ACCESS PERMIT ACROSS DOUGLAS COUNTY LANDS APPENDIX R-I ACCESS PERMIT ACROSS DOUGLAS COUNTY LANDS This permit is entered into by the Douglas County Forestry Department, hereinafter referred to as the “OWNER”, and, - hereinafter referred to as the “PERMITTEE”, for the purpose of obtaining ingress and egress across Douglas County Lands described as follows: The location of the subject access way is shown on exhibit attached hereto and made a part hereof. This permit shall be in effect for commencing and expiring The PERMITTEE shall pay the OWNER (The OWNER may extend permit on the same terms and conditions be serving written notice of its election to extend on the PERMITTEE at least thirty (30) days prior to the expiration date heretofore stated.) It is understood by the OWNER and the PERMITTEE that this permit is subject to the following conditions: 1. Access road way may not exceed feet in width. 2. Before this permit taking effect, the PERMITTEE shall submit for approval to the OWNER a plan describing the access way’s construction and maintenance. No deviations from this plan will be allowed without the prior written approval of the OWNER. 3. If the OWNER determines that further use of the above described property by the PERMITTEE will interfere with present or future management objectives of the OWNER, this permit may be cancelled by thirty (30) days written notice by the OWNER to the PERMITTEE. Upon cancellation of Access Permit for any reason, Douglas County reserves the right to close the access road. 4. PERMITTEE agrees to grant Douglas County ingress and egress as described on exhibit attached hereto and made a part hereto; and 5. This permit is non-transferable. New landowners must apply for new access permit. 6. No merchantable wood products will be cut without prior written approval of the OWNER. Any wood products approved for cutting will be cut and piled by species; all wood in 100-inch cut to a 4-inch top diameter. 7. All stumps, slash, waste materials, and other debris resulting from the permitted land use shall be disposed of by the PERMITTEE as directed by the OWNER. 8. No cutting or trimming of trees shall be done without prior written approval of the OWNER. 9. The PERMITTEE agrees to reimburse the OWNER for any unauthorized property damage to the subject property that may arise from the permitted construction, maintenance, or use of the described lands. 10. The PERMITTEE shall maintain the area under this permit in a safe and environmentally sound condition at all times, causing no obstruction to free and uninhibited use by the public. 11. Road improvement and upgrading will be supervised by the Douglas County Forestry staff. Prior notification of seven days and approval by the Director of Forestry and Natural Resources or designee is required before work begins, during permit period. 12. No gates, signs, or other articles of the PERMITTEE will be allowed on the OWNER’S land. 13. PERMITTEE agrees to waive any right to any declaration of ownership or interest in the road on county land. 14. Should the general intended use, for which this permit is granted, be changed or altered, this permit shall be automatically null and void by action of the Douglas County Forest, Parks, and Recreation Committee. PERMITTEE assures in writing, per attached document, that no other private access into his/her property can be gain 18. Present and future management, timber sales, timber stand improvement, reforestation or other forest or recreational activity will be of high priority of the OWNER and in no way should be hindered by this permit. 19. This permit does not extend to the PERMITTEE any permission to use County Forest Land for personal use to store equipment, lumber, or other miscellaneous items. 20. This permit does not give the PERMITTEE, its member or agents, any rights pertaining to hunting or trapping said rights remain under the control of the OWNER. 21. The OWNER continues full ownership of the improved roadway and land; however, it will not be liable for maintenance or upkeep of the road. 22. The PERMITTEE agrees to protect, indemnify, and save harmless the OWNER, its agents and employees, from and against all claims, demands, suits, liability and expense, by reason of loss or damage to any property or bodily injury to any person whatsoever, that may arise from the construction and placement of objects on the described lands and from the maintenance or use of the described land, and the PERMITTEE will defend the OWNER in any such action or claims upon request of the OWNER. 23. The PERMITTEE agrees to follow the Best Management Practices for Water Quality. 24. The PERMITTEE is responsible to acquire any necessary licenses and permits to conduct permitted activities and further agrees to conduct no unlawful activities on Douglas County forest property under the guise of this permit or otherwise. 25.
