Date: To: From: Subject: July 17, 2012 El Cerrito City Council Cheryl Morse, City Clerk Revisions to the City Conflict of Interest Code ACTION REQUESTED AGENDA BILL Agenda Item No. 5(C) Adopt a Resolution directing the City Clerk to review the Conflict of Interest Code and if any changes are necessary to submit a revised Code to the City Council for approval, or if no changes are necessary to so notify the Council. BACKGROUND The Political Reform Act requires every state and local government agency to adopt and promulgate a conflict of interest code (CA. Govt. § 87300.) The Act further requires the City Council, as the code-reviewing body, to direct city staff by July of each even-numbered year to review its conflict of interest code, and if any changes are necessary to submit an amended code for approval. (CA. Govt. § 87306.5) An amended code, if necessary, will be submitted to the City Council for review no later than October 1. The Act also mandates that if no changes are necessary, that a notification be sent to the City Council by October 1. This direction may be permanently delegated to a designated City staff member. When the Conflict of Interest Code is submitted for approval, assuming some changes will be necessary, it will include such a permanent delegation for future years. In the unlikely circumstance that no changes are forthcoming, then a separate resolution will be sent to the Council for approval to incorporate such a permanent delegation into the City Conflict of Interest Code. NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of El Cerrito directs the City Clerk to review the City's Conflict of Interest Code and if changes are required to submit a revised code for Council approval, or if no changes are necessary to so notify the City Council by October 1, 2012.
