Page 1 of 3 Accessory Building Setback Waiver Checklist Updated 12/30/2025 ACCESSORY STRUCTURE SETBACK WAIVER SUBMITTAL CHECKLIST The following checklist AND information need to be completed. All items listed on the checklist must accompany the completed application. REQUIRED SUBMITTAL DOCUMENTS – DIGITAL ONLY: All plans and documents must be submitted as original, high-resolution digital versions (not copies, where applicable). For file naming and formatting instructions, please refer to the digital submittal standards located on the city’s website. ☐ ☐ A written statement outlining the applicant’s justification for this waiver, including any information that demonstrates that the proposed accessory structure and location conforms to the following standards: ☐ The proposed accessory structure is compatible with the scale and design of the existing structures on the property and with the overall existing development pattern of the surrounding area; ☐ The proposed accessory structure will not impair reasonable or appropriate use of adjoining properties; ☐ The proposed accessory structure will not result in greater impacts on natural resources; and ☐ The proposed accessory structure will not impair sight distances on public or private roads; ☐ ☐ Written approval of the proposed setback reduction from all adjoining property owners at the time of application submittal. Note: If written approval cannot be obtained, the City will notify the adjoining property owners and inform them in writing about the applicant’s setback reduction. The adjoining property owners shall have ten (10) calendar days from the approval date to appeal the decision. ☐ ☐ A site plan, drawn to scale, showing the proposed accessory structure in relation to any existing building(s) on the property and the distances between each structure and the property lines. The site plan shall also include the dimensions of each individual structure, including the proposed accessory structure. ☐ ☐ Copy of Deed. ☐ ☐ If the signatory on this application is not the owner of the property, an original notarized statement (affidavit of legal interest) from the owner stating the applicant is authorized to submit this application is required. Applicant Use Staff Use ---PAGE BREAK--- Page 2 of 3 Accessory Building Setback Waiver Checklist Updated 12/30/2025 EAGLE CITY CODE SECTIONS (FOR REFERENCE): Eagle City Code Section 8-1-2: ACCESORY USE OR STRUCTURE: A use or structure on the same lot with, and of a nature customarily incidental and subordinate to, the principal use or structure. In residential zones accessory uses/structures include, but are not limited to, accessory dwelling units, detached carports and garages, pool houses and cabanas, amateur radio and satellite dish antennas, barns, corrals, stables, and similar uses and structures. In nonresidential zones accessory uses/structures include, but are not limited to, detached carports and garages, caretaker's quarters, guardhouses, storage sheds, outdoor storage structures, microwave and satellite dish antennas, and similar uses and structures. Eagle City Code Section 8-2-4(A)(5): Upon the submittal of the waiver application and findings adopted by the Zoning Administrator addressing compliance with the following criteria, accessory structures may be permitted to be located within a minimum of 15 feet (15’) of the rear property line: a. Be compatible with the scale and design of the structures and overall existing development pattern of the surrounding area; b. Not impair reasonable or appropriate use of adjoining properties; c. Not result in greater impacts on natural resources; d. Not impair sight distances on public or private roads; and e. If authorized, the waiver may only be granted for the minimum amount necessary to achieve the stated purpose of the waiver sought. f. The applicant shall provide written approval of the setback reduction from all adjoining property owners at the time of application submittal. If written approval cannot be obtained, then the city shall notify the adjoining property owners and inform them in writing about the applicant's setback reduction. The adjoining property owners shall have 10 calendar days from the decision date to appeal. In the event of a denial, the applicant shall be allowed to appeal the zoning administrator's decision. Failure to provide requested information in a timely manner may result in an application processing delay. ☐ I understand that the applicant and/or representative must attend all public meetings regarding this application and that failure to attend will likely result in a postponement of your application being heard and acted upon. ☐ I understand that my application will not be deemed complete by the City until all required application materials have been accepted (including any hardcopy documents) and the necessary fees have been paid. ☐ I understand that, in the event of a denial, the applicant shall be allowed to appeal the Zoning Administrator’s decision. If no appeal is submitted within ten (10) calendar days, the decision is final. ☐ I acknowledge that this application does not constitute final approval, and that additional permits, reviews, or requirements may apply. I further acknowledge that it is my responsibility to coordinate with all applicable agencies and departments – including, but not limited to, the City of Eagle Building Department, Clerk/Treasurer’s Office, Eagle Fire District, Ada County Highway District (ACHD), and any other relevant local, state, or federal agencies – to identify and satisfy all requirements associated with my proposal.
