City of Everett Logo Design Contest This form must be completed and submitted to the City with your design. Please describe your design and why it represents Everett: Contact information: Artist Name Company Name (if applicable) Email Phone Address Artist Agreement A. Contest. By participating in this contest, the Artist is bound by the contest rules and this agreement. All decisions of the City are final in all matters regarding the contest. The selection of the winner of this contest is done subjectively and by a judging panel, all at the City’s sole discretion. The City has the right to cancel the contest for any reason. B. Original Design. The Artist warrants that the submitted design is original and does not infringe on any other person’s copyright, rights in trade or service marks. C. Source Files. If the Artist is a finalist, the Artist will provide to the City the source files (including electronic files, if any) for the submitted design. D. Winning Design. If the design submitted by the Artist is the winning design, then the following apply: 1. The Artist irrevocably and unconditionally transfers and assigns all ownership and rights to the City for the winning design. The Artist agrees to sign all documents or take such other actions as reasonably required by the City to confirm the complete transfer of ownership and rights. ---PAGE BREAK--- 2. The winning design in every respect is the property of the City. The Artist retains no ownership or rights in the winning design. The City may modify the winning design at the City’s sole discretion. The winning design may be used on various City signs, documents, vehicles, uniforms, and other materials and in all types of media. 3. The Artist may display the winning design in the Artist’s portfolio, resume or personal promotional materials. 4. The City will pay the winning Artist $5000, as complete payment for the winning design. E. No Return of Design or Materials. Regardless of whether a design is the winner or not, the City has no obligation to return to the Artist any submitted design or any materials associated with the design. This Agreement must be signed by the Artist. If the Artist is not 18 years old, the Agreement must be signed by the Artist’s legal guardian. Artist Signature (or legal guardian) Date Artist Name
