EVANSTON CITY COUNCIL First Regular Meeting May 5, 2015 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of May was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Police Officer Jacob W illiams led those in attendance in the pledge of allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent W illiams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor W illiams; Councilmembers Tim Andy Kopp, Evan Perkes, David W elling, Saundra Meyer, and W endy Schuler. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; Director of Administrative Services/City Clerk, Amy Grenfell; City Engineer, Brian Honey; City Treasurer, Kathy Defa; Director of Planning & Development, Paul Knopf; Police Chief, Jon Kirby; Public W orks Director, Oop Hansen; Assistant Director of Parks and Recreation, Jay Dee Nielsen; Deputy City Clerk, Nancy Stevenson; and Environmental Services Manager, Gordon Robinson. Director of Parks and Recreation, Dennis Poppinga was excused. A group of interested citizens were also present. Approve Agenda Councilmember Schuler moved, Councilmember Welling seconded, to approve the agenda. The motion passed unanimously with 7 yes votes: W illiams, Kopp, Perkes, W elling, Meyer, Schuler. Approve Minutes The official record of proceedings for the City Council Meeting held April 21, 2015 was approved as presented. Council Comments The Mayor and City Councilmembers all thanked the Police Department and the Parks & Recreation Department for the Meet & Greet which was held at the Recreation Center last week. EXCEL! Award Presentation Gordon Robinson, CERC (City of Evanston Recognition Committee) Chairperson, recognized Officer Jacob W illiams for a task he took on regarding a burglary case which he spent many hours on while also still working in Patrol, where he was also required to fulfill those responsibilities. As a result of Officer W illiams was able to solve the burglary, and take illegal drugs off the street making our community a much better and safer place to live. Officer W illiams was presented with a certificate, an EXCEL! mug and coaster, an EXCEL! challenge coin, and a monetary award. ---PAGE BREAK--- Public Hearing/Evanston Energy Group, LLC City Attorney, Dennis Boal conducted a public hearing to consider the sale of personal and real property with improvements to Evanston Energy Group, LLC., pursuant to a Lease with Option to Purchase. City Clerk, Amy Grenfell explained the proposed project. Donald Biggs spokes person for Evanston Energy Group, LLC spoke in favor of the project and the Lease with Option to Purchase. Concerned citizen, Jay Stugelmeyer address the Governing Body with some concerns he wanted to address. No one else address this issue and Mr. Boal closed the hearing. Consent Agenda Councilmember Perkes moved, Councilmember seconded, to approve: A Parade Route requested by NVAR/VFW for the National Veterans Awareness Ride on Thursday, May 14, 2015 beginning at 5:00 p.m. at Exit 3 and ending on 9 Street between Main Street and Front Street; A th Street Closure Permit requesting by NVAR/VFW for the National Veterans Awareness Ride on Thursday, May 14, 2015 on 9 Street from Front Street to Main Street, from 5:00 p.m. to 9:00 p.m.; and th A Malt Beverage Permit requested by Katherine Bella with Bluegrass Evanston for the Beer, Brats and Bluegrass Festival in Depot Square on Friday, June 19, 2015 from 4:00 pm to 10:00 pm and Saturday, June 20, 2015 from 11:00 a.m. to 10:00 p.m. The motion passed unanimously with 7 yes votes: Bell, Rex, Perkes, W illiams, Meyer, Schuler. Resolution 15-27 Councilmember Welling introduced Resolution 15-27. Councilmember Welling moved, Councilmember Meyer seconded, to adopt Resolution 15-27. Resolution 15-27: RESOLUTION OF THE CITY OF EVANSTON, W YOMING, AUTHORIZING THE EXECUTION OF A CONTRACT FOR SERVICES W ITH PORTER’S FIREW ORKS TO PROVIDE FIREW