SPRING VALLEY COMMUNITY INFRASTRUCTURE DISTRICT NO. 1 (CITY OF EAGLE, IDAHO) REQUEST FOR QUALIFICATIONS FOR DISTRICT ENGINEER SERVICES ---PAGE BREAK--- 2 of 6 k:\city\cid spring valley community infrastructure dist no. engineer\rfq dist engineer 5-2021\rfq - engineer 5-2021.doc GENERAL INFORMATION PURPOSE The Spring Valley Community Infrastructure District No. 1 (City of Eagle, Idaho) (“CID”) is seeking qualified and experienced respondents (“individuals” or “firms”) to submit Statements of Qualifications (“SOQs”) to serve as the DISTRICT ENGINEER for the Spring Valley Community Infrastructure District located generally at the Highway 16 and Equest Lane, Eagle, Idaho (the “Project”). The roles and responsibilities of the DISTRICT ENGINEER area outlined in the Amended and Restated District Development Agreement No.1 for the Spring Valley Community Infrastructure District No.1 (City of Eagle, Idaho). The Development Agreement is attached here to as Exhibit A. This solicitation is governed by Idaho Code § 67-2805 and §67-2320 and shall be administered by those provisions. PROPOSAL TIMELINE The CID anticipates completing the selection process within 45-Days of the close of the RFQ. Contract negotiations with the number one selected individual or firm would commence immediately after the Board makes an appointment. In the event CID and the number one individual or firm could not agree on contract terms, CID would terminate such negotiations and initiate negotiations with the second selected individual or firm and continue in such manner until a successful contract is concluded and approved by the CID Board. The CID may enter into an agreement with one or more DISTRICT ENGINEERS at its sole discretion. GENERAL TERMS This Request for Qualifications (RFQ) does not commit CID to enter into any contract, to pay any costs incurred in the preparation of a proposal or in subsequent negotiations, or to procure or to contract for any project. REVISIONS TO RFQ In the event that it is necessary to revise any part of the RFQ, all changes will be posted on the City’s website at . RESERVATION OF RIGHTS BY CID The issuance of this RFQ does not constitute an assurance by CID that any contract will actually be entered into by CID. CID expressly reserves the right to: Waive any immaterial defect or informality in any response or response procedure. Reject any and all Submittal of Qualifications (“SOQs”). Withdraw and/or reissue the Request for Qualifications. Invite additional respondents to submit SOQs. Request additional information and data from any or all respondents. ---PAGE BREAK--- Extend the date for submission of responses. Supplement, amend, or otherwise modify the RFQ or cancel this request with or without the substitution of another RFQ. Disqualify any respondent who fails to provide information or data requested herein or who provides inaccurate or misleading information or data. Disqualify any respondent on the basis of any real or apparent conflict of interest. Disqualify any respondent on the basis of past performance on public works projects or contracts with public entities. By responding to this RFQ, each respondent agrees that any finding by CID of any fact in dispute as to this RFQ or the responses thereto shall be final and conclusive except as provided herein. CID may, at its own discretion, accept such submissions as it deems to be in the best public interest and in furtherance of the purposes of the Community Infrastructure District Law, or it may proceed with further selection processes, or it may reject any and all submissions. CID also reserves the right to waive any informality. EVALUATION The CID Board shall evaluate and determine the individual and comparative merits of each of the SOQs received. It is the responsibility of the respondent to ensure that the SOQ complies with this RFQ, demonstrates qualifications, and provides the information requested. If a respondent fails to provide any information requested in this RFQ, such failure may result in rejection of the proposal. The CID Board anticipates completing the selection process within 45- Days of the close of the RFQ. ENGINEERING REGISTRATION All respondents must be registered in Idaho as Engineer as provided in the Idaho Code. PROPRIETARY MATERIAL CID assumes no liability for disclosure of proprietary material submitted by respondents. All SOQ submittals shall be considered public documents under applicable state law except to the extent portions of the submittals are otherwise protected under applicable law. Responders should segregate any asserted proprietary information and provide an explanation as to why such information shall not be deemed a public record, citing the applicable exception under the Idaho Public Records Act. INSTRUCTIONS SUBMITTAL REQUIREMENTS SOQs must conform to the requirements of this document. All SOQ’s shall be submitted electronically by May 24, 2021, at 5:00 p.m. Mountain Standard Time to [EMAIL REDACTED], no paper or faxed applications will be accepted. FORMAT FOR SUBMITTAL The SOQ shall be submitted in the format as outlined. Content and completeness are most important. Clear and effective presentations are preferred. Elaborate, decorative, or extraneous materials are strongly discouraged. Any SOQ not following the correct format will be rejected. The SOQ shall be for the individual or firm’s expertise only. Inclusion of sub-consultant services is unacceptable. A fully executed cover page shall be the first page of the submittal. The cover page format is included with this SOQ. The maximum length of the body of the submittal shall be six pages. The submittal shall be formatted for an 8 ½ x 11-inch paper. Type style shall be no more than six lines per vertical inch and not smaller than twelve (12) point font. Certifications and releases shall be appended as noted below. INTRODUCTORY LETTER AND FORM OF AGREEMENT The introductory letter should be addressed to the Spring Valley CID Board at the above addresses. It should introduce the consultant’s firm, state the general nature of the firm’s qualifications, and list a contact name and phone number. ENGINEERING CAPABILITIES Provide a brief history of the company, its history, organization, number and type of personnel, and the location of the company’s office. List several projects performed within the past five years pertaining to DISTRICT ENGINEER services; if any; most notably for local improvement district engineering reports and creation of required assessment roles; overseeing public works projects; administering and working with public finance professionals for public works projects; and processing land use applications under Idaho law. List all claims, lawsuits, and arbitrations made against the applicant by a client for professional malpractice, complaints to the Idaho Board of Engineering, breach of contract, design defect and billing disputes in the last ten (10) years and describe the venue of each claim, their outcomes or whether they are still pending. List three verifiable professional services references with a contact person and phone number. List all personnel available to perform DISTRICT ENGINEER services. If the engineer does not have an office in Ada County, then specifically address how the resources available will be provided to CID for the project. Identify key personnel and the following information for each: Idaho professional registration (if applicable); Experience in the past three years; ---PAGE BREAK--- Brief description of qualifications as specifically pertains to the service category; and Three reliable references. The proposal will be evaluated to assess the applicant’s understanding of local improvement district and/or community infrastructure projects, public works and land use law in Idaho, and the issues that need to be addressed in the administration of the DISTRICT ENGINEER role of the CID, as enumerated in the Development Agreement, EXHIBIT A, available on the City’s website at CERTIFICATIONS AND RELEASES Attach the following documents: Proof of Registration/Licensing pursuant to the Idaho Code.
