Approval of Minutes for December 12, 2007 and January 12, 2008 A motion to approve the minutes for December 12, 2007 was APPROVED by a vote of 6-0-1 Peterson abstained. A motion to approve the minutes for January 12, 2008 was APPROVED by a vote of 6-0-1 Smith abstained. 2. PUBLIC INPUT. Items not agendized for this meeting cannot be acted upon other than to place them on future agendas. 3. REPORTS. This item is for various public entity representatives, including City Staff and Planning Commissioners to provide general information to the Commission and public. No action will be taken. 4. PUBLIC HEARING: 4.A. ADDRESS APPEAL APPLICATION 08-02, SUBMITTED BY MR. JOSEPH SPECCHIO, APPEALING A DETERMINATION BY THE CITY OF FERNLEY CONCERNING THE PLACEMENT OF A SECOND TRAILER/MOBILE HOME ON A LOT; LOCATED AT 350 RANDON COURT; APN 20-412-16. (Planning Commission final decision). This item was not heard as the issue had been resolved prior to the meeting, per City Manager Gary Bacock. 4.B. ADDRESS TENTATIVE PARCEL MAP APPLICATION TPM 08-06 FOR DANIEL W. MCCREARY TO DIVIDE A 5.06-ACRE PARCEL ZONED RR-1 (RURAL RESIDENTIAL, ONE-ACRE MINIMUM PARCEL SIZE) INTO FOUR PARCELS, THE SMALLEST TO BE 44,475 SQUARE FEET; LOCATED AT 1400 RICCI LANE; APN 20-361-10. (Planning Commission final decision). A motion to approve TPM 08-09 based on the discussion and noting that the conditions as stated in the Staff report dealt with the question of the secondary access as required by the International Fire Code, in particular condition #2 requiring no building permit shall be issued until there was secondary access to the site and with the addition of a condition requiring the three newly constructed structures to be sprinkled as presented by the applicant’s representative FAILED by a vote of 3-4-0 Burleson, Clegg, McCoy and Smith opposed. A motion to deny TPM 08-09 based on section D 107.1 of the 2003 International Fire Code was APPROVED by a vote of 4-3-0 Amerman, Maxwell, and Peterson opposed. ---PAGE BREAK--- 4/09/2008 FPC ACTION SUMMARY Page 2 of 2 4.C. ADDRESS SPECIAL USE PERMIT APPLICATION SUP 08-12 FOR FELDMEIER EXPANSION FOR A 150’ BY 80’ OUTDOOR STORAGE AREA WHICH WILL BE SCREENED FROM THE STREET WITH PROPOSED LANDSCAPE; LOCATED AT 375 INDUSTRIAL DRIVE; APN 21-261-26. (Provide recommendations to City Council). This item was APPROVED by a vote of 6-0-1 Burleson abstained. 4.D. ADDRESS TENTATIVE SUBDIVISION MAP APPLICATION TSM 08-06 FOR DONNER TRAILS TOWN CENTRE TO CREATE A COMMERCIAL SUBDIVISION ON A TOTAL OF 30.67-ACRES WITHIN THE C-2 (GENERAL COMMERCIAL) ZONING DISTRICT; LOCATED AT 2105 HIGHWAY 50A; APN 21-201-45 AND 47. (Provide recommendations to City Council). This item was APPROVED by a vote of 7-0-0. 4.E. ADDRESS TENTATIVE PARCEL MAP APPLICATION TPM 08-04 FOR STEVEN AVALOS TO DIVIDE A 24.49-ACRE PARCEL ZONED RR-3 (RURAL RESIDENTIAL, 5-ACRE MINIMUM PARCEL SIZE) INTO FOUR PARCELS, THE SMALLEST TO BE 5.22-ACRES. THE PLANNING COMMISSION WILL REHEAR THIS APPLICATION TO ADDRESS ISSUES BROUGHT UP AT PREVIOUS HEARINGS; LOCATED AT 4205 SMITH LANE; APN 21-491-59. (Planning Commission final decision). It was stated that the reason this item was being heard again was because the motion stated in the Staff report recommended denial to the City Council. Since the Planning Commission was the final authority on Tentative Parcel Maps, the motion was thought to not be valid. After a short recess to listen to the audio recording of the March 12, 2008 Planning Commission meeting, it was decided that the motion was to deny, not recommend denial. The decision to deny TPM 08-04 stood from the previous Planning Commission meeting. 5. ADDRESS REQUEST(S) FOR FUTURE AGENDA ITEMS. Future Agenda Items included: Discussion and Possible Action on Clearly Defining Serial Parcelization and Legal Access. Discussion and Review of Ordinance 2006-001, Regarding Dedication of Water Rights. 6. ADJOURNMENT. The meeting ADJOURNED at 7:15 p.m. by a vote of 7-0-0.
