3.0 COMMUNITY MENTAL HEALTH, MENTAL RETARDATION, DEVELOPMENTAL DISABILITIES, ALCOHOLISM AND DRUG ABUSE SERVICES, DOUGLAS COUNTY THE COUNTY BOARD OF SUPERVISORS OF THE COUNTY OF DOUGLAS DOES ORDAIN AS FOLLOWS: SECTION I. ESTABLISHMENT The County Board of Supervisors pursuant to Section 51.437(4)(b), Wisconsin Statutes recreated in Chapter 90 Laws of 1973 does ordain that the community mental health, mental retardation, alcoholism and drug abuse board established under Section 51.42 Wisconsin Statutes is hereby designated as the Developmental Disabilities Board with all the powers and duties specified under Section 51.437, Wisconsin Statutes. SECTION II. NAME The name of such program shall be the Douglas County Comprehensive Health Program. SECTION III. PURPOSES The program hereby created shall develop a comprehensive range of services to identify, develop, provide, or cause to be provided such services as are necessary for the prevention or amelioration of mental disabilities or developmental disabilities, including but not limited to mental illness, mental retardation, alcoholism and drug abuse. It shall facilitate the use of community resources to the fullest extent through unity of management, control and fiscal responsibility. SECTION IV. RESPONSIBILITY OF COUNTY GOVERNMENT A. The County Board of Supervisors have the primary responsibility for the well-being, treatment and care of the mentally ill, developmentally disabled, alcoholic and other drug dependent citizens residing within the county and for ensuring that those individuals in need of such emergency services found within the county receive immediate emergency services. County liability for care and services purchased through or provided by a Board established under this section shall be based upon the client's county of residence except for emergency services for which liability shall be placed with the county in which the individual is found. For the purpose of establishing county liability, "emergency"services means those services provided under the authority of s.51.15(1) Emergency detention (mental health), s.51.45(11)(b) Protective Custody (alcohol), s51.45(12) Emergency Commitment (alcohol or drug), s55.05(4) Emergency Protective Service, s.55.06 (11)(a) Emergency Protective Placement, and ---PAGE BREAK--- s.51.45(11)(a) Voluntary Admission of Intoxicated Persons for 24 hours. Nothing in this paragraph prevents recovery of liability under s.46.10 Liability and Collection based on ability to pay or any other Statute creating liability upon the individual receiving service or any other designated responsible party. B. The County Board of Supervisors shall review and approve the overall plan, program and budgets proposed by the Douglas County Comprehensive Health Plan Board. C. The County shall enter into a detailed contractual financial agreement with the State of Wisconsin after approval by the Secretary of Health and Social Services of a Plan and Budget for provision of services. This contract is necessary to obtain State financial aids. D. The County Board of Supervisors may designate the Douglas County Comprehensive Health Board established under this section as the governing Board of any other county health care program or institution. SECTION V. BOARD OF DIRECTORS There shall be appointed a governing and policy-making Board of Directors composed of nine members. Such Board shall have charge of the operation and administration of the program. A. Members of the Board shall be appointed by the County Board of Supervisors. The County Board Chairman shall appoint the members subject to approval of the County Board of Supervisors. Not more than five shall be members of the County Board of Supervisors. There shall be representation of the interests of the mentally ill, the mentally retarded, the alcoholic and drug abusers, by persons of recognized ability and demonstrated interest in these conditions. B. The term of office of each member of the Board of Directors appointed pursuant to this ordinance, shall be for three (3)years exceptthat in establishing the initial Board of Directors hereunder, one-third (1/3rd) shall be appointed for a term of one year, one-third (1/3rd) for a term of two years, and the remainder for a term of three years. Vacancies for unexpired terms shall be filled in the same manner as original appointments. Any Board member appointed hereunder, may be removed by the appointing authority in accordance with the procedure and authority set forth in the statutes. C. Election of Officers. The Chairman and Vice-Chairman and any other officers deemed necessary shall be elected by the majority membership of the Board of Directors. D. 1. Board members appointed hereunder, shall be compensated for their services and travel expenses at a rate which shall be the same as the per diem and mileage allowance prevailing for the County Board of Supervisors for Douglas County. 