ACCESSORY BUILDING SETBACK WAIVER SUBMITTAL CHECKLIST AND ADDITIONAL INFORMATION The following checklist needs to be completed and all items shown must accompany the completed application. ALL DOCUMENTS SUBMITTED MUST BE SINGLE SIDED WITH NO STAPLES. ☐ ☐ Date of pre-application Note: Pre-applications are valid for a period of three months. A submittal meeting is required prior to the cut-off date and receipt of this application. ☐ ☐ A complete Master Land Use Application. Application must be single sided, double sided application will not be accepted. ☐ ☐ A written statement of justification addressing the nature of and reason for the building setback waiver. Include in the justification letter information demonstrating that the requested building location conforms to the following standards: ☐ Is compatible with the scale and design of the structures and overall existing development pattern of the surrounding area; ☐ Will not impair reasonable or appropriate use of adjoining properties; ☐ Will not result in greater impacts on natural resources; and ☐ Will not impair sight distances on public or private roads; ☐ ☐ A drawing or picture superimposed or “photoshopped” into a picture of the lot showing the proposed building located upon the lot. ☐ ☐ Copy of Deed; and, if the applicant is not the owner, an original notarized statement (affidavit of legal interest) from the owner stating the applicant is authorized to submit this application. ☐ ☐ Any additional information to aid in understanding the project. ☐ ☐ Payment of application fees. Please submit the Planning and Zoning Application Fee Calculation Request Form a minimum of two working days prior to application submittal to confirm required application fees. ☐ ☐ Applicant shall provide written approval of the setback reduction from all adjoining property owners at the time of application submittal. If written approval cannot be obtained, then the City shall notify the adjoining property owners and inform them in writing about the applicant’s setback reduction. The adjoining property owners shall have ten (10) calendar days from the decision date to appeal. If no appeal is submitted, the decision is final.
