AGENDA BILL Agenda Item No. 5(C) Date: November 20, 2012 To: El Cerrito City Council From: Sylvia Moir, Chief of Police Michael Regan, Police Captain Subject: Renew Participation in the Contra Costa Abandoned Vehicle Abatement Service Authority ACTION REQUESTED Adopt a Resolution authorizing the City Manager or his designee to renew participation in the Contra Costa Abandoned Vehicle Abatement Service Authority by entering into a Joint Powers Agreement. BACKGROUND The City of El Cerrito Police Department opted to join the Contra Costa Abandoned Vehicle Abatement Authority in 1991 as authorized by Council Resolution No. 91-64. This Joint Powers Authority was formed pursuant to California Vehicle Code Section 22710 and California Government Code Section 6500. The formation of the JPA allowed Contra Costa County and the Cities to spilt $1.00 of registration fees for all vehicles registered in the County with the money being used to off-set the cost of abandoned vehicle abatement. The money is split between the entities in a two step formula. First, fifty percent of the money is divided amongst the entities based upon population. Second, the remaining money is paid to the entities based on the number of abandoned vehicle that are abated per year. FINANCIAL CONSIDERATIONS Over the last ten years, the City has received $202,157.74 from its participation in the Abandoned Vehicle program. The annual average is $20,215.77. This money is utilized to purchase equipment and supplies used in the abandoned vehicle abatement process. ---PAGE BREAK--- ---PAGE BREAK--- RESOLUTION 2012 - XX RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL CERRITO AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO RENEW PARTICIPATION IN THE CONTRA COSTA ABANDONED VEHICLE ABATEMENT JOINT POWERS AUTHORITY WHEREAS, the California Vehicle Code allows for the establishment of the Abandoned Vehicle Authority; and WHEREAS, the City of El Cerrito finds that abandoned, inoperable, wrecked, dismantled vehicles or parts thereof pose a health and safety hazard and are found to be public nuisances; and WHEREAS, the City of El Cerrito finds that the Abandoned Vehicle Abatement Program is needed to provide for the proper removal and disposal of abandoned vehicles. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of El Cerrito hereby authorizes the City Manager or his designee to renew the City’s participation in the Contra Costa Abandoned Vehicle Abatement Authority pursuant to Section 22710 of the California Vehicle Code.
