Chapter 1.18, Page 65 1.18 MEDICAL CARE TO PRISONERS THE COUNTY BOARD OF SUPERVISORS OF THE COUNTY OF DOUGLAS DOES ORDAIN AS FOLLOWS: SECTION I. INDIGENCE STANDARD FOR MEDICAL TREATMENT WITHIN COUNTY JAIL The Ordinance is adopted pursuant to the authority under Sections 59.025 and 302.38 of the Wisconsin Statutes. SECTION II. LIMITATION ON LIABILITY The maximum amount that Douglas County shall pay for the cost of medical or hospital care provided to any prisoner housed at the Douglas County Jail whom it is financially responsible for shall be limited to the amount payable by Medical Assistance under Sections 49.43 to 49.47 of the Wisconsin Statutes, except Section 49.468 of the Wisconsin Statutes, for care for which a Medical Assistance rate exists. SECTION III. INABILITY OF PRISONER TO PAY FOR COST OF CARE It shall be presumed that a prisoner is able to pay for the cost of medical care if his income exceeds the financial eligibility standards established by the State of Wisconsin for AFDC-Related, categorically needy eligibility. In making a determination as to the financial ability of a prisoner to pay for the cost of his medical care, the income of a prisoner shall be counted for thirty (30) days prior to the first date of medical treatment. Douglas County shall not pay the cost of medical and hospital care provided to a prisoner outside of the Jail who exceeds such financial ability of a prisoner to pay for the cost of medical and hospital care, the Douglas County Sheriff or an employee of Douglas County may require a prisoner to complete an application form. In the absence of such a completed form, Douglas County may rely on any other information which is available as to the prisoner=s present income including, but not limited to, the prisoner= s application for representation through the Wisconsin Public Defender=s Office. This ordinance shall not diminish the rights of Douglas County to collect any amount paid on behalf of the prisoner for medical or hospital care from the prisoner or his or her estate in the future. SECTION IV.COLLECTION The Douglas County Sheriff=s Department shall make a diligent effort to collect that value of any medical or hospital care provided to a prisoner, both inside and ---PAGE BREAK--- Chapter 1.18, Page 66 outside the County Jail, or from the prisoner=s estate as provided for in Section 49.08, Wisconsin Statutes. The Douglas County Sheriff, in conjunction with the Douglas County Finance Department, shall formulate a policy with regard to the collection of said monies. SECTION V. SERVICE FEE Any prisoner requesting sick call shall be charged a fee against his or her prisoner account of $10.00 and for prescription medicine. Prisoners will also be charged a $5.00 co-payment for each visit with the jail nurse and $10.00 for each visit with a doctor, excepting emergency responses or direct jail staff referral. No person shall be denied benefit or medical care or medication as a result of having insufficient funds in their account. SECTION VI.EFFECTIVE DATE This ordinance shall take effect on the date following its publication. Dated this 24th day of January, 1996. Amendments: June 15, 2006
