EVANSTON CITY COUNCIL First Regular Meeting October 7, 2014 The official record of proceedings of the first regular meeting of the Evanston City Council for the month October was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Terri Spero led those in attendance in the pledge of allegiance to the Flag. The roll was called and with a quorum being present, Mayor Joy Bell called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Bell; Councilmembers Tim Evan Perkes, David W elling, and W endy Schuler. Councilmember Curtis Rex and Saundra Meyers were excused. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; Director of Administrative Services/City Clerk, Amy Grenfell; Director of Planning & Development, Paul Knopf; City Treasurer, Kathy Defa; City Engineer, Brian Honey; Police Chief, Jon Kirby; Director of Parks and Recreation, Dennis Poppinga; Public W orks Director, Oop Hansen; Deputy City Clerk, Nancy Stevenson; and Environmental Services Manager, Gordon Robinson. A group of interested citizens were also present. Approve Agenda Councilmember Schuler moved, Councilmember Welling seconded, to approve the agenda. The motion passed unanimously with 5 yes votes: Bell, Perkes, W elling, Schuler. Approve Minutes The official record of proceedings for the City Council Meeting held September 16, 2014 and a Work Session Meeting held September 23, 2014 were approved as presented. Council Comments Councilmember Schuler reminded everyone that Rocktoberfest Fundraiser Event will held October 25 , and th that Hunter’s W idows Night Out will be October 23 . rd Mayor Bell commented that she recently signed a proclamation declaring October as Domestic Violence Awareness Month and that she also attended the 5 Annual Pet Parade Against Domestics Violence. th ---PAGE BREAK--- EXCEL! Award Presentation Gordon Robinson, CERC (City of Evanston Recognition Committee) Chairperson, recognized Terri Spero for showing community service by recognizing and reporting a stolen vehicle. As a result the car was returned to the owner, the suspect caught and a run away juvenile was returned home. Terri was presented with a certificate, an EXCEL! mug and coaster, an EXCEL! challenge coin, and a monetary award. Public Hearing/Bar & Grill Liquor License/Tumblin Tumbleweeds City Attorney, Dennis Boal conducted a public hearing to solicit public comment regarding the application for a Bar and Grill Liquor License for Tumblin Tumbleweeds, LLC., dba: Tumblin Tumbleweeds. Lisa W ilkes, owner of the establishment spoke in favor of the application and explained the reason for the transfer. No one else addressed the issue and Mr. Boal closed the hearing. Bar & Grill Liquor License/Tumblin Tumbleweeds Councilmember Welling moved, Councilmember Schuler seconded, to approve a Bar and Grill Liquor License for Tumblin Tumbleweeds, LLC., dba: Tumblin Tumbleweeds and to allow alcoholic beverage served on the patio/deck area. The motion passed unanimously with 5 yes votes: Bell, Perkes, W elling, Schuler. Consent Agenda Councilmember Perkes moved, Councilmember seconded, to approve the following on the Consent Agenda: A Street Closure Permit requested by Evanston Main Street for the Annual Downtown Trick-or-Treating on Friday, October 31, 2014, on Main Street from 7 Street to 11 Street, th th from 2:30 p.m. to 5:30 p.m. The motion passed unanimously with 5 yes votes: Bell, Perkes, W elling, Schuler. Liquor License/Change DBA/Five K, LLC Councilmember Schuler moved, Councilmember seconded, to approve the request of Five K, LLC., to change their liquor license dba from “The Speed Bump” to “The Lincoln Highway Tavern”, and to change the description of the dispensing room to a 16' X 24' room in the East portion of the building on the ground floor. The motion passed unanimously with 5 yes votes: Bell, Perkes, W elling, Schuler. Resolution 14-66 Councilmember Perkes introduced Resolution 14-66. Councilmember Perkes moved, Councilmember Welling, to adopt Resolution 14-66. Resolution 14-66: A RESOLUTION OF THE CITY OF EVANSTON, W YOMING, AUTHORIZING THE EXECUTION OF AN AGREEMENT W ITH THE W YOMING ASSOCIATION OF SHERIFFS AND CHIEFS OF POLICE TO PROVIDE COMPLIANCE INSPECTIONS ON RETAIL TOBACCO OUTLETS TO ENFORCE LAW S PROHIBITING THE SALE OF TOBACCO TO MINORS. W HEREAS, the City of Evanston, through its Police Department may obtain funds from the W yoming Association of Sheriffs and Chiefs of Police to be used for providing compliance inspections on retail tobacco outlets to enforce laws prohibiting the sale of tobacco to minors; and W HEREAS, the governing body has determined that it is in the public’s interest for the Police Department to provide this service. NOW , THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, W yoming as follows: Section 1. The City of Evanston is authorized to enter into an agreement with the W yoming Association of Sheriffs and Chiefs of Police to obtain funds to be used for providing compliance inspections on retail tobacco outlets to enforce laws prohibiting the sale of tobacco to minors. Section 2. The Chief of Police is authorized to sign and the City Clerk attest said Agreement on behalf of the City. Councilmember moved, Councilmember Schuler, to adopt Resolution 14-67.
