AGENDA BILL Agenda Item No. 5(F) Date: September 17, 2013 To: El Cerrito City Council From: Garth Schultz, Operations + Environmental Services Division Manager Subject: Endorsement of the Agreement between the West Contra Costa Integrated Waste Management Authority and Republic Services for Post- Collection Processing and Landfill Disposal Service ACTION REQUESTED Approve a recommendation advising Mayor Lyman or Council Member Friedman to vote on the City Council’s endorsement of the Agreement between the West Contra Costa Integrated Waste Management Authority and Republic Services, Inc. for Post- Collection Processing and Landfill Disposal when the Agreement is considered by the Authority Board of Directors (currently scheduled for October 10, 2013). BACKGROUND & DISCUSSION The West Contra Costa Integrated Waste Management Authority (Authority) is a joint powers authority that manages many aspects of solid waste for unincorporated sections of west Contra Costa County and the following five west county cities: El Cerrito, Richmond, San Pablo, Pinole, and Hercules. The Authority currently contracts with Republic Services, Inc. (Republic) for post-collection services on behalf of its member agencies. These services include: recyclables processing; composting; operation of the Household Hazardous Waste facility, and; transfer, transportation and land-filling of solid waste. The current agreement for post-collection services terminates on December 31, 2013. In 2012, the Authority conducted a competitive Request for Qualifications and Statement of Interest (SOI) procurement process for post-collection processing and disposal services, effective January 1, 2014. As a result of the SOI process, the Authority received six proposals from qualified firms for post-collection services. Unlike the other proposers, Republic’s proposal included significant improvements to collection services for the member agencies served by Republic-owned Richmond Sanitary Services (RSS). RSS provides collection services to all member agencies except El Cerrito, whose collection services are provided by East Bay Sanitary Company (EBS) and the City itself. On December 13, 2012, based on the recommendations of an evaluation team comprised of Authority and member agency staff (including El Cerrito staff), the Authority Board of Directors (Board) directed its staff to enter into negotiations with Republic for post- collection services. After the development of mutually agreeable terms (which the El ---PAGE BREAK--- Agenda Item No. S(F) Cerrito City Council endorsed, and the Board approved in April, 2013) the Board directed Authority staff to proceed to develop an agreement with Republic for the provision of all post-collection services for the member agencies served by RSS. Because many of the services proposed by Republic as a result of the SOl process provided specific value to the RSS service area, El Cerrito entered into separate negotiations with Republic for the provision of post-collection services for the City. El Cerrito's independent negotiation process resulted in the proposed El Cerrito-Republic Agreement which is also on the Council's September 17 Agenda (please see separate Agenda Item on this topic). Despite the fact that the Authority's post-collection agreement does not provide direct benefit to the City of El Cerrito, as a voting member agency of the Authority, El Cerrito's endorsement of the proposed Authority-Republic Post-Collection Agreement is important because the scope of services it provides will improve solid waste management services in the region and help increase regional diversion rates (as reported by the Authority to the State). FINANCIAL CONSIDERATIONS El Cerrito's endorsement of the Authority-Repu~lic Post-Collection Agreement will have no direct fiscal impact on the City ofEl Cerrito. ENVIRONMENTAL CONSIDERATIONS The services provided to the RSS member agencies as a result of the Authority-Republic agreement will result in greater regional participation in recycling, composting, and other diversion (meaning non-landfill) waste management programs. Increased participation in these types of programs should result in fewer greenhouse gas (GHG) emissions related to solid waste for all Authority member agencies.
