LATE PAYMENT POLICY FOR TIMBER SALES APPENDIX J-II DOUGLAS COUNTY FORESTRY DEPARTMENT Late Payment Policy for Douglas County Timber Sales DEFINITIONS 1. Payment received is defined as payment being received and receipt dated by the Douglas County Forestry Department office staff no later than 4:30PM CST, on the due date. 2. Payment received in its entirety is defined as the total payment being received including any wood cut amount and any increment installment amount. PAYMENT POLICY All payments are due to be received within 15 calendar days from invoice generation date. If payment is not received in its entirety STEP ONE and the following shall apply regardless of how many days the payment is outstanding: Bids on any Douglas County Timber Auction submitted from a Purchaser that has any late payment or debt to the County still outstanding at the time of the auction will be revoked. Requests to resume, reenter, open, commence or begin another Douglas County Timber Sale from a Purchaser that has any late payment outstanding at the time of the request will be denied. A Purchaser with an outstanding late payment will have all harvesting and hauling operations on all other Douglas County Timber Sales other than the sale with the late payment immediately suspended as directed by the County. LATE PAYMENT STEP ONE 14 additional calendar days from original due date will be allowed for late payment received in its entirety with all late payment occurrences recorded and kept on file. ¾ Five occurrences will be allowed in a 12-month period commencing on the date of first occurrence. On the sixth occurrence within the 12-month period, all bidding privileges will be revoked for the next regularly scheduled Douglas County Timber Auction for which the Purchaser has not previously been suspended and the late payment occurrence record will be zeroed out. If payment is not received in its entirety STEP TWO shall apply. LATE PAYMENT STEP TWO County-wide suspension of all harvesting and hauling operations as directed by the County until payment is received in its entirety. 14 additional calendar days from STEP ONE due date will be allowed for payment received in its entirety. If payment is not received in its entirety STEP THREE shall apply. LATE PAYMENT STEP THREE Debt collection will be turned over to Douglas County Corporation Counsel. 14 additional calendar days from STEP TWO due date will be allowed for payment received in its entirety. If payment is not received in its entirety STEP FOUR shall apply. LATE PAYMENT STEP FOUR Any additional late payment extended due dates will be withdrawn. Total outstanding debt for all money owed under the contract will be determined by the County. Officially terminate and close the contract and apply the performance bond towards the outstanding debt. ---PAGE BREAK--- LATE PAYMENT POLICY FOR TIMBER SALES APPENDIX J-II Continue pursuit of legal action against the Purchaser for collection of all remaining outstanding debt. 1) If payment for the outstanding debt is received in its entirety within 30 additional calendar days from STEP THREE due date, all bidding privileges for one-year from the date payment is received, including the next three consecutive regularly scheduled Douglas County Timber Auctions for which the Purchaser has not previously been suspended will be unconditionally revoked. 2) If payment for the outstanding debt is not received in its entirety within 30 additional calendar days from STEP THREE due date, all bidding privileges for a minimum of two-years from the date that the debt has been paid in full, including at a minimum the next six consecutive regularly scheduled Douglas County Timber Auctions for which the Purchaser has not previously been suspended will be unconditionally revoked.
