Insert new definition: HOUSING CODE is the International Property Maintenance Code, 2003 Edition, International Existing Building Code, 2003 Edition and the International Residential Code for One- and Two-Family Dwellings, 2003 Edition promulgated by the International Code Council, as adopted by this jurisdiction. 50.020 Geotechnical investigations required Geotechnical investigation reports shall be submitted with all commercial and industrial plan reviews for new construction. Further, geotechnical investigation reports shall be submitted with all tentative subdivision and parcel maps. The following copied portions of the original geotechnical investigation report shall be submitted with residential plan reviews: A. Project Description: including but not limited to project number, site location, access, structure information and grading concepts. B. Discussions and Recommendations: including but not limited to general information, seismic design criteria, site preparation, trenching and excavation, grading and filling, subsidence and shrinkage, foundation design, slope stability and erosion control, site drainage, concrete slabs and anticipated construction problems. ---PAGE BREAK--- Page 9 of 11 2/2/05 The recommendations of the soils engineer relating to site preparation, grading, compaction and foundation/footing design shall be made mandatory. 50.030 Premises identification The premises under which a permit has been issued shall be identified at all times and during all stages of construction pursuant to Section 505 of the International Fire Code, 2003 Edition. 50.040 Construction debris All construction sites shall have approved trash receptacle(s) or an approved trash removal plan in place at the time of the first inspection and during construction, until certificate of occupancy is issued. The receptacle(s) shall be used appropriately to maintain a clean work site. Burning of construction debris is prohibited. 50.050 Fees, general Fees Set Forth In The Several Codes: The City Council may, from time to time, by resolution, establish fees for City services and inspections provided pursuant to the several codes. 50.060 Work without a permit Whenever any work for which a permit is required has been commenced without first obtaining said permit, an inspection shall be made before a permit may be issued for such work. Following the inspection, a permit application shall be filed with all applicable fees and any additional information of investigation reports. 50.065 Emergency repairs Where equipment replacements and repairs must be performed in an emergency situation, the permit application shall be submitted within the next working business day. For the purposes of this section, emergency shall be defined as: an unexpected situation requiring prompt action to safeguard life or limb, health, property and public welfare. This section shall not be construed as allowing work to be done without a permit to restore comfort and convenience items, equipment or systems. Emergency work performed shall not be done contrary to the provisions of the City of Fernley Development Code. 50.070 Reinspection fees A reinspection fee may be assessed for each inspection or reinspection of work if any one of the following conditions occurs: A. Work for which inspection is requested is not complete. B. Corrections identified in a previous inspection are not complete. C. Inspection record card, approved plans or permit are not made available to the inspector on the work site. D. Access to work is not provided or is restricted. E. Work that requires inspection prior to the requested inspection has not been approved. F. Deviating from the plans requiring the approval of the Building Official. ---PAGE BREAK--- Page 10 of 11 2/2/05 This section is not to be interpreted as requiring reinspection fees the first time a job is rejected for failure to comply with the code, but as controlling the practice of calling for inspections before the job is ready for such inspection or reinspection. To obtain a reinspection, the applicant shall pay the reinspection fee in accordance with the adopted fee schedule. For instances where reinspection fees have been assessed, no additional inspection of the work will be performed until the required fees have been paid. 50.080 Permit expiration Every permit issued shall become invalid unless the work authorized by such permit is commenced within 180 days after its issuance, or if the work authorized by such permit is suspended or abandoned for a period of 180 days after the time the work is commenced. A minimum of one inspection approval must be obtained as evidence that work was commenced or that work has continued. The Building Official is authorized to grant, in writing, one or more extensions of time, for periods not more than 180 days each. The extension shall be requested in writing prior to the permit’s expiration and justifiable cause demonstrated. The determination as to weather work was suspended shall be based on the most recent inspection approval date. Permits may be renewed up to three times. The fee for renewing each permit shall be as set by resolution. Permits are not transferable and any change in occupancy, operation, tenancy or contractor of record or ownership shall require that a new permit be issued. 50.090 Nevada state adopted plumbing code NRS 444.350 currently requires that any construction, alteration or change in the use of a building or other structure in this state must be in compliance with the latest version of the Uniform Plumbing Code as published by the International Association of Plumbing and Mechanical Officials. The City of Fernley recognizes the Uniform Plumbing Code, 2003 Edition, as the latest version. However, it is being proposed to change that requirement to allow use of the International Plumbing Code. In the event Nevada law is changed in this regard, Section A shall take effect at the same time as such amended state law takes effect, substituting the International Plumbing Code, International Fuel Gas Code and International Private Sewage Disposal Code for the Uniform Plumbing Code. 50.100 Conflicts with other law Any provision of any of the codes listed above, as amended, which is in conflict with the Nevada Constitution, the Nevada Revised Statutes, or the Nevada Administrative Code, shall not be enforced. Further, where, in any specific case, different sections of the referenced codes and amendments specify different materials, methods of construction or other requirements than that of the City of Fernley Development Code or other City Ordinances and Resolutions, the most restrictive shall govern. Where there is a conflict between a general requirement and a specific requirement between different sections of the referenced codes and amendments and the City of Fernley Development Code or other City Ordinances and Resolutions, the specific requirement shall be applicable. If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. 50.110 Violations and penalties A. Criminal Penalties: ---PAGE BREAK--- Page 11 of 11 2/2/05 1) Any natural person who violates any provision of the codes hereby adopted shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by not more than six months imprisonment or by a fine of not more than one thousand dollars ($1,000.00) or by both such fine and imprisonment. 2) Any corporation, which violates any provision of the codes hereby adopted, shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more than one thousand dollars ($1,000.00). B. Civil Penalties: 1) Abatement Procedures. Abatement shall be as prescribed by the Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition. 3) Business license revocation. The City of Fernley business license of any natural person or corporation holding such license, which violates the provisions hereof, may be terminated or cancelled after a duly noticed public hearing and a finding that the person or corporation has violated or caused violation of the provisions hereof. 50.120 Future code adoptions In an effort to improve the Building Code Effectiveness Grading Schedule (BCEGS) by Insurance Services Office, Inc. (ISO), and to ensure proper code enforcement to reduce loss of life, the risk of property loss, and social disruption that result from natural catastrophes, the City of Fernley shall adopt and implement the most recent and current coordinated set of codes published by the International Code Council within 12 months of the publication of the codes to be effective July 1st immediately following the publication of said codes. 50.130 Effective date This ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect July 1, 2004.
