BACKGROUND On June 5, 2013, the Design Review Board held a public hearing on a proposed bell tower that concealed six wireless telecommunication antennas. Upon further review the Board continued the case to the next meeting to study possible design options. At the meeting, the Board provided the following comments to the applicant for consideration: - What other locations and sites were considered; - Design of the equipment cabinet and the bell tower is not compatible with surrounding properties; - Can the facility collocate with the existing on-site AT&T spire; - Can the equipment room locate elsewhere on the site, preferably on the ground floor; - Will the noise level from the generators impact the surrounding properties; - Is this facility taller than it needs to be; - Can the equipment room be setback from the edge of the building; The Board directed the applicant to: 1. Have an architect present at the next DRB meeting, and 2. provide a detailed site plan showing surrounding neighbors, 3. provide first floor plan to determine viability of options; and 4. integrate the equipment cabinet with the building. ---PAGE BREAK--- H:\PLANNING\Applications\2013\PL13-0012 - 6830 Stockton ST. DR\Staff Report PL13-0012 July 3 final.docx Page 2 of 6 City records show that a use permit (Use Permit No. 1004) was approved by the Planning Commission for a church on this location in 1956. Records also show that in 2004 AT&T applied for and received a conditional use permit (PL No. 6052) to install a telecommunications facility on top of the roof of the main sanctuary building. The approval was for a cupola that concealed six antennas and to increase the height to 52’ total. Subsequently, the Design Review Board approved the design review for the cupola. III. DISCUSSION Project Description: At the last DRB meeting, the applicant proposed the construction of a bell tower to conceal six antennas and related equipment cabinets on an existing building. In response to the comments from the Board at the June 5th meeting, the applicant has submitted other design options to conceal the antennas. The applicant has submitted the following alternatives: 1. Second identical cupola, 2. Redesign the roof to house the antennas, 3. Bell tower 4. Collocation on existing cupola. Analysis: Alternative 1 - Second Identical Cupola Alternative 1 is the installation of a second identical cupola to the AT&T facility. It will be located at the opposite end of the main sanctuary roof away from Stockton Avenue. The cupola will conceal six antennas and will be identical to AT&T’s facility. This was the original design of the facility as submitted to the city. Staff was concerned that given the size of the building and site, that one defining architectural element was adequate, but two might not be acceptable and could detract from the architectural character of the building. Staff directed the applicant to submit other options that would achieve their goals. Their response is shown in this report as Alternative 3, the Bell Tower. It was discussed at the last DRB meeting and found to be unsatisfactory for the reasons listed at the meeting and noted in this staff report. Alternative 1 does address many of the concerns the Board noted at the prior meeting. It adds much less mass and bulk to the overall structure, meeting the concern of the project looming over the nearby residences. It is however, closer to the rear property line than other options proposed. Alternative 2 - Secondary Roof Projection Alternative 2 is the construction of a second roof structure that is different than the existing cupola. It is designed to appear as a second cupola, consistent with the secondary building on the site. It is shown as a square appendage on the roof with the same pyramid shaped roof as the lower tower on the main building. Staff believes that although the proposal uses the same building material and architectural syle it is not in keeping with the architectural character of the buildings on the site. The added structure above the roof increases the mass and bulk to an otherwise standard gabled roof. It gives an appearance of a “top heavy” building and detracts from the symmetry of the roof. ---PAGE BREAK--- H:\PLANNING\Applications\2013\PL13-0012 - 6830 Stockton ST. DR\Staff Report PL13-0012 July 3 final.docx Page 3 of 6 Alternative 3 – Bell Tower This is the alternative that was presented to the Board at the last meeting. The Board believed that this alternative was too dramatic an impact to surrounding properties and to the site itself. In addition, members of the Board found that the structure was too large and out of scale with the buildings on the site Finally, members of the Board felt that with its mass and bulk, the tower seemed too close to surrounding neighbors to the south. Staff concurs with the comments made by members of the Board regarding this alternative, but kept it on the list as a possibility for the Board to choose, after considering all other options. Alternative 4 – Collocation Alternative 4 reflects the Board’s suggestion to explore collocation on the AT&T cupola. Such an endeavor will require the construction of a larger cupola. This alternative will require an addition of 20’ in height and 20’ in width and depth. Staff believes that this alternative would be out of scale within the context of the building and the size of the roof. While further away from the residential neighbors, the massing is basically the same as Alternative 3, making it appear out of scale and bulky. This alternative would also require that the original conditional use permit for the facility to be modified to reflect the larger and taller facility. This would result in continuing the application and requiring the applicant to submit a Conditional Use application that would need to agendized before the Planning Commission. The process would add a minimum of three additional months to the project timeline. Of all the options presented, staff believes that Alternative 1 is the most consistent with the comments made by the Board and offers the least