Case Number Defendant Street Address City, State and Zip Code AFFIDAVIT FOR SUMMONS OF DISPOSSESSORY Personally appeared, who upon oath says that he is owner or (attorney, agent, or lessee) for the owner of said premises, and that Defendant is in possession as tenant of premises at the above address in DOUGLAS COUNTY. Further Tenant: fails to pay the rent which is now past due. Holds the premises over and beyond the term of which they were rented or leased to him or and that plaintiff is entitled to recover any and all rent that may come due until this action is finally concluded. Plaintiff desires and has demanded possession of the premises and Defendant has failed and refused to deliver said possession. WHEREFORE, Plaintiff DEMANDS: possession of the premises; past due rent of rent accruing up to the date of judgment or vacancy at the rate of per and Sworn to and subscribed before me, this day of Magistrate/Notary Public/Deputy Clerk Affiant SUMMONS To the Constable of the Magistrate Court or Sheriff or his Deputies of said County. GREETINGS: The Defendant(s) named herein is/are hereby commanded and required personally or by attorney to ANSWER, in writing or orally in person at the Douglas County Magistrate Court Filing Office, WITHIN SEVEN DAYS from the date of actual service hereof unless the seventh day is Saturday, Sunday, or legal holiday, in which case the answer may be made on the next day which is not a Saturday, Sunday, or legal holiday. The date of service is shown on the reverse side of this summons under “Sheriff’s Entry of Service”. Should you fail to answer within the time required by law, the Plaintiff/Landlord will be entitled to a WRIT OF POSSESSION as provided by law and judgment shall be granted as prayed for by the Plaintiff herein WITHOUT FURTHER NOTICE TO YOU. IF YOU ANSWER WITHIN THE TIME PROVIDED BY LAW, as stated above, you will be sent a hearing notice to you or your attorney to appear at a hearing before the presiding Magistrate of said county on the 3rd FLOOR, MAGISTRATE COURTROOM, DOUGLAS COUNTY COURTHOUSE, 8700 HOSPITAL DRIVE, DOUGLASVILLE, GEORGIA 30134.
