City Manager Greg Evangelatos asked to continue items 6 and 3.H. to a later date Councilman Parsons asked to pull item 3.G. from consent agenda for discussion. Councilman Eilrich asked to make adjustments for the minutes on page 11 and correct the dollar amount from 2,5 million to 1.5 million. 3. APPROVAL OF CHANGE ORDER #1 FOR THE EAST WASTE WATER TREATMENT PLANT POND 1 RECONSTRUCTION IN THE AMOUNT OF $37,232.80 AS A RESULT OF OWNER REQUESTED CHANGE IN SCOPE. {End of Consent Agenda} A motion to approve the consent agenda minus item 3.G. was APPROVED by a vote of 5-0-0. A motion to approve Change Order #6 with A&K Earthmovers, Inc for the Water Conveyance project 3A, with the exemption of request for change #20 was APPROVED by a vote of 5-0-0. A motion to go to the closed session was approve by a vote of 5-0-0. 4. CLOSED SESSION. CONSIDERATION OF CHARACTER, ALLEGED MISCONDUCT, PROFESSIONAL COMPETENCE, OR PHYSICAL OR MENTAL HEALTH OR TO CONSIDER AN APPEAL REGARDING THE RESULTS OF AN EXAMINATION CONDUCTED BY OR ON BEHALF OF THE PUBLIC BODY AS IT RELATES TO MANAGEMENT PROCEDURES RELATIVE TO THE TERMINATION OF BILL CADWALLADER No action was taken on this item. 5. DISCUSSION AND POSSIBLE ACTION ON ESTABLISHMENT OF AN APPEAL PROCESS FOR DEPARTMENT DIRECTORS WHICH REQUIRES MODIFICATION OF FERNLEY MUNICIPAL CODE 1.05.05, ENTITLED “COUNCIL NOT TO INTERFERE WITH APPOINTMENTS OR REMOVALS,” INCLUDING AN EXPLANATION AS TO THE TIMELINESS OF BRINGING FORWARD THIS PROCESS. No action was taken on this item. 6. DISCUSSION OF FUEL TAX AND ROOM TAX ASSESSMENT. This item was continued to the future date by the City Manager Greg Evangelatos' request. 7. DISCUSSION OF PARKS DEPARTMENT’S USE OF CONTRACTORS AND TO SEE A CONTRACT AND AN ANALYSIS OF WHETHER OR NOT BEN IS AN EMPLOYEE OR INDEPENDENT CONTRACTOR. A motion to bring back an analysis of the City’s risk and Mr. not caring the insurance and to show the Council a proposal of what it would be to have Mr. to sign contract as independent contractor or for him to ---PAGE BREAK--- 09-08-19 Summary of Action FCC Page 4 of 5 become a City employee, so he would be insured under City insurance was APPROVED by a vote of 3-2-0, Eilrich and Chaffin opposed. 8. DISCUSSION AND POSSIBLE ACTION ON PROCEDURES ON THE DISTRIBUTION OF COMMUNICATIONS FROM THE MAYOR AND CITY MANAGER REGARDING THE CITY’S POSITION ON ANY ITEM. No action was taken on this item. It was informational item only. 9. PUBLIC INPUT. Public comment is limited to five minutes per person. Items not agendized for this meeting cannot be acted upon other than to place them on future agendas. Public input is prohibited regarding comments, which are not relevant to, or within the authority of, the public body, or if the content of the comments is willfully disruptive of the meeting by being irrelevant, repetitious, slanderous, offensive, inflammatory, irrational or amounting to personal attacks or interfering, with the rights of other speakers. NO action was taken on this item. 10. REPORTS. This item is for various public entity representatives to provide general information to the Council and public. No action will be taken. 10.A. REPORTS BY CITY COUNCIL. 10.E. REPORT BY MAYOR. NO action was taken on this item. 11. PUBLIC HEARING: 11.A. APPEAL 10-05 OF THE PLANNING COMMISSION’S APPROVAL OF AN INTERPRETATION OF CODE, IOC 09-58, FOR SCREENING OF MECHANICAL EQUIPMENT AT THE CITY OF FERNLEY WATER TREATMENT PLAN. A motion to reverse Planning Commission decision and to direct staff to add some conditions to put some sort of screening for making Water Treatment Plant looking more esthetically pleasing was APPROVED by a vote of 5-0-0. ---PAGE BREAK--- 09-08-19 Summary of Action FCC Page 5 of 5 12. REQUEST(S) FOR FUTURE AGENDA ITEMS. Review the escalating water rate chart. The charges are more for the gallons you use, which is not fair for larger land owners and tenants that rent properties on these lands. Create a policy to not raise water rates and if rates are raised, not do it in the height of the irrigation season Establish policy regarding emergency management. Mayor Goodman suggested directing staff to work on that and bring in the future agenda. 13. ADJOURNMENT. The meeting ADJOURNED at 8:16pm
