Chapter 1.16, Page 58 1.16 SMOKING POLICY THE COUNTY BOARD OF SUPERVISORS OF THE COUNTY OF DOUGLAS DOES ORDAIN AS FOLLOWS: SECTION I. POLICY It is the declared policy of the Douglas County Board of Supervisors to promote to the greatest extent possible the health and welfare of Douglas County employees and members of the general public who frequent County-owned buildings and vehicles; and whereas smoking is a proven hazard both to smokers and those exposed to secondary smoke, the Douglas County Board of Supervisors hereby enact this ordinance pursuant to the authority of Sections 101.123 and 59.07 of the Wisconsin Statutes. SECTION II. DEFINITIONS A. "Smoking" means carrying a lighted cigar, cigarette, pipe or any other lighted smoking equipment. B. "Motor vehicle" means any motor driven vehicle capable of transporting a person or property upon a highway including cars, trucks, vans, graders and front-end loaders with enclosed areas; but does not include snowmobiles, all-terrain vehicles or similar devices. C. "Enclosed area" means any area permanently or temporarily enclosed from the outdoors, including temporary vehicle cabs. The opening of a door or window whether temporary or permanent does not remove any area from this definition. SECTION III. PROHIBITION Smoking is prohibited within enclosed areas of any County-owned building or motor vehicle. Exception: Smoking is permissible in the Superior Police Department Interview Room only when an interview is being conducted and the subject being interviewed requests to smoke. SECTION IV.POSTING All enclosed areas of County-owned buildings which are frequently used by the general public shall be adequately posted with "no smoking" signs so as to be visible from any point generally accessible by the public. ---PAGE BREAK--- Chapter 1.16, Page 59 SECTION V. PENALTIES Any person who willfully violates Section III after being advised by an employee or supervisor of the County that smoking within the building or motor vehicle is prohibited may be subject to a forfeiture of Twenty-five Dollars ($25.00). SECTION VI.ENFORCEMENT This ordinance may be enforced through issuance of a citation. The Courthouse Bailiff, in addition to the Douglas County Sheriff's Department, is specifically empowered to issue citations for violations of this ordinance. Department Heads are directed to enforce this ordinance as a matter of policy of the Douglas County Board. SECTION VII. EFFECTIVE DATE This ordinance shall take effect upon passage by the Douglas County Board and publication according to law. Dated this 20th day of May, 1993. Amendments: June 17, 1999