affects to the neighborhood and surrounding properties. Of the options presented, this alternative has the least amount of bulk. Although it would be located towards the rear of the main building and therefore closer to the residences than some other options, the amount of additional shading is minimal. With regards to the equipment cabinet, the applicant has confirmed with the staff engineer that the roof mounted equipment room can be shifted 3.8’ to the north, thereby creating a nominal second floor setback. The applicant stated that the entire site has been analyzed for an alternative location for the equipment cabinet. No other location is feasible due to existing uses on the ground floor. Consistency with the General Plan The project is consistent with the following General Plan policies: LU3.1 Commercial/Residential Interaction, LU4.2 Availability of Goods and Services, LU4.5 Quality of Development, CD1.3 High Quality Design, CD1.9 Building Design, CD4.1Compatible in Building Scale, CD4.2 Building Articulation and CD5.1 Design Review Process. Environmental Review Pursuant to the California Environmental Quality Act, Section 15301 Class 1 – Existing Facilities, the project is exempt. Findings The proposed development meets the Design Review criteria noted in Section 19.36.160 of the Zoning Ordinance. Findings for approval under Section 19.38.060 are listed below. The applicable standards and requirements of this Zoning Ordinance; As conditioned, the project complies with all of the relevant standards of the El Cerrito Zoning Ordinance. 2. The design policies of the General Plan and specific plans adopted by City Council; Pursuant to the City of El Cerrito General Plan, the following policies are pertinent to the proposed project: LU3.1 Commercial/Residential Interaction, LU4.2 Availability of Goods and Services, LU4.5 Quality of Development, CD1.3 High Quality Design, CD1.9 Building Design, CD4.1Compatible in Building Scale, CD4.2 Building Articulation and CD5.1 Design Review Process. 3. Any applicable design guidelines adopted by the City Council; There are no applicable, adopted design guidelines. 4. The design review criteria set forth in the following subsection; a. The aesthetic design, including is appropriate to the function of the project and will provide an attractive and comfortable environment for occupants, visitors, and the general community. The design of the project is consistent with aesthetic of a religious institution. The proposed identical second spire, while out of the ordinary, is consistent with the architecture of the existing building. b. Project details, colors, materials, and landscaping, are fully integrated with one another, and used in a manner that is visually consistent with the proposed architectural design. The project features a unified color scheme and materials palette. The applicant proposes to to use the same materials and color as the existing structures on the site.. c. The project has been designed with consideration of neighboring development. The project size and height is in keeping with structures that are consistent with religious institutions. In addition, the adjacent residential neighbor has an exceptionally wider side yard (14’) than the neighborhood standard of so minimal shading impact is created. d. The project contributes to the creation of an attractive and visually interesting built environment that includes well-articulated structures that present varied building facades, rooflines, and building heights and encourages increased pedestrian activity and transit use. Street frontages are attractive and interesting for pedestrians, address the street and provide for greater safety by allowing for surveillance of the street by people inside buildings and elsewhere. The existing façade on the first floor would not change as the result of the proposal. The street frontage will remain attractive and interesting, in that, the project is located to the rear of the site and will not obstruct or interfere with the existing street front facade. f. The proposed design is compatible with the historical or visual character of any area recognized by the City as having such character. The project is not in an area recognized as having historical or visual character. Also, the addition is compatible in terms of materials, color with the existing structures on the site. g. The aesthetic design preserves significant public views and vistas from public streets and open spaces and enhances them by providing areas for pedestrian activity. The proposed project will add a minor architectural feature that will increase building height in a limited way, however, it will have no impact to public views and vistas from the street. The project adds no impact to public views of open spaces or pedestrian activity. h. The proposed landscaping plan is suitable for the type of project and will improve the appearance of the community by enhancing the building, minimizing hardscape and softening walls; and the landscape plan incorporates plant materials that are drought- tolerant, will minimize water usage, and are compatible with El Cerrito’s climate. No new landscaping will be installed as part of this project. i. The project has been designed to be energy efficient including, but not limited to, landscape design and green or eco-friendly design and materials. The project will be consistent with Title 24 of the California Building Code. This is the section of the building code that ensures a adequate level of energy efficiency, eco friendly design. No landscape materials are included in this project. j. The project design protects and integrates natural features including creeks, open space, significant vegetation, and geologic features. Projects along the Ohlone Greenway shall enhance the usability and aesthetic appeal of the Greenway by integrating it into the fabric of the City through building designs that include entries, yards, patios, and windows that open onto and face the Ohlone Greenway. As this project is being added to the roof, there is no potential to impact open space or vegetation on site. Further, this project is not along the Ohlone Greenway. 