EVANSTON CITY COUNCIL First Regular Meeting March 4, 2014 The official record of proceedings of the first regular meeting of the Evanston City Council for the month March was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Chris Jensen led those in attendance in the pledge of allegiance to the Flag. The roll was called and with a quorum being present, Mayor Joy Bell called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Bell; Councilmembers Tim Curtis Rex, Evan Perkes, Saundra Meyers, and W endy Schuler. Councilmember David W elling excused. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; Director of Administrative Services/City Clerk, Amy Grenfell; City Engineer, Brian Honey; City Treasurer, Kathy Defa; Police Chief, Jon Kirby; Director of Parks and Recreation, Dennis Poppinga; Public W orks Director, Oop Hansen; Deputy City Clerk, Nancy Stevenson; Police Lieutenant, Ken Pearson; and Associate Planner, DuW ayne Jacobson. Director of Planning & Development, Paul Knopf was excused. A group of interested citizens were also present. Approve Agenda Councilmember Meyer moved, Councilmember Schuler seconded, to approve the agenda. The motion passed unanimously with 6 yes votes: Bell, Rex, Perkes, Meyer, Schuler. Approve Minutes The official record of proceedings for the City Council Meeting held February 18, 2014 and a Work Session Meeting held February 25, 2014 were approved as presented. Council Comments Councilmember Rex reported that he had recently attended the W AM W inter W orkshops in Cheyenne. He also thanked Saundra Meyer for all her help and support assisting W AM with during this legislative session. Councilmember Schuler offered her condolences to the Davis family with the passing of long time residence Thelma Davis. She also commented on the Chili Cook-off and thanked those responsible for that event. Councilmember Meyers stated that she was glad to be able to help W AM out during the legislative session. She also thanked Mayor Bell for going to Cheyenne and speaking to the legislatures regarding SB-100. Mayor Bell also thank Saundra for her contribution to W AM during the legislative session. The Mayor commented on a workshop that she participated in for Leap into Leadership in Cheyenne. EXCEL! Award Presentation Ken Pearson, CERC (City of Evanston Recognition Committee) Chairperson, recognized Municipal Court Clerk, Chris Jensen for her outstanding efforts in helping to train a new court clerk in another municipality. Chris was presented with a certificate, an EXCEL! mug and coaster, an EXCEL! challenge coin, and a monetary award. ---PAGE BREAK--- Appointment to Boards Mayor Bell made following appointments to the Housing Authority Board. Councilmember Rex moved, Councilmember Schuler seconded, to confirm the following appointments: Housing Authority Board Allen Hansen (reappointment) - March 2019 Justin Mathson (reappointment) - March 2019 Consent Agenda Councilmember Schuler moved, Councilmember Meyer seconded, to approve the following Consent Agenda: A Limited Malt Beverage Permit requested by Young Musician, Inc. for the Celtic Festival at the Roundhouse and Railyards Complex on Friday, March 21, 2014 from 3:00 p.m. to 11:30 p.m. and Saturday, March 22, 2014 from 12:00 p.m. to 11:30 p.m. A Limited Malt Beverage Permit requested by UMF of America for the Evanston Freedom Rally to be held at Depot Square on Friday, June 13, 2014 from 6:00 p.m. to 11:00 p.m., Saturday, June 14, 2014 from 12:00 p.m. to 11:00 p.m., and Sunday, June 15, 2014 from 12:00 p.m. to 6:00 p.m.; An Open Container Permit requested by UMF of America for the Evanston Freedom Rally in the downtown area on Friday, June 13, 2014 from 6:00 p.m. to 11:00 p.m., Saturday, June 14, 2014 from 10:00 a.m. to 11:00 p.m., and Sunday, June 15, 2014 from 12:00 p.m. to 6:00 p.m.; A Street Closure requested by UMF of America for the Evanston Freedom Rally for Front Street from 9 Street to Harrison Drive and 10 Street from Front Street to the Alley between th th Main Street and Front Street and Harrison Drive from Front Street to Main Street on Saturday, June 14, 2014 from 10:00 a.m. to 6:00 p.m., and Sunday, June 15, 2014 from 12:00 p.m. to 6:00 p.m.; and A Parade Route requested by UMF of America for the Evanston Freedom Rally for Sunday, June 15, 2014 with the parade beginning at 12:00 noon at McDonald’s and ending at the Uinta County Complex. Ordinance 14-01 Councilmember moved, Councilmember Perkes seconded, to pass Ordinance 14-01 on third and final reading. Ordinance 14-01: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 15-34. OF THE CITY CODE TO BRING CURRENT THE SHOPLIFTING ORDINANCE BY DELETING A REFERENCE TO AN OUTDATED STATE STATUTE. W HEREAS, there is a need to amend the city’s shoplifting ordinance to delete a reference to an outdated state statute; NOW , THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1. Section 15-34. A. of the Evanston City Code is hereby amended and re-enacted to provide as follows: Sec. 15-34. Shoplifting. A. It shall be unlawful for any person to wilfully conceal or take possession of any goods offered for sale by wholesale or retail stores or other mercantile establishment, without the knowledge or consent of the owner thereof and with intent to convert the goods to his own use without paying the purchase price. Councilmember Meyer moved, Councilmember seconded, to adopt Resolution 14-15. Resolution 14-15: RESOLUTION OF THE GOVERNING BODY OF CITY OF EVANSTON, W YOMING, SETTING GREEN FEES AND OTHER RELATED FEES FOR THE PURPLE SAGE MUNICIPAL GOLF COURSE FOR THE 2014 GOLF SEASON. W HEREAS, the Golf Course Advisory Board has recommended that the City of Evanston set and ---PAGE BREAK--- charge the green fees and other related fees for the Purple Sage Municipal Golf Course for the 2014 golf season as set forth in the attached Recommendation; and W HEREAS, the governing body for the City of Evanston concurs with the recommendation of the Golf Course Advisory Board; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The City of Evanston shall set and charge fees and other related fees for the Purple Sage Municipal Golf Course for the 2014 golf season as set forth in the Golf Course Advisory Board Recommendation, which is attached hereto and incorporated herein. Resolution 14-16 Councilmember Rex introduced Resolution 14-16. Councilmember Rex moved, Councilmember Schuler seconded, to adopt Resolution 14-16. Resolution 14-16: A RESOLUTION OF THE CITY OF EVANSTON, W YOMING, AUTHORIZING AN APPLICATION FOR A SELECTIVE TRAFFIC ENFORCEMENT GRANT FROM THE HIGHW AY SAFETY PROGRAM OF THE W YOMING DEPARTMENT OF TRANSPORTATION. W HEREAS, supplemental grant funds are available from the Highway Safety Program of the W yoming Department of Transportation which are to be used by local law enforcement agencies to improve traffic safety through increased enforcement; and W HEREAS, it is necessary for the City to execute that attached Grant Application in order to receive the Supplemental Selective Traffic Grant funds. NOW , THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, W yoming as follows: Section 1. The Chief of Police is authorized to sign and submit the Supplemental Selective Traffic Enforcement Grant Application to the Highway Safety Program of the W yoming Department of Transportation, a copy of which is attached hereto.
