DRAFT AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL CERRITO AMENDING TITLE 19 OF THE EL CERRITO MUNICIPAL CODE TO INCORPORATE THE SAN PABLO AVENUE SPECIFIC PLAN AREA SECTION 1. RECITALS A. On September 4, 2014, (Resolution ) the Planning Commission considered the Environmental Impact Report (EIR) for the San Pablo Avenue Specific Plan (SPASP) project and recommended that the City Council certify the EIR; and B. On September 4, 2014, (Resolution ) the Planning Commission considered the SPASP and recommended that the City Council adopt the SPASP; SECTION 2. MUNICIPAL CODE AMENDMENT SECTION 1. The following section of Title 19, Z o n i n g, C h a p t e r 19.15, of the El Cerrito Municipal Code is hereby amended to read as follows: Part III – Special District Regulations Chapter 19.15: San Pablo Avenue Specific Plan Area District (–SPASP) 19.15.010 Purpose The general purpose of the –SPASP San Pablo Avenue Specific Plan Area district is to recognize and designate the unique planning context of the San Pablo Avenue corridor and to prescribe planning and design principles for the plan area. In addition to furthering the general principles of the El Cerrito zoning ordinance, the specific purposes of the –SPASP district include the following: A. To establish area-specific and context-sensitive development standards to produce an attractive, coherent and efficient built environment. B. To identify public improvements necessary to accommodate and support development in the plan area. C. To permit development in the plan area while ensuring adequate standards relating to public health, safety, welfare, comfort and convenience. 19.15.020 Applicability The San Pablo Avenue Specific Plan was adopted by the City Council on All notations, references, and other information shown in the SPASP are incorporated by reference and shall be deemed as much a part of this title as if the matter and information set forth in the plan were fully described in this chapter. All terms not otherwise defined in the San Pablo Avenue Specific Plan shall have the meaning set forth in the El Cerrito Municipal Code. In the event of a conflict between the terms, conditions, requirements, policies, or other provisions of the San Pablo Avenue Specific Plan and the El Cerrito Municipal Code, the San Pablo Avenue Specific Plan shall take precedence. (Ord. ---PAGE BREAK--- DRAFT 19.15.030 Permitted Uses Land uses within the –SPASP San Pablo Avenue Specific Plan Area district shall be permitted as prescribed in the San Pablo Avenue Specific Plan. (Ord. 19.15.040 Development Standards Development standards within the –SPASP San Pablo Avenue Specific Plan Area district shall be those standards prescribed in the San Pablo Avenue Specific Plan. SECTION 3. NOTICING, POSTING AND PUBLICATION This ordinance is adopted pursuant to the procedures established by state law, and all required notices have been given, and the public hearing has been properly held and conducted. SECTION 4. EFFECTIVE DATE This ordinance shall not take effect until thirty days after the second reading, November 6, 2014.
