EVANSTON CITY COUNCIL First Regular Meeting February 4, 2014 The official record of proceedings of the first regular meeting of the Evanston City Council for the month February was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Officer Preston Sheets led those in attendance in the pledge of allegiance to the Flag. The roll was called and with a quorum being present, Mayor Joy Bell called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Bell; Councilmembers Tim Curtis Rex, David W elling, Saundra Meyer and W endy Schuler. Councilmember Evan Perkes was excused. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; Director of Administrative Services/City Clerk, Amy Grenfell; City Engineer, Brian Honey; City Treasurer, Kathy Defa; Director of Planning & Development, Paul Knopf; Police Chief, Jon Kirby; Director of Parks and Recreation, Dennis Poppinga; Public W orks Director, Oop Hansen; Deputy City Clerk, Nancy Stevenson; and Police Lieutenant, Ken Pearson. A group of interested citizens were also present. Approve Agenda Councilmember Welling moved, Councilmember Meyer seconded, to approve the agenda. The motion passed unanimously with 6 yes votes: Bell, Rex, W elling, Meyer, Schuler. Approve Minutes The official record of proceedings for the City Council Meeting held January 21, 2014 and a Work Session Meeting held January 28, 2014 were approved as presented. Council Comments Councilmember Rex complemented all those that helped with the Boys and Girls Club fundraiser and commented on what a wonderful event it was. Councilmember Schuler stated that the Sled Dog races began in Jackson this week and will end in Evanston on Saturday and encouraged everyone to attend this event. She also announced that the Chamber of Commerce will soon be hosting a Chamber Mixer and the annual Chili Cook-off. ---PAGE BREAK--- Councilmember Meyer announced that she has been retained as the W AM’s lobbyist for this Legislative Session. Among the items she will be working on, are strategies to ensure passing the Governor’s budget proposal for cities, towns, and counties. Mayor Bell commented on the recent Skate Party, Union Telephone’s 100 year celebration, and the Boys and Girls Club fundraiser and she thanked all those involved with those wonderful events. The Mayor also announced that the City of Evanston will be hosting the fifth stage of the Tour of Utah cycling stage race in August. EXCEL! Award Presentation Ken Pearson, CERC (City of Evanston Recognition Committee) Chairperson, recognized Officer Preston Sheets for solving and clearing four burglaries that had occurred in our community. Officer Sheets was presented with a certificate, an EXCEL! mug and coaster, an EXCEL! challenge coin, and a monetary award. Appointment to Boards Mayor Bell made appointments to the following board and commission. Councilmember Rex moved, Councilmember seconded, to confirm the following appointments: Housing Authority Board Michelle Tholl - March 2017 Preservation Commission Tom Farrens - January 2015 The motion passed unanimously with 5 yes votes: Rex, W elling, Meyer, Schuler. Public Hearing/Liquor License Transfer/Jolly Jacs, LLC City Attorney, Dennis Boal conducted a public hearing to solicit public comment regarding the application for a transfer of ownership and location of a Retail Liquor License from BASK, Inc. dba: TC’s Steakhouse to Jolly Jacs, LLC dba: Evanston David Collar and Johnna Messmer spoke in favor of the application and explained the plans for their new store. John Porter spoke in opposition. No one else addressed the issue and Mr. Boal closed the hearing. Transfer of Ownership & Location/Liquor License/Jolly Jacs, LLC Councilmember Welling moved, Councilmember Meyer seconded, to approve the transfer of ownership and location of a Retail Liquor License from BASK, Inc dba: TC’s Steakhouse to Jolly Jacs, LLC dba: Evanston The motion passed with 4 yes votes: Rex, W elling, Meyer, Schuler. 2 no votes: Bell, Public Hearing/Bar & Grill License/TC’s Steakhouse City Attorney, Dennis Boal conducted a public hearing to solicit public comment regarding the application for a Bar and Grill License for BASK, Inc. dba: TC’s Steakhouse. Tom Kindler spoke in favor of the application. No one else addressed the issue and Mr. Boal closed the hearing. Bar & Grill License/Jolly Jacs, LLC Councilmember Schuler moved, Councilmember Welling seconded, to approve a Bar and Grill License for BASK, Inc dba: TC’s Steakhouse, contingent upon approval of the State Liquor Commission. The motion passed unanimously with 6 yes votes: Bell, Rex, W elling, Meyer, Schuler. Ordinance 14-01 Councilmember Welling sponsored Ordinance 14-01. Ordinance 14-01: AN ORDINANCE OF THE CITY OF EVANSTON, W YOMING AMENDING SECTION 15-34. OF THE CITY CODE TO BRING CURRENT THE SHOPLIFTING ORDINANCE BY DELETING A REFERENCE TO AN OUTDATED STATE STATUTE. Mayor Bell call for the vote to pass Ordinance 14-01 on first reading. 