Chapter 4.18, Page 41 4.18 POSSESSION/CONSUMPTION OF ALCOHOL BEVERAGES BY UNDERAGE PERSON THE COUNTY BOARD OF SUPERVISORS OF THE COUNTY OF DOUGLAS DOES ORDAIN AS FOLLOWS: SECTION I. AUTHORITY Pursuant to the authority of sec. 125.10(2), Wisconsin Statutes, Douglas County does hereby establish this ordinance prohibiting the possession/consumption of alcohol beverages by underage persons. SECTION II. DEFINITIONS A. “Alcohol beverages” means fermented malt beverages, intoxicating liquor or wine. B. "Fermented malt beverages" means any beverage made by the alcohol fermentation of an infusion in potable water of barley malt and hops, with or without unmalted grains or decorticated and degerminated grains or sugar containing 0.5% or more of alcohol by volume. C. "Intoxicating liquor" means all ardent, spirituous, distilled or vinous liquors, liquids or compounds, whether medicated, proprietary, patented or not, and by whatever name called, containing 0.5% or more of alcohol by volume, which are beverages, but does not include "fermented malt beverages". D. “Underage person” means a person who has not attained the legal drinking age in the State of Wisconsin. E. “Wine" means products obtained from the normal alcohol fermentation of the juice or must of sound, ripe grapes, other fruits or other agricultural products, imitation wine, compounds sold as wine, vermouth, cider, perry, mead and sake, if such products contain 0.5% or more of alcohol by volume. SECTION III. UNDERAGE POSSESSION/CONSUMPTION PROHIBITED Any underage person not accompanied at all times by his or her parent, guardian or spouse who has attained the legal drinking age, who knowingly possesses or consumes alcohol beverages is guilty of a violation. ---PAGE BREAK--- Chapter 4.18, Page 42 SECTION IV. PENALTIES Any person violating Section III is subject to the following penalties: A. For a first violation a forfeiture of not less than $100 nor more than $200, and suspension of the person's operating privilege as provided under Section 343.30(6)(b)1., Stats. B. For a violation committed within 12 months of 1 previous violation, a forfeiture of not less than $200 nor more than $300, and suspension of the person=s operating privilege as provided under Section 343.30(6)(b)2., Stats. C. For a violation committed within 12 months of 2 previous violations, a forfeiture of not less than $300 nor more than $500, and suspension of the person's operating privilege as provided under Section 343.30(6)(b)3., Stats. D. For a violation committed within 12 months of 3 or more previous violations, a forfeiture of not less than $500 nor more than $1,000, and suspension of the person's operating privilege as provided under Section 343.30(6)(b)3., Stats. SECTION V. EFFECTIVE DATE Following passage and publication by the Douglas County Board of Supervisors this ordinance shall be in full force and effect. Recreated: January 19, 2006