ORKS DISPLAYS FOR THE CITY’S FOURTH OF JULY CELEBRATION. W HEREAS, the City of Evanston has solicited proposals from vendors to provide the fireworks displays for the City’s Fourth of July Celebration; and W HEREAS, Porter’s Fireworks has submitted to the City the best proposal to provide the displays; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1. The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, a Contract with Porter’s Fireworks to provide a fireworks display for the City’s Fourth of July Celebration, a copy of which is attached hereto. Councilmember moved, Councilmember Meyer seconded, to adopt Resolution 15-28. Resolution 15-28: A RESOLUTION OF THE CITY OF EVANSTON, W YOMING, RATIFYING THE APPLICATION FOR A SELECTIVE TRAFFIC ENFORCEMENT GRANT FROM THE HIGHW AY SAFETY PROGRAM OF THE W YOMING DEPARTMENT OF TRANSPORTATION. W HEREAS, grant funds are available from the Highway Safety Program of the W yoming Department of Transportation which are to be used by law enforcement agencies improve traffic safety through increased enforcement; NOW , THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, W yoming as follows: Section 1. The Police Department of the City of Evanston is authorized to apply for and accept a Selective Traffic Enforcement Grant from the Highway Safety Program of the W yoming Department of Transportation. Section 2. Resolution 15-29: A RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING, RATIFYING AN APPLICATION AND AUTHORIZING THE ACCEPTANCE OF A UNDERAGE DRINKING AND DRIVING ENFORCEMENT GRANT FROM THE W YOMING DEPARTMENT OF HEALTH. W HEREAS, grant funds are available from the W yoming Department of Health which are to be used to reduce underage drinking of alcohol within the community; NOW , THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, W yoming as follows: Section 1. The Police Department of the City of Evanston is authorized to apply for and accept a Underage Drinking Enforcement Grant from the W yoming Department of Health. Section 2. The Mayor, City Clerk and Police Department are authorized to sign and attest all documents and take all other actions which are necessary to accept and receive the grant. Councilmember Meyer moved, Councilmember Welling seconded, to adopt Resolution 15-30. Resolution 15-30: RESOLUTION OF THE CITY OF EVANSTON, W YOMING, AUTHORIZING THE ACCEPTANCE AND EXECUTION OF A PROPOSAL, MASTER AGREEMENT AND TASK ORDER W ITH TERRACON CONSULTANTS, INC. TO PROVIDE A PHASE 1 ENVIRONMENTAL SITE ASSESSMENT OF THE EVANSTON RAIL CENTER PROPERTY. W HEREAS, the City of Evanston has a need to establish a baseline of the environmental conditions existing on Evanston Rail Site to facilitate leasing of the property; and W HEREAS, Terracon Consultants, Inc., has submitted a Proposal, Master Agreement and Task Order to the City of Evanston to provide a Phase 1 Environmental Site Assessment of the Evanston Rail Site; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The Mayor is authorized to execute and the City Clerk attest the attached Proposal, Master Agreement and Task Order with Terracon Consultants Inc., to provide a Phase 1 Environmental Site Assessment of the Evanston Rail Site. Resolution 15-31: RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING AUTHORIZING THE EXECUTION OF A LEASE W ITH OPTION TO PURCHASE W ITH EVANSTON ENERGY GROUP, LLC, A W YOMING LIMITED LIABILITY COMPANY AND DETERMINING THAT THE SALE OF REAL PROPERTY TO EVANSTON ENERGY GROUP, LLC, PURSUANT TO THE LEASE W ITH OPTION TO PURCHASE W ILL BENEFIT THE ECONOMIC DEVELOPMENT OF THE MUNICIPALITY AS REQUIRED BY W YOMING STATUTE 15-1-112 Councilmember Perkes moved, Councilmember Schuler seconded, to table Resolution 15-31 to the June 2, 2015 meeting. The motion to table Resolution 15-31 passed unanimously with 7 yes votes: W illiams, Kopp, Perkes, W elling, Meyer, Schuler.
