy. 9. DISCUSSION AND POSSIBLE DIRECTION TO STAFF TO NEGOTIATE RENEWING A PROFESSIONAL SERVICES AGREEMENT WITH NV BUSINESS STRATEGIES (PER COUNCILMAN EDGINGTON’S REQUEST) ---PAGE BREAK--- 07/20/2011 FCC Page 4 of 5 Motion: direct staff to negotiate a tentative agreement with NV Business Strategies to look into consolidated taxes and any other issues, Action: Approve, Moved by Councilman Edgington, Seconded by Councilman Chaffin. Vote: Motion passed (summary: Yes = 3, No = 2, Abstain = Yes: Councilman Chaffin, Councilman Edgington, Councilman Eilrich. No: Councilman Parsons, Councilwoman Malloy. 10. CITY CLERK EVALUATION FOR LENA SHUMWAY – DISCUSSION AND POSSIBLE ACTION REGARDING THE CITY CLERK PAST YEAR’S EMPLOYMENT PERFORMANCE, AND THE CITY COUNCIL AND MAYOR’S SATISFACTION WITH THE CITY CLERK’S EMPLOYMENT PERFORMANCE INCLUDING BUT NOT LIMITED TO: A. CITY CLERK CONTRACT COMPLIANCE. B. GENERAL PERFORMANCE AS THE CITY CLERK. Motion: to approve City Clerk’s evaluation and summaries and relevant actions and recommendations. Moved by Councilman Edgington, Councilman Parsons seconded the motion. Vote: Motion carried by unanimous roll call vote (summary: Yes = Yes: Councilman Chaffin, Councilman Edgington, Councilman Eilrich, Councilman Parsons, Councilwoman Malloy. 11. PRESENTATION OF PUBLIC WORKS AND GENERAL SERVICES CORE SERVICES OVERVIEW. No action was made on this item. It was informational only. City Engineer Shari Whalen provided power point presentation regarding Public Works and General Services Core Services. 12. REPORTS BY CITY STAFF, CITY COUNCIL AND MAYOR. This item is for various public entity representatives to provide general information to the Council and public. No action will be taken. A. REPORTS BY LYON COUNTY SHERIFF’S DEPARTMENT, NORTH LYON COUNTY FIRE PROTECTION DISTRICT AND ADDITIONAL REPORTS AS RECOGNIZED BY THE MAYOR. B. REPORTS BY CITY STAFF, CITY COUNCIL AND MAYOR. It was informational only. 14. ADDRESS REQUEST(S) FOR FUTURE AGENDA ITEMS. Councilman Edgington asked Staff to provide an update regarding existing ranches within the City of Fernley and if there are any water rights left associated with them. Councilman Edgington asked City Manager to provide a bi-weekly report to the City Council and update regarding each individual department. Councilwoman Malloy asked for the following items to be placed on the City Council Agenda: Review policies and procedures for City Council regarding council items and how they are distributed between council members and public and agenda packets being submitted to Council by 3pm on Friday. Discussion and Possible Action on Establishing a City Noise Ordinance. Update regarding Master Plan amendment and Development Code Update. Discussion regarding starting over Youth City Council Program. Councilman Chaffin requested an update regarding the situation of trucks that park on the NDOT property on Main Street. 15. ADJOURNMENT. The meeting adjourned at 6:54pm.
