AGENDA BILL Agenda Item No. 5(I) Date: October 7, 2014 To: El Cerrito City Council From: Melanie Mintz, Interim Community Development Director Margaret Development Services Manager Subject: Professional Services Agreement with 4Leaf Inc. ACTION REQUESTED Adopt a resolution authorizing the City Manager to execute an amendment to the Professional Services Agreement between the City of El Cerrito and 4Leaf Inc. (Consultant) to provide support services to the Building Division in an amount not to exceed $25,000 bringing the total contract to an amount not to exceed $50,000 for fiscal year 2015. DISCUSSION The Community Development Department’s Building Division has utilized contract services to fill the role of Building Official for the past two fiscal years and recently filled the position, as of October 1, 2014. Between July 1, 2014 and October 1, 2014 the position continued to be filled by 4Leaf Inc. (Consultant). 4Leaf was selected after evaluating multiple options including other firms, other cities and the County. Additionally, the Building Division’s adopted 2014-15 budget included funds for Part- Time assistance to fulfill building inspection services during times of increased activity. City staff has not been able to retain an on-call Part-Time regular employee, and has therefore utilized Consultant services to fulfill the on-call inspection services function. The proposed $25,000 contract amendment is to continue to utilize 4Leaf Inc. services to fulfill the on-call building inspection function. An existing $25,000 agreement has provided for both Building Official and Inspection services for this fiscal year. The proposed amendment will allow the Division to continue to utilize the Consultant’s services on an on-call basis. The new Building Official will evaluate the Division’s needs and available budget and determine and recommend the appropriate staffing levels going forward. FINANCIAL CONSIDERATIONS The cost of the proposed amendment to the Professional Services Agreement will be offset by Part-Time Salary and Wage savings. IN THE AMOUNT NOT TO EXCEED $25,000 WHEREAS, the City of El Cerrito has an existing contract with 4Leaf Inc. (Consultant) to provide support services to the Building Division; and WHEREAS, the City of El Cerrito adopted Fiscal Year 2014-15 budget included funds for part-time inspection services to be able to fulfill inspection needs during times of increased activity; and WHEREAS, the Building Division has not yet retained an on-call part-time employee to fill the position; and WHEREAS, the Consultant is qualified to fill the functions of the position. NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of El Cerrito that it hereby authorizes the City Manager to execute an amendment to the Professional Services Agreement between the City of El Cerrito and 4Leaf Inc. in an amount not to exceed $25,000. BE IT FURTHER RESOLVED, that this Resolution shall become effective immediately upon passage and adoption.