2. Board members may be compensated at a fixed rate for each regular or special meeting of the Board. ---PAGE BREAK--- 3. Citizen members of the Board may receive the stipend for meetings even if County Board members do not. E. Subject to the provisions of Section 51.42,Wisconsin Statutes and any amendments thereof, and Wisconsin Administrative Code, the Board of Directors shall have the powers and duties set forth herein and shall: 1. Appoint a Director of the Program on the basis of recognized and demonstrated interest in and knowledge of the problems of mental health, mental retardation, developmental disabilities, alcoholism and drug addiction, with due regard to training, experience, executive and administrative ability, and general qualification and fitness for the performance of the duties of the director. 2. Fix the salaries of personnel employed to administer the program. 3. Plan, develop and evaluate programs and services for all population and disability groups. 4. Establish long and intermediate range plans, goals, priority and estimate costs. 5 Develop coordination of services and continuity of care where indicated. 6. Utilize available community resources and develop new resources necessary to carry out purposes of the Board. 7. Provide mandated services either directly or through contractual arrangements. 8. Enter into contracts to render services to or secure services from other agencies or resources including out-of-state agencies or resources. SECTION VI. PROGRAM DIRECTOR - POWERS AND DUTIES A. All of the administrative and executive powers and duties of managing, operating, maintaining and improving the program shall be vested in the Director, subject to the delegation of authority by the Board of Directors. B. In consultation and agreement with the Board, shall prepare an annual Comprehensive Plan and Budget of all funds necessary for the program. C. Set priorities and objectives for the year. D. Develop intermediate plans and budgets. ---PAGE BREAK--- E. Prepare an annual report of the operation of the program. F. Prepare other reports as required by the State of Wisconsin, and County Board of Supervisors G. The Director shall make recommendations to the Board for: 1. Personnel and salaries of employees. 2. Changes in program services. 3. Evaluation of personnel performance. SECTION VII. OTHER PROGRAM REQUIREMENTS A. Prepare an inventory of existing resources. B. Identify needed new resources and services. C. The clinical treatment program shall be directed by licensed physician trained in who may also be the Director. D. Under supervision of the Director, Disability Coordinators shall be responsible for planning and implementation of program and coordination of services affecting each liability area. 1. Qualified personnel with training and experience or both shall be Coordinator for each disability program. 2. A single Coordinator may be responsible for alcoholism, drug abuse, mental health and developmental disabilities programs. SECTION VIII. FINANCES A. The program shall be financed by such funds as may be available through public and private sources; and the Board is authorized to accept private donations and to request and receive state and federal grants-in-aid in addition to county funds. B. The Board of Directors shall plan it financial operations on calendar year basis; and each year it shall submit its proposed budget for the next calendar year to the County Board of Supervisors prior to October 1, commencing in 1974, and each year thereafter. C. The expenses incurred in the operation of the program shall be paid by the County Clerk and charged by him against the appropriations and other funds credited to the program. Said Clerk shall receive, deposit and credit to the separate account of said program all funds paid over for the said program's operations by any source. ---PAGE BREAK--- SECTION IX REPORTS The Board o Directors shall make an annual report to the County Board of Supervisors, and it shall make or cause to be made such reports as may be required by pertinent statutes. SECTION X. CONTRACT The existence or establishment of a program in combination with any other county or counties shall necessitate the execution of a written contractual agreement binding each county to perform its several and mutual obligations as set forth in this ordinance. SECTION XI. REPEALER Any ordinance or resolution previously enacted and relating to any predecessor agency or program, or which conflicts with this ordinance, is hereby repealed. SECTION XII. EFFECTIVE DATE This ordinance shall take effect upon passage, approval and publication as required by law.
