EVANSTON CITY COUNCIL First Regular Meeting March 5, 2013 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of March was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Rebecca Landes led those in attendance in the pledge of allegiance to the Flag. The roll was called and with a quorum being present, Mayor Joy Bell called the meeting to order at 5:42 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Bell; Councilmembers Tim David Welling, Curtis Rex, Evan Perkes, Saundra Meyer, and Wendy Schuler. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; Director of Administrative Services/City Clerk, Jim Davis; Director of Public Works/City Engineer, Brian Honey; Director of Planning & Development, Paul Knopf; Police Chief, Jon Kirby; Director of Parks and Recreation, Dennis Poppinga; Public Works Superintendent, Oop Hansen; Deputy City Clerk, Nancy Stevenson; Police Lieutenant, Ken Pearson; Police Lieutenant, Bill Jeffers and Waste Water Supervisor, Frank Sheets. City Treasurer, Kathy Defa was excused. A group of interested citizens were also present. Approve Agenda Councilmember Welling moved, Councilmember Meyer seconded, to approve the agenda. The motion passed unanimously with 7 yes votes: Bell, Rex, Perkes, Welling, Meyer, Schuler. Approve Minutes The official record of proceedings for the City Council Meeting held February 19, 2013 and a Work Session Meeting held February 26, 2013 were approved as presented. Council Comments Councilmember Welling wished all the Evanston High School Red Devil teams good luck at State Tournament. Councilmembers Meyer and Schuler commented on the presentation, “End of Track” presented by Wyoming PBS at a public meeting in the Roundhouse last week. They thanked those who helped to arrange this presentation and commented that they were pleased to learn more about our Railroad History. Councilmember Schuler also thanked Dawn Darby and the Chamber of Commerce for all the work they did for this years Chili Cook-off. EXCEL! Award Presentation Frank Sheets, CERC (City of Evanston Recognition Committee) Chairperson and Ken Pearson, CERC Vice Chairperson recognized Detective Chris Smith for being nominated for an EXCEL! (Employees Exhibiting Commendable Efforts and Loyalty) Award. Chris was nominated by a fellow employee for putting the Police Department needs before his own on many occasions. Mayor Bell presented Detective Smith with a certificate, an EXCEL! mug and coaster, and a monetary award. Mr. Sheets and Lieutenant Pearson also recognized Sergeant Don Shillcox and Officer Rebecca Landes for being nominated for an EXCEL! Award. Shillcox and Landes were also nominated by a fellow employee for going above and beyond to rescue a cat that had been stuck in a tree for several days in frigid temperatures. Mayor Bell presented Officer Landes a certificate, an EXCEL! mug and coaster, and a monetary award. Sergeant Shillcox was unable to attend the meeting and will be presented with his award at a later date. ---PAGE BREAK--- Appointment/Planning and Zoning Commission Councilmember Welling moved, Councilmember Meyer seconded, to approve Mayor Bell’s appointment of Curtis Rex to the Airport Joint Powers Board, to fill the remainder of the term vacated by Rich Carver. The motion passed unanimously with 6 yes votes: Rex, Perkes, Welling, Meyer, Schuler. Ordinance 13-01 Councilmember Perkes sponsored Ordinance 13-01. Councilmember moved, Councilmember Rex seconded, to pass Ordinance 13-01 on first reading. Ordinance 13-01: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING ENACTING SECTION 4-6.1. OF ARTICLE II OF CHAPTER 4, ALCOHOLIC BEVERAGES, OF THE EVANSTON CITY CODE TO REQUIRE LICENSEES TO REQUIRE PERSONS WHO SERVE ALCOHOL HAVE ALCOHOL SEVER TRAINING. The motion passed unanimously with 7 yes votes: Bell, Rex, Perkes, Welling, Meyer, Schuler. Resolution 13-06 Councilmember Schuler introduced Resolution13-06. Councilmember Schuler moved, Councilmember Meyer seconded, to adopt Resolution 13-06. Resolution 13-06: A RESOLUTION OF THE CITY OF EVANSTON, WYOMING RATIFYING THE SUBMISSION OF AN APPLICATION FOR A FY14 WYOMING COURT SUPERVISED TREATMENT PROGRAM GRANT TO OBTAIN FUNDS FOR YOUTH DRUG COURT TREATMENT PROGRAM. WHEREAS, there are grants which can be used to provide funds for the City’s Youth Drug Court Treatment Program; and WHEREAS, the governing body for the City of Evanston has determined that it is in the public’s interest to apply for a grant to continue funding of the Youth Drug Court Treatment Program; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The City of Evanston is authorized to submit an application for a FY14 Wyoming Court Supervised Treatment Program Grant to continue funding of the Youth Drug Court Treatment Program. Section 2: The action of the Mayor and City Clerk to sign and attest all documents which were necessary to submit the grant application on behalf of the City are authorized. Resolution 13-07 Councilmember introduced Resolution13-07. Councilmember moved, Councilmember Perkes seconded, to adopt Resolution 13-07. Resolution 13-07: RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, SETTING GREEN FEES AND OTHER RELATED FEES FOR THE PURPLE SAGE MUNICIPAL GOLF COURSE FOR THE 2013 GOLF SEASON. WHEREAS, the Golf Course Advisory Board has recommended that the City of Evanston set and charge the green fees and other related fees for the Purple Sage Municipal Golf Course for the 2013 golf season as set forth in the attached Recommendation; and WHEREAS, the governing body for the City of Evanston concurs with the recommendation of the Golf Course Advisory Board; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The City of Evanston shall set and charge the green fees and other related fees for the Purple Sage Municipal Golf for the 2013 golf season as set forth in the Golf Course Advisory Board Recommendation, which is attached hereto and incorporated herein. ---PAGE BREAK--- PASSED, APPROVED AND ADOPTED the 5th day of March, 2013. Resolution 13-08 Councilmember Meyer introduced Resolution13-08. Councilmember Meyer moved, Councilmember Welling seconded, to adopt Resolution 13-08. Resolution 13-08: A RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A GEOTECHNICAL ENGINEERING SERVICES AGREEMENT WITH IGES, INC TO PROVIDE A GEOTECHNICAL INVESTIGATION AND REPORT FOR THE MEDICAL SPECULATIVE BUILDING PROJECT. WHEREAS, the City of Evanston and IGES, Inc. have negotiated an agreement whereby IGES, Inc., will provide a geotechnical investigation and report for the Medical Speculative Building Project; and NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Agreement between the City of Evanston and IGES, Inc., a copy of which is attached hereto, to provide a geotechnical investigation and report for the Medical Speculative Building.
