EVANSTON CITY COUNCIL Second Regular Meeting February 17, 2015 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of February was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Brad Asay of Boy Scout Troop 200 led those in attendance in the pledge of allegiance to the Flag. The roll was called and with a quorum being present (one Councilmember present via teleconferencing), Mayor Kent W illiams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor W illiams; Councilmembers Andy Kopp, and W endy Schuler; David W elling via teleconferencing. Councilmember Tim Evan Perkes, and Saundra Meyer were excused. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; Director of Administrative Services/City Clerk, Amy Grenfell; Director of Planning & Development, Paul Knopf; Police Chief, Jon Kirby; City Engineer, Brian Honey; City Treasurer, Kathy Defa; Public W orks Director, Oop Hansen; Director of Parks and Recreation, Dennis Poppinga; Assistant Director of Parks and Recreation, Jay Dee Nielsen; Deputy City Clerk, Nancy Stevenson, Urban Renewal Coordinator, Jane Law. A group of interested citizens were also present. Approve Agenda Mayor Williams suggested the following changes: Under New Business, add Resolution 15-12 and Resolution 15-13. Councilmember Schuler moved, Councilmember Kopp seconded, to approve the agenda with the suggested changes. The motion passed unanimously with 4 yes votes: W illiams, Kopp, W elling, Schuler. Approve Minutes The official record of proceedings for the City Council Meeting held February 3, 2015 and a Work Session held February 10, 2015 was approved as presented. Revenue & Expenditure Report Councilmember Schuler moved, Councilmember Kopp seconded, to approve the Revenue and Expenditure Report. Council Comments Mayor W illiams and Councilmember Schuler thanked all those that helped with the Sled Dogs Races and congratulated them on the very successful event. ---PAGE BREAK--- Special Presentation/United Way of Southwest Wyoming Kelly Frink and Kathy Tacke, Executive Co-Directors of United W ay of Southwest W yoming, thanked the Mayor and Council for their support of the United W ay Campaign. They explained the program and gave an update on the projects that they have helped with in our community over the past year. Consent Agenda Councilmember Schuler moved, Councilmember Kopp seconded, to approve the following Consent Agenda: A Limited Malt Beverage Permit requested by Young Musician, Inc. for a Young Musicians VIP Concert at the Beeman Cashin Building on Tuesday, March 17, 2015 from 5:00 p.m. to 10:00 p.m.; and a Limited Malt Beverage Permit requested by Young Musician, Inc. for the Celtic Festival at the Roundhouse and Railyards Complex on Friday, March 20, 2015 from 3:00 p.m. to 11:30 p.m. and Saturday, March 21, 2015 from 11:00 a.m. to 11:30 p.m. The motion passed unanimously with 4 yes votes: W illiams, Kopp, W elling, Schuler. Resolution 15-08 Councilmember Schuler introduced Resolution 15-08. Councilmember Schuler moved, Councilmember Kopp seconded, to adopt Resolution 15-08. Resolution 15-08: RESOLUTION AUTHORIZING THE CITY OF EVANSTON, W YOMING TO ENTER INTO A LETTER OF AGREEMENT W ITH THE W YOMING MAIN STREET PROGRAM FOR THE IMPLEMENTATION OF THE MAIN STREET PROGRAM IN THE CITY OF EVANSTON. W HEREAS, the City of Evanston and the State desire to implement the W yoming Main Street Program in the City of Evanston to promote the revitalization of the designated program area; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1. The Mayor is hereby authorized to sign the Letter of Agreement, a copy of which is attached hereto, with the W yoming Main Street Program for the implementation of the Main Street Program in the City of Evanston. Councilmember Kopp moved, Councilmember Schuler seconded, to adopt Resolution 15-09. Resolution 15-09: RESOLUTION OF THE CITY OF EVANSTON, W YOMING, AUTHORIZING THE EXECUTION OF A CONTRACT FOR SERVICES W ITH YOUNG MUSICIANS, INC., A W YOMING NON- PROFIT CORPORATION TO PROVIDE THE ANNUAL CELTIC MUSIC FESTIVAL. W HEREAS, Young Musicians has for a number of years put on a Celtic Music Festival in Evanston which provides music education and cultural activities for members of the community; and W HEREAS, the Celtic Music Festival also promotes tourism with in the City; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, a Contract for Services with Young Musicians, Inc., a W yoming non-profit corporation to provide the annual Celtic Music Festival, a copy of which is attached hereto. Resolution 15-10: RESOLUTION OF THE CITY OF EVANSTON, W YOMING, AUTHORIZING THE EXECUTION OF A MEMORANDUM OF UNDERSTANDING W ITH UINTA COUNTY PUBLIC HEALTH, TO COOPERATE IN PROVIDING A FACILITY FOR VACCINATIONS, NATURAL DISASTERS AND OTHER