17.9 1.14 MEDICAL EXAMINER THE COUNTY BOARD OF SUPERVISORS OF THE COUNTY OF DOUGLAS DOES ORDAIN AS FOLLOWS: SECTION I. ESTABLISHMENT Pursuant to Sections 59.34, 59.35, 59.351, 59.352 and 59.353 of the Wisconsin Statutes the Douglas County Board of Supervisors hereby establishes the position of Medical Examiner and further establishes the duties, responsibilities and salary of said position. SECTION II. APPOINTMENT, SALARY The position of Medical Examiner shall be part-time and shall be filled by appointment of the Douglas County Board of Supervisors. The Medical Examiner shall be paid an annual salary based on a C41 classification for the performance of his or her official duties in lieu of all other compensation. The annual salary shall be adjusted, as needed, on an annual basis, with the starting (year 2000) salary to be $10,846. SECTION III. DUTIES A. The Medical Examiner shall make physical examinations and tests incident to any matter of a criminal nature up for consideration before either the Court or District Attorney upon request. Whenever requested by the Court or District Attorney the Medical Examiner shall testify to facts and conclusions disclosed by autopsies performed by him or her, at his or her direction or in his or her presence and shall testify as an expert for either the Court or the State in all matters where examinations or tests have been made. The Medical Examiner shall perform such other duties of a pathological or medicolegal nature as may be required. B. The Medical Examiner shall collect for all services performed, except in cases where the county is solely liable all fees that coroners are by law entitled to receive; and he or she shall keep accurate books of account in which shall be entered from day to day the items of services rendered, and the fees charged and received, and shall, at the end or every three months, render to the County Board of Supervisors and to the County Treasurer an accurate report or statement, verified by his or her oath, of all fees and income collected by them or for them during the three months; and at the same time they should pay to the County Treasurer all fees and incomes collected by them, or which they were entitled by law to charge or receive, not paid to the County Treasurer. SECTION IV. ASSISTANTS The Medical Examiner may appoint such assistants as may be authorized by the County Board of Supervisors. An Assistant Medical Examiner shall be paid for investigations and viewing bodies for cremation at the rates incorporated into the annual budget as approved by the County Board. The duties of an Assistant Medical Examiner shall be identical to those of the Medical Examiner and shall be performed at his or her direction. ---PAGE BREAK--- 17.10 SECTION V. CREMATION VIEWING FEE The following fees are established pursuant to Sections 59.351 and 59.37 of the Wisconsin Statutes: A. Cremation fee - $100.00. B. Disinterment fee - $75.00. C. Death Certificate signing fee - $15.00 The foregoing fees are established upon findings that they are reasonably related to the actual necessary cost of providing the applicable services. Said fees are payable by the estate or family of the deceased. Further, said fees shall apply equally to both in-state and out-of-state residents. Any of the aforementioned fees may be waived upon approval of the Law Enforcement Committee upon a finding that said waiver is in the interest of Douglas County and the general public, and said waiver is nondiscriminatory on the basis of the residency of the deceased. SECTION VI. BOND The Medical Examiner shall post a bond as required by Section 59.353 of the Wisconsin Statutes and in such amount as determined by the County Board of Supervisors. SECTION VII. TERM The Medical Examiner and his or her assistants shall serve at the pleasure of the County Board of Supervisors and are subject to removal by the Board upon a majority vote of members present. SECTION VIII. EFFECTIVE DATE This Ordinance shall take effect on January 1, 1991, upon passage, approval and publication, as required by law.