6 yes votes: Bell, Rex, W elling, Meyer, Schuler. ---PAGE BREAK--- Resolution 14-05 Councilmember Meyer introduced Resolution 14-05. Councilmember Meyers moved, Councilmember Rex seconded, to adopt Resolution 14-05. Resolution 14-05: RESOLUTION OF THE CITY OF EVANSTON, W YOMING, AUTHORIZING THE EXECUTION OF A BUILDING USE AGREEMENT W ITH EVANSTON CHILD DEVELOPMENT CENTER, INC., A W YOMING NON-PROFIT CORPORATION, TO PROVIDE EARLY CHILDHOOD EDUCATION IN A CITY BUILDING. W HEREAS, the governing body of the City of Evanston recognizes that it benefits the citizens of the community to provide early childhood for the youth of the community; and W HEREAS, Evanston Child Development Center, Inc., was formed in part to provide such education and activities for the pre-school youth of the community; and W HEREAS, the City owns a building which is particularly suitable for providing such a program; and NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Building Use Agreement with the Evanston Child development Center, Inc., a copy of which is attached hereto. Councilmember Schuler moved, Councilmember Welling seconded, to adopt Resolution 14-06. Councilmember Rex moved, Councilmember Meyer seconded, to amend Resolution 14-06 as follows: in the title and throughout the body of the Resolution delete “Community Youth Coalition” and insert “Boys and Girls Club of Evanston, Inc.”. The motion passed unanimously with 6 yes votes: Bell, Rex, W elling, Meyer, Schuler. Councilmember moved, Councilmember Welling seconded, to adopt Resolution 14-07. Resolution 14-07: RESOLUTION OF THE CITY OF EVANSTON, W YOMING, CONSENTING TO THE CONSTRUCTION OF IMPROVEMENTS BY EVANSTON CHILD DEVELOPMENT CENTER, INC., TO THE CITY’S BUILDING LOCATED AT 336 SUMMIT, EVANSTON, W YOMING. The motion failed with 6 no votes: Bell, Rex, W elling, Meyer, Schuler. Resolution 14-08 Councilmember Meyer introduced Resolution 14-08. Councilmember Meyer moved, Councilmember seconded, to adopt Resolution 14-08. Resolution 14-08: A RESOLUTION OF THE CITY OF EVANSTON, W YOMING AUTHORIZING THE EXECUTION OF A COMMUNITY DEVELOPMENT BLOCK AGREEMENT W ITH THE W YOMING BUSINESS COUNCIL TO OBTAIN FUNDS TO ASSIST IN PREPARING A CONCEPTUAL PLAN FOR THE DEVELOPMENT OF A RAIL ACCESS BUSINESS PARK IN THE CITY OR UINTA COUNTY, W YOMING. W HEREAS, the City of Evanston has been awarded a grant from the W yoming Business Council to develop a conceptual plan for the development of a rail access business park within the City or Uinta County; and W HEREAS, it is necessary for the City to execute a Community Block Grant Agreement with the W yoming Business Council in order to receive the funds. NOW , THEREFORE, BE IT RESOLVED by the governing body of the city of Evanston, W yoming as follows: Section 1. The Mayor and City Clerk are authorized to sign and attest the attached Community Block Grant Agreement with the W yoming Business Council to develop a conceptual plan for the development of a rail access business park within the City or Uinta County. Resolution 14-09 Councilmember Rex introduced Resolution 14-09. Councilmember Rex moved, Councilmember Welling seconded, to adopt Resolution 14-09. Resolution 14-09: RESOLUTION OF THE CITY OF EVANSTON, W YOMING AUTHORIZING THE EXECUTION OF A CONTRACT FOR SERVICES W ITH YOUNG MUSICIANS, INC., A W YOMING NON- PROFIT CORPORATION TO PROVIDE THE ANNUAL CELTIC MUSIC FESTIVAL. W HEREAS, Young Musicians has for a number of years put on a Celtic Music festival in Evanston which provides music education and cultural activities for members of the community; and W HEREAS, the Celtic Music Festival also promotes tourism with in the city; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, a Contract for Services with Young Musicians, Inc., a W yoming non-profit corporation to provide the annual Celtic Music Festival, a copy of which is attached hereto. She also commended the Mayor and City Councilmembers for the great job that they all do and thanked them for their service.
