LAND-USE PERMIT APPENDIX N-I LAND-USE PERMIT This permit is entered into by the Douglas County Forestry Department, hereinafter referred to as the “OWNER”, and, - hereinafter referred to as the “PERMITTEE”, for the purpose to enter upon and use the of SECTION TOWNSHIP NORTH, RANGE WEST, TOWNSHIP - DOUGLAS COUNTY, WISCONSIN, for the purpose of at rate of . The location of the subject site is shown on exhibit attached hereto and made a part hereof. This permit shall be in effect for commencing and expiring In order to accomplish this purpose the PERMITTEE intends to place or construct the following items: on the above-described land. Being under the direction of the Douglas County Director of Forestry and Natural Resources in accordance with the following regulations set forth by the Douglas County Forest, Parks, and Recreation Committee, the PERMITTEE agrees to meet the following conditions: 1. The OWNER may terminate this agreement by written notice at any time, if the continued use of this land by the PERMITTEE will interfere with present or future management objectives of the OWNER for the above-described area. 2. This agreement is nontransferable. 3. Prior to the effective date of this agreement, the PERMITTEE shall submit for approval to the OWNER a plan describing the intended placement and construction of any items on the subject lands. No deviations from this plan shall be allowed except with the written approval of the OWNER. 4. For permits requiring payment, payment schedule and dates will be established by the OWNER. 5. No stumps, slash, litter, waste materials or other debris will remain on site after termination of permit and shall be disposed of by the PERMITTEE as directed by the OWNER. 6. No cutting, trimming or damaging vegetation shall be done unless approved by the OWNER. Any timber removed/damaged and/or forested land removed/delayed from future timber production due to operations of permit will be paid for, by the PERMITTEE, at the going rates established by the OWNER. 7. All signs, postings and markers shall approved by the OWNER. 8. The PERMITTEE shall maintain the area under this agreement in a safe condition at all times. 9. The PERMITTEE agrees to protect, indemnify, and save harmless the OWNER, its agents and employees, from and against any and all claims, demands, suits, liability and expense, by reason of loss or damage to any property or bodily injury to any person whatsoever, that may arise from the construction and placement of objects and the described land and from the maintenance or use of the described land. 10. Any and all disputes arising under the terms and conditions of this agreement shall be settled by arbitration in accordance with Chapter 298 of the Wisconsin Statutes. 11. Upon termination of this permit, PERMITTEE shall restore the permit area to a condition as directed by the OWNER. Such restoration shall be completed within 30 days of receipt of such specifications by PERMITTEE. 12. Any violation of these regulations will be deemed a trespass and shall be grounds for the termination of active permits and refusal to grant future permits to persons in violation of such regulations. The penalty fine charged for a trespass shall be left to the discretion of the OWNER. ---PAGE BREAK--- LAND-USE PERMIT APPENDIX N-I 13. The PERMITTEE agrees to follow the Best Management Practices for Water Quality as directed by the OWNER. 14. The PERMITTEE agrees to aesthetically maintain the subject lands at all times throughout the duration of the permit as directed by the OWNER. 15. The PERMITTEE is responsible to acquire any additional necessary licenses and permits to conduct permitted activities and further agrees to conduct no unlawful activities on Douglas County Forest property under the guise of this permit or otherwise. 16.
