AGENDA BILL Agenda Item No. 5(G) Date: October 7, 2014 To: El Cerrito City Council From: Melissa L. Tigbao, Engineering Manager / Senior Engineer Yvetteh Ortiz, Public Works Director / City Engineer Subject: Parking Modifications on Fairmount Ave between San Pablo Avenue and Carlson Boulevard ACTION REQUESTED Adopt a resolution authorizing the Public Works Director / City Engineer to establish a “No Parking” restriction from 3 PM to 10 PM on Wednesdays for both sides of Fairmount Avenue between San Pablo Avenue and Carlson Boulevard. DISCUSSION The Public Works Department is proposing establishment of a “No Parking” restriction in support of the Administrative Use Permit issued by the Planning Division for Off the Grid. The Off the Grid Administrative Use Permit was renewed on June 27, 2014 to run through July 30, 2015 for a public food market event every Wednesday from 5 PM to 9 PM. Per the Administrative Use Permit, the applicant is to start event set up at 3:30 PM and take down operations by 10 PM. The current parking restriction on Fairmount Avenue between San Pablo Avenue and Carlson Boulevard is a one-hour time limit from 9 AM to 6 PM except Saturdays, Sundays, and Holidays. For the past year, this roadway segment has been temporarily signed for “No Parking” from 3 PM to 10 PM on Wednesdays using temporary signs on various types of barricades and delineators. The barricades showed to be a potential obstruction to the path of travel along the sidewalk, and the temporary signs faded after short use. The installation of permanent sign panels is a Condition of Approval to the permit and a notification regarding these conditions was sent to residents and businesses within a 300 foot radius of the event location. The establishment of a “No Parking” restriction from 3 PM to 10 PM on Wednesdays for both sides of Fairmount Avenue between San Pablo Avenue and Carlson Boulevard will allow for closure of the street for not only Off the Grid, but other special events as well. It will also reduce maintenance of the temporary signs and ensure a clear path of travel. The establishment of a “No Parking” restriction requires City Council approval. ---PAGE BREAK--- Agenda Item No. 5(G) If the Off the Grid event ceases operation in this location and no other special events are anticipated as established, Public Works staff will return to City Council and request that the "No Parking" restriction be eliminated. ENVIRONMENTAL CONSIDERATIONS The installation of signs is not subject to the California Environment~! Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. STRATEGIC PLAN CONSIDERATIONS Approval of the establishment of the proposed parking restriction would help fulfill the following City ofEl Cerrito Strategic Plan Goals: Goal A: By working with Off the Grid to establish parking restrictions on Fairmount A venue between San Pablo A venue and Carlson Boulevard, the City is developing and strengthening the relationships with public and private partners, residents, businesses and community groups. Goal C: By working with Off the Grid to establish parking restrictions on Fairmount A venue between San Pablo A venue and Carlson Boulevard, the City is promoting and supporting entertainment, recreational, and leisure activities for people of all ages and demographics. FINANCIAL CONSIDERATIONS The cost for materials and installation will be paid for by the applicant, Off the Grid, per the Conditions of Approval of the Administrative Use Permit. LEGAL CONSIDERATIONS El Cerrito Municipal Code Section 11.40.230 requires that parking prohibitions during specific hours be approved by City Council Resolution. Attachment: 1. Resolution for Establishment of Parking Restriction on Fairmount A venue between San Pablo A venue and Carlson Boulevard Page2 ---PAGE BREAK--- Agenda Item No. 5(G) Attachment 1 RESOLUTION 2014–XX RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL CERRITO AUTHORIZING THE ESTABLISHMENT OF A “NO PARKING” RESTRICTION FROM 3 PM TO 10 PM ON WEDNESDAYS ON BOTH SIDES OF FAIRMOUNT AVENUE BETWEEN SAN PABLO AVENUE AND CARLSON BOULEVARD WHEREAS, the Public Works Department is proposing establishment of a “No Parking” restriction from 3 PM to 10 PM on Wednesdays for both sides of Fairmount Avenue between San Pablo Avenue and Carlson Boulevard; and WHEREAS, the Public Works Department is proposing such establishment in support of the Administrative Use Permit issued by the Planning Division for Off the Grid; and WHEREAS, the current parking restriction on Fairmount Avenue between San Pablo Avenue and Carlson Boulevard is a one-hour time limit from 9 AM to 6 PM except Saturdays, Sundays and Holidays; and WHEREAS, if the Off the Grid event ceases operation in this location and no other special events are anticipated during the times established by this resolution, Public Works staff will return to the City Council and request that the “No Parking” restriction be eliminated; and WHEREAS, Section 11.40.230 of the El Cerrito Municipal Code requires that parking prohibitions during specific hours be approved by the City Council. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of El Cerrito hereby authorizes the Public Works Director / City Engineer to establish a “No Parking” restriction from 3 PM to 10 PM on Wednesdays for both sides of Fairmount Avenue between San Pablo Avenue and Carlson Boulevard. BE IT FURTHER RESOLVED that the City Council of the City of El Cerrito finds that this action is not subject to the California Environmental Quality Act (“CEQA”) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines because it has no potential for resulting in physical change to the environment, directly or indirectly. BE IT FURTHER RESOLVED that this Resolution shall become effective immediately upon passage and adoption.