5. Any planning or zoning approvals by the Planning Commission or Zoning Administrator; The project does not require approval by the Planning Commission or the Zoning Administrator. 6. The Board may: 1) Provide comment and require the applicant to respond with additional information or options. 2) Approve Alternative 1 that adds a second identical cupola to the southern edge of the roof 3) Deny the application Proposed Motion: Move adoption of Design Review Board Resolution 13-02 granting Design Review approval for constructing an identical cupola along the southerly roof to conceal six telecommunications antennas. In addition, the application shall include any environmental documentation required to obtain such license or approval together with such engineering calculations demonstrating that the proposed wireless communication facility will comply with all applicable FCC requirements and standards. 9. Throughout the project’s operation, wireless facilities and any related equipment, including backup generators and air conditioning units, shall not generate continuous noise in excess of 40 decibels (dBa) measured at the property line of any adjacent residential property, and shall not generate continuous noise in excess of 50 dBa during the hours of 7:00 a.m. to 10:00 p.m. and 40 dBa during the hours of 10:00 p.m. to 7:00 a.m. measured at the property line of any non-residential adjacent property. BACKGROUND On January 10, 2013 New Cingular Wireless PCS, LLC, doing business as AT&T Mobility submitted six applications for wireless telecommunications facilities at the locations of existing utility poles in the southern portion of El Cerrito. On May 23, 2013, the applicant withdrew one application near 859 Gelston Place. The remaining five applications are proposed as part of a distributed antenna system (DAS) that will cover a large portion of the East Bay hills. The applicant is currently processing applications in Oakland, Berkeley, and Kensington for other portions of the network. The Design Review Board conducted Conceptual Review of the project at their May 1 meeting. The DRB comments generally centered around the aesthetics of the existing poles and whether the Board could require the applicant to replace the poles with a certain type of pole (e.g. concrete). More information on this issue is presented in the Discussion Section of this report. The Planning Commission approved conditional use permits to allow all five wireless telecommunications facilities at their June 19, 2013 meeting. The Planning Commission’s approval of the facility near 851 Seaview Drive was appealed to the City Council and the appeal will be heard on August 20. Pending the resolution of the appeal, the facility near 851 Seaview may return to the Design Review Board for consideration. Pursuant to the Federal Telecommunications Act of 1996, local jurisdictions are not permitted to consider the health effects of wireless telecommunications facilities in their decisions. Pursuant to Federal law, the facilities will be required to meet the operational standards set by the Federal Communications Commission (FCC). III. DISCUSSION The proposed DAS nodes would be located on top of the existing utility poles. For two of the proposed sites, a 7-foot extension would be added to the top of the pole. For two sites, the existing pole would be replaced with a new pole that would be approximately 7 feet taller. The proposed antennas are approximately 2 feet tall would be mounted at the top of the extension or the new pole. The top of the antennas would sit approximately 3 feet above the top of the pole extension, extending the top of the utility pole structure by a total of 10 feet. All equipment for each facility would be mounted on the pole. No equipment would be ground mounted. The applicant has verbally assured staff that their intent is to paint the proposed antennas and equipment brown to match the color of the utility poles. Staff is proposing a condition of approval to ensures that this will happen. Site PL13-0006 near 851 Seaview Drive. The site nearest to El Cerrito is near 1215 Santa Fe Avenue in Berkeley at the intersection Key Route Boulevard, on the border with Albany. This site is visible from BART trains. Other nearby sites include Cedar Street at Juanita Way, near Cedar Rose Park and Dwight Way at California Street. Photos of two of these sites are included below. These sites are different from the proposed AT&T nodes in that the T- Mobile sites use omnidirectional antennas which are cylindrical in shape. The coverage that AT&T is attempting to provide with the proposed nodes has informed the applicant’s decision to propose two directional antennas per node. Coverage in all directions is not required and the applicant wished to limit the loss of signal toward the bay and other areas where coverage is not needed. The existing examples of DAS nodes mentioned above are good examples of the scale of the proposed facilities. The pole extensions that these nodes are Site PL13-0010 near 202 Seaview Drive mounted on are approximately the same height as the extensions that AT&T is proposing. The T- Mobile antennas appear to be taller than the proposed AT&T antennas. Other examples of proposed DAS nodes are presented by recent AT&T applications for DAS nodes in Kensington (unincorporated Contra Costa County). The antenna projects off the side of the pole below the existing PG&E lines. The California Public Utilities Commission (CPUC) requires a minimum separation of 6 feet between the proposed DAS antennas and the existing PG&E lines. As a result, on one of these two sites, the pole would be raised by approximately 2 feet to provide the clearance required for the proposed DAS antennas. On May 1 when the DRB conducted Conceptual Review of the proposed facilities, Boardmembers asked staff if the Board could require that the proposed poles be constructed of a certain material (i.e. concrete). The applicant has submitted a letter that states