Shreeve, Sr., Chief Building Official Subject: Pool Anti-Entrapment Device Code References Section 115928(b) California Health and Safety Code 115928.5 – Whenever a building permit is issued for the remodel or modification of an existing swimming pool, toddler pool, or spa, the permit shall require that the suction outlet or suction outlets of the existing swimming pool, toddler pool, or spa be upgraded so as to be equipped with anti-entrapment grates, as specified in the American National Standards Institute (ANSI)/APSP-16. Background What is considered a building permit? The City of Dublin Municipal Code indicates permits for Building, Plumbing, Mechanical, and Electrical are to be issued as per Chapter 7.32 (Building Code), Chapter 7.40 (Plumbing Code), Chapter 7.44 (Mechanical Code), Chapter 7.36 (Electrical Code), and considers each to be an individual type of permit. Interpretations Anti-entrapment devices are required for building permits per the above California Health and Safety Code, however this law does not mention mechanical, plumbing or electrical permits not associated with swimming pool equipment. All permits in relation to swimming pool equipment issued by the City of Dublin are required to comply with the anti-entrapment regulations, Section 115928(b) California Health and Safety Codes. Permits issued for building, mechanical, plumbing, and electrical work not associated with a swimming pool or spa are exempt from this requirement.
