Official Use Only: Date received: Amount Receipt ---PAGE BREAK--- OFFICIAL RULES FOR FOOD VENDORS – CITY OF EL CERRITO FOURTH OF JULY & WOLDONE FESTIVAL To ensure a pleasant and successful day for everyone involved, please not that all booth participants are expected to conduct themselves in a professional manner. Please read and initial each line that you agree to the condition. 1. Fourth of July & WorldOne Festival will be presented by the City of El Cerrito on Thursday, July 4, 2013 from 10:00 AM-6:00 PM. Initial: 2. Cars are permitted entry to the Food Court area between 7:00 AM-9:00 AM to unload food items and supplies. All vehicles must vacate the Food Court area by 9:00 AM. Initial: 3. Vehicle will not be allowed to enter the Food Court area until 6:00 PM. Initial: 4. Each food vendor’s booth will have signage supplied by the City of El Cerrito with a booth number, name, address, city, and telephone number of your business or organization. Bring your own merchant signs. Initial: 5. Vendor agrees to occupy booth space as assigned, and to be open and staffed during all regular festival hours (10:00 AM – 6:00 PM). In the event that the Vendor shall not occupy or staff said space, the City is expressly authorized to occupy or cause said space to be occupied in such a manner as it may deem best for the interest of the Festival without any refunds or allowance whatsoever to the Vendor and without anyway releasing the Vendor from any liability there under. The vendor also agrees not to sublet or apportion said space to anyone else. Initial: 6. All food vendor booths will receive two 6 ft. tables, two folding chairs and two pallets. Additional tables, chairs and pallets needed are the responsibility of the food vendor. Initial: 7. All food and supplies must be at least 6 inches off the ground. Should you need additional space for supplies please bring tables or pallets to meet your storage needs. Initial: 8. The City will not be liable for refunds or any other liabilities whatsoever for failure to fulfill this contract due to acts of nature, statutes, ordinances or any legal authority, or any other cause beyond the City’s control. REMEMBER: The event happens regardless or weather. Initial: 9. All pertinent Fire Codes, laws, ordinances, and regulations pertaining to health, fire prevention and public safety shall be strictly obeyed. Initial: 10. Any food vendor who will be conducting cooking activities is required to have a minimum of one 2A-10B: C Fire extinguisher that has the proper certified State Fire Marshal tag on it and that it must have been serviced within one year of the date of the events inspection date. Initial: 11. In addition to the above required 2A-10B: C fire extinguisher, any food vendor who will be conducting any cooking using deep fat frying or grease-laden vapors (use of wok) is also required to have one K-rated fire extinguisher that must have been served within one year of the date of the events inspection date. Any food vendor using a BBQ, any open flame cooking devise (open flame burners), deep fat fryers or grease-laden cooking (woks) must conduct this type of cooking activity minimum of 10 ft. away from any and all covered booths. Additional space is required for the use of any of these. Initial: 13. Cooking oil may not be disposed of on the street. Initial: 14. All Food Services Vendors will be inspected during the event by the El Cerrito Fire Marshall and inspectors from the Contra Costa Environmental Health Services. Initial: 15. Food booths requesting electricity must supply their own commercial grade electrical power cords. Initial: 16. All vendors must stop selling by 6:00 PM. Vendors must retrieve their vehicles, pack up and be off the site by 7:00 PM to allow the site to be cleaned and the rental booths to be dismantled. Initial: 17. Payment Terms: Applicants must submit a check, money order or credit card payment with their application/contract for booth space. Checks will be deposited/ Credit cards will be charged upon acceptance. Applications received without full payment & required forms will not be considered and returned to sender. Initial: 18. Vendor agrees to allow the City to use their photos and application materials for promotional purposes. Initial: 19. This Contract constitutes the entire contract between parties and no waivers, modifications or amendments shall be valid unless written upon or attached hereto and shall be approved in writing by the City of El Cerrito. All food vendor operators must have completed the Vendor Checklist/Booth Information form for Contra Costa Health Service’s Requirements for Temporary Food Facilities Application from the Fourth of July Package provided by the City of El Cerrito. There is a mandatory information meeting with the Contra Costa Environmental Health Department (schedule TBA). The meeting will be held in the Conference Room, Community Center, 7007 Moeser Lane, El Cerrito. Initial: ---PAGE BREAK--- COMPOSTABLE FOODWARE REIMBURSEMENT APPLICATION The City of El Cerrito requires that all 2013 Fourth of July Celebration food vendors use compostable and recyclable food ware products for all food sold at the event. EPS foam (e.g. Styrofoam™) and other plastic food ware may not be used. To support the transition to compostable and recyclable food ware products, the City is providing up to $100 reimbursement to all Fourth of July Celebration food vendors that purchase compostable food ware products for use during the 2013 Celebration. Compostable food ware products include paper, cardboard, bags, and other ASTM certified compostable products. Recyclable food ware products include aluminum foil, cans and bottles, and #1 plastic cups. To apply for reimbursement, please complete this form, attach purchase receipts (for eligible compostable food ware products), and submit them upon inspection during the 2013 Fourth of July Celebration. Food service businesses that submit completed applications (with receipts) during the event will be mailed a check during the month of July.