PUBLIC HEALTH EMERGENCIES. W HEREAS, the governing body of the City of Evanston has determined that it is in the public’s interest to cooperate with Uinta County Public Health to cooperate in providing a facility for vaccinations, natural disasters and other public health emergencies within Uinta County, W yoming; and W HEREAS, the City of Evanston and Uinta County Public Health have negotiated a Memorandum of Understanding which will provide a cooperative approach; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the Acting City Clerk attest, on behalf of the City of Evanston, the Memorandum of Understanding between the City of Evanston and Uinta County Public Health to cooperate in providing a facility for vaccinations, natural disasters and other public health emergencies, a copy of which is attached hereto. Councilmember Kopp moved, Councilmember Schuler seconded, to adopt Resolution 15-11. Resolution 15-11: A RESOLUTION OF THE CITY OF EVANSTON, W YOMING AUTHORIZING THE SUBMISSION OF AN APPLICATION FOR A EDUCATION/PROGRAM DEVELOPMENT GRANT TO THE W YOMING URBAN AND COMMUNITY FORESTRY PROGRAM TO OBTAIN FUNDS TO PREPARE A TREE GUIDE FOR THE COMMUNITY. W HEREAS, it would benefit the citizens of Evanston to have available a written guide describing the various types of trees that are suitable for the community; and W HEREAS, there are grant funds available from the W yoming Urban and Community Forestry Program which could be used to prepare a tree guide for the community; NOW , THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, W yoming as follows: Section 1. The City of Evanston, W yoming hereby authorizes the submission of an application for an Education/Program Development Grant to the W yoming Urban and Community Forestry Program to obtain funds to prepare a tree guide for the community. Councilmember Kopp moved, Councilmember Schuler seconded, to adopt Resolution 15-12. ---PAGE BREAK--- Resolution 15-12: RESOLUTION OF THE CITY OF EVANSTON, W YOMING AUTHORIZING THE EXECUTION OF A MEMORANDUM OF UNDERSTANDING W ITH THE UINTA COUNTY COMMISSIONERS, UINTA COUNTY SHERIFF AND THE UINTA COUNTY ATTORNEY TO FACILITATE AND PROVIDE CRISIS INTERVENTION MANAGEMENT FOR INDIVIDUALS SUBJECT TO EMERGENCY DETENTION. W HEREAS, the City has facilities in the medical spec building which are suitable for individuals who need emergency detention; and W HEREAS, the City of Evanston, the Uinta County Commissioners the Uinta County Attorney and the Uinta County Sheriff have negotiated a Memorandum of Understanding which will provide a cooperative approach to provide for emergency detentions; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Memorandum of Understanding between the City of Evanston, the Uinta County Commissioners, Uinta County Sheriff and the Uinta County Attorney to facilitate and provide crisis intervention management for individuals subject to emergency detention, a copy of which is attached hereto. Councilmember Schuler moved, Councilmember Kopp seconded, to adopt Resolution 15-13. Resolution 15-13: A RESOLUTION APPROVING AND AUTHORIZING THE FINAL PLAT FOR THE M BAR B SECOND ADDITION, A SUBDIVISION W ITHIN THE CITY OF EVANSTON, W YOMING AS MORE PARTICULARLY DESCRIBED HEREIN. W HEREAS, M Bar B Enterprises, a W yoming General Partnership, (the “Subdivider”,) has made application to the governing body of the City of Evanston, W yoming for approval and authorization of the proposed subdivision entitled the M Bar B Second Addition, a subdivision located within the City of Evanston, W yoming; and W HEREAS, the City of Evanston finds that said subdivision is a minor subdivision and can be approved pursuant to Section 22-10 of the Evanston City Code. NOW , THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, W yoming, that: Section 1. The final plat of the M Bar B Second Addition is hereby approved, accepted and authorized and described in particularity as follows, to-wit: BEGINNING at the Southwest corner of said lot 78, running thence N 0E24'23"E, 174.17 feet along the W est line thereof to the Southwest corner of Block 1 of the M Bar B Subdivision; Thence N 89E53'07"E, 295.29 feet along the South line of said Block 1 to the Southeast corner thereof and the East line of said Lot 78; Thence S 0E21'40" W , 174.59 feet along said East line to the Southeast corner of said Lot 78; Thence S 89E58'02" W , 295.43 feet along the South line of said Lot 78 to the POINT OF BEGINNING. Said M Bar B Second Addition containing 1.182 acres more or less. Section 2. The Mayor and City Clerk are hereby authorized and directed to enforce the mandates of chapter 22 of the Code of the City Evanston with regard to the filing of the final plat with the County Clerk of Uinta County, W yoming as by law required.
