EVANSTON CITY COUNCIL Second Regular Meeting October 15, 2013 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of October was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Cub Scout Pack #83 led those in attendance in the pledge of allegiance to the Flag. The roll was called and with a quorum being present, Mayor Joy Bell called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Bell; Councilmembers Tim Curtis Rex, Saundra Meyer, and W endy Schuler. Councilmember Evan Perkes and David W elling were excused. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; Director of Administrative Services/City Clerk, Jim Davis; Director of Planning & Development, Paul Knopf; Police Chief, Jon Kirby; City Engineer, Brian Honey; City Treasurer, Kathy Defa; Director of Parks and Recreation, Dennis Poppinga; and Deputy City Clerk, Nancy Stevenson. Public W orks Director, Oop Hansen was excused. A group of interested citizens were also present. Approve Agenda Councilmember Schuler moved, Councilmember Meyer seconded, to approve the agenda. Revenue & Expenditure Report Councilmember Rex moved, Councilmember Meyer seconded, to approve the Revenue and Expenditure Report. Council Comments Councilmember Rex commented on a recent trip he took and how nice it was to return to the wonderful place in which we live. Councilmember Meyer expressed her appreciation to the Police Department for all they do to insure our safety. Councilmember Schuler encouraged everyone to participate in “Hunters’ W idows Night Out” on Thursday, October 17 . th Mayor Bell commented on the following events and invited everyone to attend; “Hunters’s W idow Night Out”, the Uinta County Business Leadership Network & MentorABILITY award luncheon, and the Downtown Trick or Treat event. Consent Agenda Councilmember Meyer moved, Councilmember Schuler seconded, to approve the following on the Consent Agenda: A Parade Route Permit requested by the Evanston Jaycees for the Annual Parade of Lights on Thursday, December 5, 2013, beginning at 6:00 p.m. at the McDonald’s parking lot and ending at the Machine Shop parking lot. The motion passed unanimously with 5 yes votes: Bell, Rex, Meyer, Schuler. Ordinance 13-05 Councilmember moved, Councilmember Meyer seconded, to pass Ordinance 13-05 on third and final reading. Ordinance 13-05: AN ORDINANCE OF THE CITY OF EVANSTON, W YOMING AMENDING SECTION 24-69 AND SECTION 24-94 A. OF CHAPTER 24, ZONING ORDINANCE, OF THE EVANSTON CITY CODE TO UPDATE THE DEFINITION OF CHANGEABLE COPY SIGNS AND TO ALLOW ON-PREMISE CHANGEABLE COPY SIGNS TO ADVERTISE OFF-PREMISE USES. W HEREAS, Section 24-94 A. currently allows automatic Changeable copy signs to be used for off-premise advertising only when a conditional use permit is obtained; and W HEREAS, the Planning Department has developed a proposed amendment to Section 24-94 A. which would grant a business more flexibility in advertising by permitting changeable copy signs to be used for off-premise advertising without the need to obtain a conditional use permit; and W HEREAS, the Planning and Zoning Commission held a public hearing on September 9, 2013, to receive comments, information and input from the public regarding the proposed amendment to permit ---PAGE BREAK--- changeable copy signs to used for off-premise advertising without the need to obtain a conditional use permit; and W HEREAS, notice of the public hearing was published in a local newspaper of general circulation at least fifteen days in advance of the hearings; and W HEREAS, as a result of the hearing, the Planning and Zoning Commission has prepared and forwarded a positive recommendation to the Governing Body of the City of Evanston. NOW , THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The Definitions of “Changeable Copy Sign (Automatic)” and “Changeable Copy Sign (Manual)” set forth in Section 24-69 of Chapter 24 of the Evanston City Code are hereby amended and re- enacted to provide as follows: § 24-69. Definitions. As used in this article, the following terms shall have the meanings indicated: CHANGEABLE COPY SIGN (AUTOMATIC)– An automatic changeable copy sign is an electronic sign where advertising copy changes through mechanical means, utilizing digital technology and other similar graphic and visual technologies. CHANGEABLE COPY SIGN (MANUAL) – A manual changeable copy sign is a sign where copy is changed manually with changeable letters. Section 2. Section 24-94 A. of Chapter 24, of the Evanston City Code is hereby amended and re- enacted as set forth below: § 24-94. Commercial and Industrial. A. General Provisions. Unless otherwise specifically provided in this section, the following restrictions shall apply: An automatic changeable copy sign or manual changeable copy sign can be placed in any zoning district, except residential zoning districts, subject to the general sign provisions of the zoning district. An on-premise automatic changeable copy sign or an on-premise manual changeable copy sign can be used to advertise off-premise uses. The area of the sign shall count toward allowable on-premise sign area for the property. A Conditional Use Permit shall be required for an automatic changeable copy sign that is located within 100 feet of a residential zoning district. Ordinance 13-06 Councilmember Rex moved, Councilmember seconded, to pass Ordinance 13-06 on third and final reading. Ordinance 13-06: AN ORDINANCE APPROVING AND