Page 1 of 3 Variance Title 9 Checklist Updated 12/30/2025 VARIANCE (TITLE 9) SUBMITTAL CHECKLIST The following checklist AND information need to be completed. All items listed on the checklist must accompany the completed application. REQUIRED SUBMITTAL DOCUMENTS - HARDCOPY ONLY: ☐ ☐ Two printed sets of adhesive labels containing the names and addresses of all adjoining property owners and purchasers of record who own property located within the required noticing radius of the exterior boundary of the application property, as required by Eagle City Code 8-7-8. REQUIRED SUBMITTAL DOCUMENTS – DIGITAL ONLY: All plans and documents must be submitted as original, high-resolution digital versions (not copies, where applicable). For file naming and formatting instructions, please refer to the digital submittal standards located on the city’s website. ☐ ☐ Verification of a neighborhood meeting being held prior to the submittal of this application. Note: The verification shall include the time, date, and location of the meeting, a copy of the letter mailed by the applicant, any exhibits presented at the meeting, a copy of the mailing list, and the sign-up sheet from the meeting. Refer to Eagle City Code Section 8-7-8(B)(1) for noticing requirements and neighborhood meeting requirements. ☐ ☐ An Excel file (.XLS) providing the names and mailing addresses of all adjoining property owners and purchasers of record who own property located within the noticing radius of the exterior boundary of the application property, pursuant to Table 1 below and Eagle City Code 8-7-8. Table 1 – Neighborhood Meeting Noticing Requirements (Eagle City Code Section 8-7-8 Application property size and density: The notice distance shall be: All properties (all zones) under 500-acres in size 500 feet Properties 500-acres in size or larger and 250 dwelling units or fewer ½ mile Properties 500-acres in size or larger and 251 dwelling units or more 2 miles Applicant Use Staff Use ---PAGE BREAK--- Page 2 of 3 Variance Title 9 Checklist Updated 12/30/2025 ☐ ☐ Legal description of property. ☐ ☐ Copy of Deed. ☐ ☐ If the signatory on this application is not the owner of the property, an original notarized statement (affidavit of legal interest) from the owner stating the applicant is authorized to submit this application is required. ☐ ☐ A vicinity map showing the location of the property in relation to the nearest major cross streets. ☐ ☐ Canal company license agreements (if applicable). ☐ ☐ Exclusive use easements agreements of any kind that might impact pathways and/or open space (if applicable). ☐ ☐ A written statement describing the existing use and existing zone classification. ☐ ☐ A written statement of justification addressing the nature of and reason for the variance. Include in the justification letter information demonstrating that the requested variance conforms to the following standards: ☐ That there are such special circumstances or conditions affecting the property that the strict application of the provisions of this Title would clearly be impracticable or unreasonable. ☐ The strict compliance with the requirements of this Title would result in extraordinary hardship to the subdivider because of the unusual topography, other physical conditions or other such conditions which are not self-inflicted, or that these condition would result in inhibiting the achievement of the objectives of this Title ☐ That the granting of the specified variance will not be detrimental to the public welfare or injurious to other property in the area in which the property is situated. ☐ That such variance will not violate the provisions of the Idaho Code. ☐ That such variance will not have the effect of nullifying the interest and purpose of this Title and the Comprehensive plan. ---PAGE BREAK--- Page 3 of 3 Variance Title 9 Checklist Updated 12/30/2025 ACKNOWLEDGEMENT OF PROCEDURES AND SUBMITTAL REQUIREMENTS: ☐ I acknowledge that all information provided within the checklist and application(s) are, to the best of my abilities and knowledge, correct and accurate and that all items on the checklist are complete and included within the submittal package. ☐ I understand that additional information and/or revised plan sets may be required to be submitted, as directed by staff. Failure to provide requested information in a timely manner may result in an application processing delay. ☐ I understand that the applicant and/or representative must attend all public meetings regarding this application and that failure to attend will likely result in a postponement of your application being heard and acted upon. ☐ I understand that public hearing signs must be posted by the applicant/representative prior to the Planning and Zoning Commission hearing and again prior to the City Council hearing in accordance with Eagle City Code Section 8-7-8 ☐ I understand that my application will not be deemed complete by the City until all required application materials have been accepted (including any hardcopy documents) and the necessary fees have been paid. ☐ The applicant shall not construct any required improvements, including storm drainage or roadway facilities until the City has issued a “Notice to proceed with construction”. Upon receipt of the ACHD approved construction drawings and confirmation by the City Engineer that they comply with the City-approved construction drawings, the City will issue the “Notice to Proceed with Construction” to the applicant’s designated representative. ☐ I acknowledge that this application does not constitute final approval, and that additional permits, reviews, or requirements may apply. I further acknowledge that it is my responsibility to coordinate with all applicable agencies and departments – including, but not limited to, the City of Eagle Building Department, Clerk/Treasurer’s Office, Eagle Fire District, Ada County Highway District (ACHD), and any other relevant local, state, or federal agencies – to identify and satisfy all requirements associated with my proposal.
