I HAVE BEEN INFORMED AND FULLY UNDERSTAND THAT: I have the right to representation by a lawyer and that if I cannot afford to pay for a lawyer, one will be provided at no expense to me.  I wish to waive my right to an attorney at this time  My attorney is: I am charged with: Unlawful Bus Conduct. The elements are: Did, while on or in a municipal transit vehicle as defined by RCW 46.04.355 or in or at a municipal transit station and with knowledge that such conduct is prohibited, did one or more of the following: smoke or carry a lighted or smoldering pipe, cigar, or cigarette not in a designated smoking area; discard litter other than in a designated receptacle; dumps or discards, or both, any materials on or at a transit facility, including but not limited to hazardous substances and automotive fluids; play a radio, recorder, or other sound-producing equipment that was not connected to earphones to limit the sound to individual listeners; spit, expectorate, urinate or defecate except inappropriate plumbing fixtures; carry flammable liquid, explosive, acid or other article or material likely to cause harm to others; consumed an alcoholic beverage or possessed an open alcoholic beverage container; intentionally obstruct or impede the flow of municipal transit vehicles or passenger traffic, hinder or prevent access to a municipal transit vehicle or station, or unlawfully interfere with the provision or use of public transportation services; unreasonably disturb others by engaging in loud, raucous, unruly, harmful or harassing behavior; (10) destroy, deface or otherwise damage property in a transit vehicle or at a transit facility; (11) throw an object in or at a transit vehicle, in or at a transit facility, or at any person at a transit facility with an intent to do harm; (12) possess an unissued transfer or fare medium or tender an unissued transfer or fare medium as proof of fare payment; (13) falsely claim to be a transit operator or transit employee or through other actions including, but not limited to, words, conduct, or the use of clothes, insignia, or equipment resembling department-issued uniforms and equipment, creates a false impression that he or she is a transit operator or other transit employee; (14) engage in gambling or any game of chance for the winning of money or anything of value; (15) skate on roller-skates or in-line skates, or ride in or upon or by any means a coaster, skateboard, toy vehicle, or any similar device; (16) engage in other conduct that is inconsistent with the intended use and purpose of the transit facility, transit station, or transit vehicle and refused to obey the lawful commands of an agent of the transit authority or a peace officer to cease such conduct; or (17) refuse to provide his or her required identification following ---PAGE BREAK--- Statement of Defendant on Plea of Guilty Page 2 of 4 Revised June 2020 a lawful request by a transit official. 5. I UNDERSTAND I HAVE THE FOLLOWING IMPORTANT RIGHTS, AND I GIVE THEM ALL UP BY PLEADING GUILTY: The right to a speedy and public trial by an impartial jury in the county where the crime is alleged to have been committed; The right to remain silent before and during trial, and the right to refuse to testify against myself; The right at trial to hear and question the witnesses who testify against me; The right at trial to testify and to have witnesses testify for me. These witnesses can be made to appear at no expense to me; The right to be presumed innocent unless the charge is proven beyond a reasonable doubt or I enter a plea of guilty; The right to appeal a finding of guilt after a trial. 6. The judge can give me any sentence up to the maximum authorized by law no matter what the prosecuting authority or anyone else recommends The judge may place me on probation for up to five years if I am sentenced for a domestic violence offense or under RCW 46.61.5055, or up to two years for all other offenses and impose conditions of probation. If the court orders me to appear at a hearing regarding my compliance with probation and I fail to attend the hearing, the term of probation will be tolled until I appear before the court on the record. The judge may require me to pay costs, fees and assessments authorized by law. The judge may also order me to make restitution to any victims who lost money or property as a result of crimes I committed. The maximum amount of restitution is double the amount of the loss of all victims or double the amount of my gain. If I am not a citizen of the United States, a plea of guilty to an offense punishable as a crime under state law is grounds for deportation, exclusion from admission to the United States, or denial of naturalization pursuant to the laws of the United States. 7. I plead guilty to the crime(s) of Unlawful Bus Conduct, as charged in the complaint(s) or citation(s) and notice, or as amended.
