Chapter 1.0, Page 1 1.0 DOUGLAS COUNTY CODE Ordinance Introduced by the Ordinance Committee Adopting and Enacting a New Code of Ordinances of Douglas County, Wisconsin, Establishing the Same; Providing for the Repeal of Certain Ordinances Not Included Therein, Except as Herein Expressly Provided; Providing for the Manner of Amending Such Code of Ordinances; and Providing When Said Code of Ordinances Shall Become Effective. WHEREAS, the County Board of Supervisors of Douglas County, Wisconsin, has previously authorized the preparation and publication of a Code of Ordinances of Douglas County, Wisconsin; and WHEREAS, a copy of such Code compiled in accordance with such authorization has been on file and open for public inspection in the office of the County Clerk for more than two weeks, as required by Section 66.035 of the Wisconsin Statutes; NOW, THEREFORE: THE COUNTY BOARD OF SUPERVISORS OF THE COUNTY OF DOUGLAS DOES ORDAIN AS FOLLOWS: SECTION I. ADOPTION That a "Code of Ordinances" consisting of Chapters 1 through 8, inclusive, is hereby adopted and enacted as the "Code of Ordinances, for Douglas County, Wisconsin", and shall be treated and considered as a new and original comprehensive ordinance which shall supersede all other general and permanent ordinances passed by the County Board on or before April 17,1984, except such as by reference thereto are expressly saved from repeal or continued in force and effect for any purpose. SECTION II. EFFECTIVE DATE That all sections and provisions of such Code shall be in force and effect from and after its printing in accordance with Section 9 hereof, and all ordinances of a general and permanent nature of Douglas County, enacted on final passage on or before April 17, 1984, and not in such Code or recognized and continued in force by reference therein are hereby repealed from and after the effective date of such Code, except as herein provided. ---PAGE BREAK--- Chapter 1.0, Page 2 SECTION III. ORDINANCES REPEALED That such repeal shall not be construed to revive any ordinance or part thereof that has been repealed by a subsequent ordinance which is repealed by this ordinance. SECTION IV. ADDITIONS/AMENDMENTS That any and all additions or amendments to such Code, when passed in such form as to indicate the intention of the County Board to make the same a part thereof, shall be deemed to be incorporated in such Code so that reference to the "Code of Ordinances, Douglas County, Wisconsin," shall be understood and intended to include such additions and amendments. SECTION V. COPIES OF CODE That three copies of such Code shall be kept on file in the office of the County Clerk, preserved in looseleaf form. It shall be the express duty of the County Clerk or someone authorized by him to insert in their designated places all amendments or ordinances which indicate the intention of the County Board to make the same a part of such Code when the same have been printed or reprinted in page form, and to extract from such Code all provisions which may from time to time be repealed by the County Board. This copy of such Code shall be available for all persons desiring to examine the same and shall be considered the official Code of Ordinances of Douglas County, Wisconsin. SECTION VI. PENALTIES That in case of the amendment of any section of such Code for which a penalty is not provided, the general penalty as provided in Chapter 1.1, Sec. III, such Code shall apply to the section as amended or in case such amendment contains provisions for which a penalty, other than the aforementioned general penalty, is provided in another section in the same chapter, the penalty so provided in such other section shall be held to relate to the section so amended, unless such penalty is specifically repealed therein. SECTION VII. UNLAWFUL AMENDMENTS That it shall be unlawful for any person, firm or corporation in Douglas County to change or amend by addition or deletions, any part or portion of such Code, or to insert or delete pages or portions thereof, or to alter or tamper with such Code in any manner whatsoever which will cause the law of Douglas County to be misrepresented thereby. Any person, firm or corporation violating this section ---PAGE BREAK--- Chapter 1.0, Page 3 shall be punished as provided in Chapter 1.1, Sec. III of the Code of Ordinances of Douglas County, Wisconsin. SECTION VIII. REPEALED ORDINANCES That all ordinances or parts of ordinances in conflict herewith or with the Code of Ordinances adopted hereby are, to the extent of such conflict, hereby repealed. SECTION IX. EFFECTIVE DATE That this ordinance shall be in full force and effect from and after its passage and publication of this adopting ordinance according to law and on the 1st day of May, 1984. SECTION X. PUBLICATION That this ordinance shall be printed and published in looseleaf form by order of the County Board. Passed this 17th day of April, 1984
