These lands are chosen for preservation based on the unique and valuable ecological assets situated within their boundaries. Bullock, seconded by Councilwoman C. Lester, and adopted: WHEREAS, the Town held a public hearing pursuant to the provisions of General Municipal Law Section 247 to consider the purchase of property in the Stony Hill area consisting of approximately 3.7 acres, described as SCTM #0300-125.00-02.00-001.003, said premises being owned by David and Mary Whelan; and WHEREAS, the premises are being offered to the Town for the sum of $172,725.00 together with payment of the costs incurred by the Seller for market and site analysis performed by their consultant, Land Marks Land Use and Conservation Planning, in the sum of $5,775.00; and WHEREAS, acquisition of said premises is being considered for purposes of furthering the Town's program of Open Space Preservation; and WHEREAS, the Town Board believes the proposed parcel is a suitable parcel for acquisition under said program and will further the Town's Open Space Preservation Program; now, therefore, be it RESOLVED, that the Supervisor is hereby authorized to execute a contract to purchase SCTM #0300-125.00-02.00-001.003 from David and Mary Whelan for the sum of $172,725.00, together with payment to Seller's land Use consultant, Land Marks Land Use and Conservation Planning, in the amount of $5,775.00; and be it further RESOLVED, that the Supervisor is further authorized to make payment for all necessary and reasonable costs associated with the acquisition including reasonable title, survey and recording expenses as may be required; and be it further RESOLVED, that the Supervisor is further authorized to make payment for all necessary and reasonable costs associated with the acquisition including reasonable title, survey and recording expenses as may be required; and be it further RESOLVED, that the Town Clerk shall forward a copy of this resolution to: Landmarks Land Use and Conser.Planning P.O.
