Chapter 4.26, Page 56 4.26 PAWNBROKERS AND SECONDHAND DEALERS THE COUNTY BOARD OF SUPERVISORS OF THE COUNTY OF DOUGLAS DOES ORDAIN AS FOLLOWS: SECTION I. WISCONSIN STATUTES ADOPTED BY REFERENCE Wisconsin Statutes 134.71 through (10) and (13), and 138.10, and any amendments or successor statutes thereto are hereby adopted and incorporated by reference as if fully set forth herein except that the term "Article" shall include all personal property and antiques except for jewelry as defined in Wisconsin Statutes 134.71 SECTION II. DUTY UPON RECEIPT OF LOST OR STOLEN GOODS Each pawnbroker who shall be offered or shall receive or have in possession any goods, wares, merchandise, articles or things which he/she has reason to believe to have been lost or stolen, shall forthwith notify the sheriff or any member of the sheriff's department. SECTION III. PROHIBITED DEALINGS No pawnbroker, secondhand article dealer, or secondhand jewelry dealer shall take any article in pawn, or purchase or receive any property from any person appearing to be intoxicated, or from any person known to be a thief or to have been convicted of larceny or burglary. SECTION IV. ADDITIONAL RECORDS In addition to the records required under Wisconsin Statutes 134.71(c), all pawnbrokers, secondhand dealers, or secondhand jewelry dealers shall keep and maintain records as required by the sheriff for all personal property not described in Wisconsin Statutes 134.71(1)(a) or SECTION V. ISSUANCE OF LICENSE The Douglas County Board authorizes the County Clerk to issue licenses under this ordinance, upon Sheriff's Department approval of the application, without further County Board approval. ---PAGE BREAK--- Chapter 4.26, Page 57 SECTION VI. If any section, subsection, sentence, clause or phrase or this ordinance is for any reason held to be invalid or unconstitutional by reason of any decision of any court of competent jurisdiction, such decision shall not affect the validity of any other section, subsection, sentence, clause or phrase or portion thereof. SECTION VII. All ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION VIII. This ordinance shall take effect and be in force from and after its passage and publication, as provided by law. Dated this 17th day of January, 1991.
