4.34 INDIVIDUALS OR GROUPS HARASSING OTHER PERSONS, PROHIBITED THE COUNTY BOARD OF SUPERVISORS OF THE COUNTY OF DOUGLAS DOES ORDAIN AS FOLLOWS: SECTION I. INTENT A person or a person participating with a group of person(s) commits harassment if, with the intent to harass, annoy or alarm another person or persons, he/she: A. Strikes, shoves, kicks or otherwise touches a person or subjects him/her to physical contacts; or B. Engages in a course of conduct or repeatedly commits acts which harass or intimidate the person and which serve no legitimate purpose. SECTION II. UNLAWFUL USE OF TELEPHONE Violation of this ordinance by use of telephone will consist of any of the following: A. With intent to frighten, intimidate, threaten, abuse or harass, makes a telephone call and threatens to inflict injury or physical harm to any person or the property of any person; or B. With intent to frighten, intimidate, threaten or abuse, telephones another and uses any obscene, lewd or profane language or suggests any lewd or lascivious act; or C. Makes a telephone call, whether or not conversation ensues, without disclosing his or her identity and with intent to abuse or threaten any person at the called number; or D. With intent to harass or offend, telephones another and uses any obscene, lewd or profane language or suggests any lewd or lascivious act; or E. Makes or causes the telephone of another repeatedly to ring, with intent to harass any person at the called number; or F. Makes repeated telephone calls, whether or not conversation ensues, with intent solely to harass any person at the called number; or G. Makes a telephone call, whether or not conversation ensues, without disclosing his or her identity and with intent to harass any person at the called number; or H. Knowingly permits any telephone under his or her control to be used for any purpose prohibited by this section. ---PAGE BREAK--- SECTION III. PENALTIES Whoever violates this ordinance is subject to a forfeiture not to exceed more than $500.00. SECTION IV. PUBLICATION This ordinance shall take effect and be in force after its passage and publication as required by law. Dated this 20th day of August, 1998.
