Chapter 4.10, Page 17 4.10 PRESENCE OF UNDERAGE PERSONS IN PLACES OF SALE OF INTOXICATING LIQUOR OR FERMENTED MALT BEVERAGES PROHIBITED THE COUNTY BOARD OF SUPERVISORS OF THE COUNTY OF DOUGLAS DOES ORDAIN AS FOLLOWS: SECTION I. PURPOSE/VIOLATION/EXCEPTIONS A. Except as provided by paragraphs and no keeper of any place for the sale of any intoxicating liquor or fermented malt beverage may either directly or indirectly suffer or permit a person under the age of 21 years, unaccompanied by his or her parent, guardian or spouse, of whom one is at least 21 years of age, who is not a resident, employee or a bona fide lodger or boarder on the premises of the licensed person, to enter or be on the licensed premises for any purpose, except as provided by paragraph B. Except as provided by paragraphs and a person who is under 21 years of age not accompanied by his or her parent, guardian or spouse, of whom one is at least 21 years of age, may not enter or remain on the premises of a place which sells intoxicating liquor or fermented malt beverage for other than a valid purpose under paragraph unless the person is a resident, employee, or bona fide lodger or boarder on the premises or is accompanied by his or her parent, guardian or spouse, of whom one is at least 21 years of age. C. This ordinance does not apply to hotels, drugstores, grocery stores, bowling alleys, service stations, cars operated on any railroad, regularly established athletic fields or stadiums, public facilities as defined by Wisconsin Statute 125.51 (5)(b)1.d which are owned by a county or municipality, ski chalets, golf clubhouses, nor to premises under both a "Class B" license and a restaurant permit where the principal business conducted therein is that of a restaurant. It is presumed where the premises are operated under both a "Class B" license and a restaurant permit that the principal business conducted is that of the sale of intoxicating liquor or fermented malt beverage, until the presumption is rebutted by competent evidence. D. A person under 21 years of age may enter premises on which intoxicating liquor or fermented malt beverage is sold if for the purpose of transacting bona fide business other than amusement or the purchase, receiving or consumption of edibles or beverages except a person under 21 years of age who enters "Class B" licensed premises for the purpose of transacting business at an auction or a market as defined by Wisconsin Statute 125.33 may not remain in, or be permitted to enter or remain in, a room in which intoxicating liquor or fermented malt beverage is sold or furnished. ---PAGE BREAK--- Chapter 4.10, Page 18 E. This ordinance does not prohibit a person under the age of 21 from entering or being on the premises of a place for which a "Class A" retail intoxicating liquor license is issued for the purpose of purchasing edibles or beverages other than intoxicating liquor or fermented malt beverages. F. A person at least 18 years of age or older may enter premises on which intoxicating liquor or fermented malt beverage is sold if that person is working under contract with the licensee, permittee or corporate agent to provide entertainment for customers on the premises. SECTION II. PENALTY A. A licensee or permittee who commits a violation of this ordinance is subject to a forfeiture of up to. B. A person under the age of 21 who commits a violation of this ordinance is subject to a forfeiture of up to $500.00 for the first or second violation, or a subsequent violation committed more than 12 months after a previous violation; up to $750.00 for a third violation committed within 12 months of two previous violations; and up to $1,000.00 for a violation committed after three or more previous violations, except that disposition in proceedings against a person under 21 years of age, the date of disposition shall be as provided by '48.344. SECTION III. EFFECTIVE DATE This ordinance shall take effect upon passage and publication. Amendments: August 19, 1999
