City of Fernley 595 Silver Lace Blvd. Fernley NV 89408 Telephone: (775) 784-9800 Fax: (775) 784-9999 Summary of Proposed Waste Franchise Agreements and Ordinance City staff members are soliciting information from businesses regarding the following: the award of an exclusive franchise agreement for mandatory residential garbage collection including possible rate and fee increases for collection of residential garbage; the formation of an open waste franchise system whereby non-residential waste collection can be collected by any waste hauler who obtains a City of Fernley Business License and Waste Hauling Permit; and an ordinance regulating the collection, transportation, deposit, disposal of solid waste in a manner consistent with the award of the exclusive franchise agreement and open franchise system. We are soliciting the information in order to prepare a “Business Impact Statement” pursuant to NRS 237.090 to address the impact of the proposal. Any trade associations or owners and officers of businesses which are likely to be affected by the three proposed actions or rule(s) may submit data or arguments as to whether the proposed actions or rule(s) will impose a direct and significant economic burden upon a business; or directly restrict the formation, operation or expansion of a business. The City Council may take final action at the December 3, 2008, City Council meeting regarding the award of the exclusive residential franchise agreement and approval of the open franchise system. The City Council may initiate, through a proposed ordinance, an ordinance regulating solid waste at the December 3, 2008, City Council meeting. Any data or arguments must be received by December 1, 2008, by 12:00 PM in order for consideration in the Business Impact Statement. An Open House will be held on November 24, 2008, at 6:00 PM where staff will be available to answer questions and receive written data and written arguments. 1) Award of Exclusive Franchise for Mandatory Residential Garbage Collection City Council is considering awarding an exclusive franchise agreement to Trashpros, Inc., for the mandatory collection of single family residents situated on property of gross acreage equal to or less than two acres and multi-unit ---PAGE BREAK--- residential dwellings, including but not limited to mobile home parks and apartment complexes. Trashpros, Inc., will (upon award) be required to submit an eight percent franchisee fee based upon gross revenue. The proposed rate for single family housing (as described) is $21.96 per month, which includes the use of an approximate 96-gallon container. 2) Approval of an Open Franchise System for Non-Residential Waste Collection City Council is considering approving an Open Franchise system for non- residential waste collection whereby non-residential waste collection can be collected by any waste hauler who obtains a City of Fernley Business License and Waste Hauling Permit. A waste hauler will be required to submit an eight percent franchisee fee to the City of Fernley based upon gross revenue. The Waste Hauling Permit will include an approximate $1500 application and processing fee and may include an advance deposit. The approximate $1500 application and processing fee includes costs of inputting the application, ensuring license compliance, preparing City Council agenda reports, presenting City Council agenda reports, collection of the franchise fee, review of auditing compliance, and addressing customer concerns and questions. This fee will be monitored on an annual basis to ensure that processing costs are reflective of the permit and processing fee. 3) An Ordinance Regulating Waste City Council is considering an ordinance regulating the collection, transportation, deposit, disposal of solid waste in an manner consistent with the award of the exclusive franchise agreement and open franchise system.
