CITY OF DOUGLAS PARKWAY TREE TRIMMING & REMOVAL COST SHARE APPLICATION/AGREEMENT Property Address of Mailing Address (if different) Telephone I, to participate in a joint Parkway tree trimming/removal program with the City of Douglas. I understand that applications shall be considered on a first-come first-serve basis, subject to budget availability, provided the tree meets the necessary Deterioration criteria as outlined by the City of Douglas. As a participant in the rehabilitation program, I am required to; 1. Get approval from the City of Douglas authorized representative. 2. Obtain an estimate from a licensed contractor. 3. Complete and submit this application to the City of Douglas Parks Department. 4. After approval, the homeowner must contact and schedule the work to be done with the contractor. 5. After completion the homeowner shall Contact the City of Douglas authorized representative to verify the work is complete and accepted. 6. After contractor has been paid in full by the homeowner, Proof of payment and a signed copy of this application shall be delivered to the Parks Department office. Reimbursement in the amount of 50% (up to $1,000) will be scheduled to pay at the next regularly scheduled time as determined by the Administrative Services Department. Following these same procedures, New trees may be planted in the parkway/boulevard and qualify for reimbursement in the amount of 50% up to $200. Tree species and placement must conform to the building code 5.5.3 Landscape Requirements. 10 – 15 gallon trees and larger will be allowed. Work will be performed only on those trees approved by the Coordinator. Work shall be limited to tree trimming and removal of diseased or declined trees. Projects accepted but not completed due to time, funding or other factors may be placed at the top of the list for the following years. The City of Douglas and its officers, employees, agents, elected officials and successors and assignees hereinafter referred to collectively as "the City" shall not be liable to the Property Owner for any damage to persons or property arising out of or connected in any way with the trimming of trees of Property Owner located in City street parkways /boulevards/ROW or the condition of the Property Owner’s premises. ---PAGE BREAK--- Property Owner agrees to indemnify, defend and hold harmless the City from any and all claims, lawsuits, losses and liability by or on behalf of any person, firm or corporation arising out of or connected in any way with the trimming of Property Owner’s trees located in street parkways /boulevards/ROW or in connection with any act of negligence or omission of Contractors or any of its agents, servants or employees arising out of or connected in any way with the trimming of Property Owner’s trees located in City’s street parkways /boulevards/ROW.