that PG&E (the owner of the poles) no longer installs concrete poles due to safety and maintenance concerns. This letter is attached to this staff report. The facility and all associated equipment will be painted to match the existing pole. c. The project has been designed with consideration of neighboring development. The proposed project minimizes the size of the antennas required to provide wireless service to El Cerrito and minimizes the need for larger facilities with larger antennas. d. The project contributes to the creation of an attractive and visually interesting built environment that includes well-articulated structures that present varied building facades, rooflines, and building heights and encourages increased pedestrian activity and transit use. The project will increase the height of the existing utility pole with an extension in line with the existing pole. As such, the project will neither enhance nor detract from the existing articulation of the utility pole. e. Street frontages are attractive and interesting for pedestrians, address the street and provide for greater safety by allowing for surveillance of the street by people inside buildings and elsewhere. The project will increase the height of the existing utility pole at the top of the pole. Since the height increase will be at the top of the pole, it will not impact pedestrians or the interface with the street. The project will to affect the surveillance of the street. f. The proposed design is compatible with the historical or visual character of any area recognized by the City as having such character. The project is not in an area recognized as having historical or visual character. g. The aesthetic design preserves significant public views and vistas from public streets and open spaces and enhances them by providing areas for pedestrian activity. The project has been sited to minimize view blockage. Since the facility will be located at the top of the pole, far above street level, it will not impact public vistas from the street on which it is located. h. The proposed project will consume the amount of energy required to operate the site in compliance with FCC standards. j. The project design protects and integrates natural features including creeks, open space, significant vegetation, and geologic features. Projects along the Ohlone Greenway shall enhance the usability and aesthetic appeal of the Greenway by integrating it into the fabric of the City through building designs that include entries, yards, patios, and windows that open onto and face the Ohlone Greenway. The project is not adjacent to natural features or the Ohlone Greenway. 5. WHEREAS, the subject site is located in the public right-of-way near 7800 Eureka Avenue; WHEREAS, the zoning district of the site is RS-5 (Single Family Residential); WHEREAS, the general plan land use designation of the site is Low Density Residential; WHEREAS, on January 10, 2013, the applicant submitted an application for a conditional use permit; and WHEREAS, this project is Categorically Exempt from the provisions of CEQA – Section 15301 Class 1 – Existing Facilities; WHEREAS, on June 19, 2013, the El Cerrito Planning Commission approved a conditional use permit to allow a wireless telecommunication facility on an existing utility pole near 7800 Eureka Avenue; and WHEREAS, on August 7, 2013, the Design Review Board of El Cerrito, after due consideration of all evidence and reports offered for review, does find and determine the following: 1. The proposed project meets all standards of the El Cerrito Zoning Ordinance including the standards of Chapter 19.28: Wireless Telecommunications Facilities. 2. The proposed project will implement the following policies of the El Cerrito General Plan: LU2.2, LU4.1, LU4.2, CD1.7, and CD5.1. 3. There are no applicable, adopted design guidelines. 4. The design is appropriate for a wireless telecommunications facility. The project will increase the height of the existing utility pole. However, the extension and the proposed facility will be consistent with the existing aesthetics of the pole. 5. The facility and all associated equipment will be painted to match the existing pole. 6. The proposed project minimizes the size of the antennas required to provide wireless service to El Cerrito and minimizes the need for larger facilities with larger antennas. 7. The project will increase the height of the existing utility pole with an extension in line with the existing pole. The project will increase the height of the existing utility pole at the top of the pole. Since the height increase will be at the top of the pole, it will not impact pedestrians or the interface with the street. The project will to affect the surveillance of the street. 9. The project is not in an area recognized as having historical or visual character. 10. The project has been sited to minimize view blockage. Since the facility will be located at the top of the pole, far above street level, it will not impact public vistas from the street on which it is located. 11. No new landscaping is proposed as part of this project. 12. The proposed project will consume the amount of energy required to operate the site in compliance with FCC standards. 13. The project is not adjacent to natural features or the Ohlone Greenway. 14. The proposed facilities are consistent with the Planning Commission’s conditional use permit approval in Resolution PC13-12. 15. The project is in compliance with the zoning requirements and the goals and policies outlined in the General Plan. NOW, THEREFORE, BE IT RESOLVED, that after careful consideration of maps, facts, exhibits, correspondence, and testimony, and other evidence submitted in this matter, and, in consideration of the findings, the El Cerrito Planning Commission hereby approves Application No. PL13-0007, subject to the following conditions: Planning Division: 1. The project shall be developed and maintained substantially in compliance with the plans dated January 10, 2013 except as amended by subsequent conditions of this Resolution.