AUTHORIZING A ZONE CHANGE FOR PROPERTY IN THE CITY OF EVANSTON FROM A RURAL RESIDENTIAL ZONE TO A LOW DENSITY RESIDENTIAL DEVELOPING ZONE, AS REQUESTED BY LAURENCE HAVERHALS AND BETTY DERENTIS. W HEREAS, the property owner has filed an application with the Planning and Zoning Commission of the City of Evanston, W yoming to change the zoning of the property described below from a rural residential zone to a low density residential developing zone; and W hereas, the Planning and Zoning Commission scheduled a public haring for said application on September 9, 2013; and W HEREAS, notice of the public hearing and application was published in a newspaper of general circulation and notices of the hearing were mailed to affected landowners pursuant to City Ordinance; and ---PAGE BREAK--- W HEREAS, a public hearing was held by the Planning and Zoning Commission of the City of Evanston on September 9, 2013, to consider said application for a change; and W HEREAS, after receiving testimony and evidence from the applicants, affected landowners and the public at large, the Planing and Zoning Commission voted to recommend to the governing body that it approve the zone change. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The request by Laurence Haverhals and Betty Derentis to change the zoning of the property described below, from a rural residential zone to a low density residential developing zone is hereby approved and authorized. Said real property being more particularly described as follows: BEGINNING at the Northwest corner of said SE ¼, a 1 ½” steel pipe with a 3" brass cap appropriately inscribed as the center Quarter Corner of said Section 28, running thence N 89E43'46" E, 723.03 feet along the North line of said SE ¼ and South line of the Crestview Meadows Addition and Crestview Meadows Second Addition to the W est line of City View Drive; thence S 12E36'17" W , 67.50 feet along said W est line; thence S 89E43'46" W , 194.08 feet; thence S 00E12'50" E, 129.35 feet; thence S 83E53'24" W , 516.70 feet to the W est line of said SE ¼; thence N 00E12'50" W , 247.72 feet to the POINT OF BEGINNING. Said tract containing 2.917 acres more or less. Section 2: The City of Evanston is hereby authorized and directed to take all action necessary to implement said zone change. Final Acceptance/Staker & Parson Co./Street Overlay Project Councilmember Schuler moved, Councilmember Rex seconded, to authorize final acceptance and payment of retainage to Staker & Parson Company, for the Street Overlay Project. The motion passed unanimously with 5 yes votes: Bell, Rex, Meyer, Schuler. Resolution 13-72 Councilmember Meyer introduced Resolution 13-72. Councilmember Meyer moved, Councilmember seconded, to adopt Resolution 13-72. Resolution 13-72: RESOLUTION AUTHORIZING THE CITY OF EVANSTON, W YOMING TO ENTER INTO A SCADA SERVICE AGREEMENT W ITH W ETCO, INC. TO PROVIDE MAINTENANCE SERVICES FOR THE SCADA SYSTEM IN THE W ASTE W ATER TREATMENT PLANT. W HEREAS, the City has need to provide maintenance services to the SCADA System of the waste water treatment plant; and W HEREAS, W ETCO, INC. Is able to provide such services pursuant to the attached SCADA Service Agreement: NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The Mayor is hereby authorized to sign, and the City Clerk is hereby authorized to attest, on behalf of the City, the attached SCADA Service Agreement with W ETCO, Inc. to provide maintenance services for the SCADA System in the waste water treatment plant. Resolution 13-73: RESOLUTION AUTHORIZING THE CITY OF EVANSTON, W YOMING TO ENTER INTO A CONTRACT FOR SERVICES W ITH THE TO HOST THE UINTA COUNTY STAGE STOP DOG SLED RACE. W HEREAS, the annually hosts the Uinta County Stage Stop Dog Sled Race which promotes tourism within the City of Evanston; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The Mayor is hereby authorized to sign, and the City Clerk is hereby authorized to attest, on behalf of the City, the Contract for Services with the a copy of which is attached hereto, to host the Uinta county stage Stop Dog Sled Race and thereby promote tourism within the City of Evanston. Resolution 13-74: RESOLUTION OF THE CITY OF EVANSTON, W YOMING, AUTHORIZING THE CITY OF EVANSTON TO ENTER INTO A TRACK LEASE AGREEMENT W ITH W ATCO TRANSLOADING, L.L.C. d/b/a W ATCO TERMINAL & PORT SERVICES TO LEASE THE EVANSTON RAIL CENTER SITE FOR THE OPERATION OF A RAILROAD TRANSLOADING FACILITY. W HEREAS, the governing body of the City of Evanston has the opportunity to lease the Evanston Rail Center Site to W ATCO Transloading, L.L.C., ATCO”) to operate a railroad transloading facility; and W HEREAS, the lease with W ATCO will generate revenue that can be used to promote other economic development within the community; and W HEREAS, the operation of a railroad transloading facility may also stimulate other economic activity in the City of Evanston and Uinta County; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The City of Evanston, W yoming is hereby authorized to enter into the Track Lease Agreement with W ATCO Transloading, L.L.C. d/b/a/ W ATCO Terminal & Port Services to lease the Evanston Rail Center Site for the operation of a railroad transloading facility as set forth in the Track Lease Agreement attached hereto. Section 2: The Mayor is authorized to sign and the City Clerk attest the Track Lease Agreement on behalf of the City of Evanston, W yoming.
