CITY HALL 10940 San Pablo Avenue El Cerrito, CA 94530 QUESTIONS AND ANSWERS as of January 5, 2012 ScCAP Solar PV Systems Joint Procurement Design/Build RFP/RFQ for Municipal Solar Procurement Q1) Will you sign a Non-Disclosure Agreement regarding our financial statements? The Notice to Design Build Entities regarding the RFQ contains a confidentiality clause on page 6 that states “The information contained in these questionnaires and the financial statements provided to the City of El Cerrito are not public records and shall not be open to public inspection.” Please review this clause to ascertain as to whether it will accomplish the same results as a NDA. If it does not, your firm may submit its NDA form for our legal review. Q3) Will the winning contractor be contracting directly with each city or will there be a single contract? If a single contract, who is the contracting authority? Each city will execute a separate contract with each of the winning contractors. However, the contract templates, as negotiated with the contractor(s), will be essentially the same between the four ScCAP cities (Albany, El Cerrito, Piedmont, and San Pablo). A notable exception is for the City of Berkeley’s “Berkeley West Branch Library.” This is the only Berkeley project and is optional for bidders to include in their bids, as it is subject to the City of Berkeley’s additional contract requirements, as detailed at the following website: http://www.ci.berkeley.ca.us/ContentDisplay.aspx?id=5120 It is a possibility that the cities could collaborate to use one project management firm to oversee contract and labor compliance and streamline point of contacts for contractor(s). Q4) Who will be administering the Prevailing Wage requirements? Because each city will be managing its own contract with the contractor, each city will administer the prevailing wage requirements pertaining to their projects. Q5) For the Prevailing Wage requirement, please clarify the hourly payment rate that will be associated with the following job classifications: Laborer; Ironworker; Inside Wireman? Q6) How much weight will be given to EPCs who utilize local workforce development programs? None of the cities participating in this RFQ/RFP provide extra credit for utilizing local workforce development programs. Q7) Is there an ARRA requirement? No. This project will not be financed by federal stimulus funds.
