4.25 PROHIBITING ANY PERSON 18 YEARS OR OLDER FROM CONTRIBUTING TO THE TRUANCY OF A CHILD THE COUNTY BOARD OF SUPERVISORS OF THE COUNTY OF DOUGLAS DOES ORDAIN AS FOLLOWS: SECTION I. CONTRIBUTING TO THE TRUANCY AND TRUANCY DEFINED A. "Contributing to Truancy" means any person 18 years or older who, by any act or omission, knowingly encourages or contributes to the truancy, as defined under Wisconsin Statutes 118.16(1)(c), of a child. An act or omission contributes to the truancy of a child, whether or not the child is adjudged to be in need of protection or services, if the natural consequences of that act or omission would be to cause the child to be truant. B. "Truancy" means any absence of part or all of one or more days from school during which the school attendance officer, principal, or teacher has not been notified of the legal cause of such absence by the parent or guardian of the absent pupil, and also means intermittent attendance carried on for the purpose of defeating the intent of Wisconsin Statutes 118.15. SECTION II. CONTRIBUTING TO TRUANCY PROHIBITED It shall be illegal for anyone 18 years of age or older to contribute to truancy. SECTION III. DISPOSITION Any person found by the Court to have contributed to the truancy of a child may be required to forfeit not more than $500.00. SECTION IV. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional by reason of any decision of any court of competent jurisdiction, such decision shall not affect the validity of any other section, subsection, sentence, clause or phrase or portion thereof. ---PAGE BREAK--- SECTION V. All ordinance and parts of ordinances in conflict herewith are hereby repealed. SECTION VI. This ordinance shall take effect and be in force from and after its passage and publication, as provided by law. Dated this 17th day of January, 1991.
